WELD COUNTY COUNCIL
April 5, 1984 GREELEY. COLO.

The Weld County Council met in regular session in full conformity with
the Weld County Home Rule Charter at 915 Tenth Street, Greeley, Colorado,
April 5, 1984, at 1 :45 p.m.
ROLL CALL
The following members were present in person: President Ralph Waldo,
Vice President DeAnn Emerson, Patricia Anderson, Don Elliott and Bill Rupp.
Also present for the meeting were two members of the press and the Council
secretary.
MINUTES
The minutes of March 15, 1984, stood approved as read.
ADDITIONS AND/OR DELETIONS
A press conference at 4:30 p.m. was added to the agenda.
Three items were deleted from the agenda: 1 ) approval of payment of
bills; 2) a conflict of interest ruling, and 3) an executive session to
discuss a personnel matter.
APPOINTMENTS
The President reminded the Council of their upcoming appointments.
CORRESPONDENCE
The President made the Correspondence File available for the individual
review of Council members. In view of the fact that the County Council will
be the topic of consideration by the Home Rule Charter Amendment Study Committee
on May 8, 1984, the President encouraged as many members as possible to attend
that meeting.
REPORTS
Bill Rupp made a report to the Council concerning the Engineering work-
session he attended February 27, 1984. Mr. Rupp considered this a routine
meeting which did not furnish any direction for the Council to take in its
upcoming audit of the Road and Bridge Department.
UNFINISHED BUSINESS
The Council discussed the upcoming audit of the Road and Bridge Department.
The Council expressed interest in Hyland Associates organizing this audit;
however, Mr. Hyland has never approved the contract between his company and
the Council , as drafted by the Commissioners. Both the Council and Mr. Hyland
take issue with paragraph four of the contract which states that the total
amount of said agreement shall not exceed the sum of $10,000. To be acceptable,
that statement would need to be changed to, "The total amount of contract shall
not exceed the County Council ' s budget less Council 's normal yearly expenses."
This was put in the form of a motion by Don Elliott, seconded by Bill Rupp,
and passed unanimously with a roll call vote. Ralph Waldo agreed to contact
Mr. Hyland about initiating the audit. The Council agreed that once the audit
is begun, Mr. Hyland should advise the Council every three days to keep them
abreast of the study.

The Council discussed setting salaries for Commissioners for 1987 and
1988. No action was taken.
EXECUTIVE SESSION
An executive session was called at 2:45 p.m. to discuss a personnel matter.
The regular meeting reconvened at 3:10 p.m. The meeting was recessed until
4:30 p.m. when a press conference was held.
PRESS CONFERENCE
The meeting reconvened at 4:30 p.m. in the form of a press conference.
Three additional members of the press attended this portion of the meeting.
A Report to the People was read aloud by Ralph Waldo, disclosing overpayment
of salary to the Comissioners for the year 1983 and the first three months
of 1984. The remainder of the meeting was spent answering questions posed
by the press.
ADJOURNMENT
There being no further business, the meeting was adjourned. The time of
adjournment was 5:30 p.m. , on April 5, 1984.
The next scheduled meeting is Thursday, April 19, 1984, at 1 :45 p.m.

REPORT TO THE PEOPLE
So the people may know:
The Weld County Council , pursuant to provisions of the Weld
County Home Rule Charter, reports the following matters:
At a February meeting of the Weld County Council , it was noted
the salaries for the Weld County Commissioners for the year of 1983
appeared to be $28,000 per year, which is greater than the $25,100
for the year 1983 which had been set by Resolution of the Weld County
Council in 1980. Copies of the Resolutions setting salaries had been
forwarded to the County Finance and Personnel Departments in 1980.
The Resolution of the Council indicated the salaries of the County
Commissioners would be $25,100 for 1983; $25,750 for 1984; and $28,000
for the years of 1985 and 1986, with the $28,000 figure to commence
on January 1 of 1985.
A memorandum was sent to Mr. Don Warden as the financial officer
of Weld County requesting an explanation of the over-payment of salary.
On February 22, 1984, following a meeting of elected officials, Don
Warden presented photocopies of what appeared to be a letter from the
County Council to the Department of Personnel of the County, dated
May 3, 1982, stating the salary of the Commissioners would be $28,000
commencing on January 1 , 1983. A later study of the letter showed it
to be an apparent forgery.
When the County Council members learned of the apparent forgery
of a letter dated May 3, 1982, the Weld County District Attorney was
informed. At that time, the District Attorney decided to call in a
special prosecutor to investigate the matter. Consequently, Terence
Gilmore, Deputy District Attorney of Larimer County, Colorado, was
appointed as special prosecutor in this matter and the investigation
was turned over to Mr. Gilmore for appropriate action.
An explanation of the apparent over-payment was requested on
February 22, 1984. The County Council has found no evidence of steps
having been taken to correct the over-payment in the approximate amounts
of $2,900 a year for each of the five County Commissioners. The total
over-payment through 1983 and the first three months of 1984 is
$17,312.50.
Further, no response has been given to the County Council with regard
to the fact it is illegal to change the salary of an elected county official
during his or her term of office, irrespective of any justification.

The handling of the matter is entirely in the hands of the
special prosecutor and his staff at this time, and investigation
has been continuing since the disclosure of this matter to the Weld
County District Attorney on February 24, 1984, by the County Council .
