HomeMy WebLinkAbout20000820.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST RON AND CLAUDIA OLSON FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Ron and Claudia Olson, VI #9900381, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of April, 2000, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Ron and Claudia Olson, property owners, were present at said hearing and were represented by Robert Bruce, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 10, 2000, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. He noticed a trucking business and also noticed that the property owners may have more animals than what is allowed in the Agricultural Zone District. The complaint was turned in to Vickie Brown, Zoning Compliance Officer at that time. December 28, 1999 Complaint received by Vickie Brown. December 29, 1999 Mrs. Olson came into the Department of Planning Services and discussed permit options with Vickie and a planner. A letter was requested from the Olson's describing exactly what uses were occurring on the property. December 29, 1999 Thirty day Zoning Violation Notice was given to the property owner. January 3, 2000 A letter was received from the Olson's regarding the uses on the property. January 12, 2000 Letter was sent to the Olson's from Sheri Lockman, Current Planner. Sheri included a Special Review Permit packet with her letter. February 16, 2000 Second letter sent to the Olson's regarding the uses on the propel ty and describing the violation. A lime frame for submittal of the Special Review Permit was established, allowing two weeks from the date of the letter. February 29, 2000 A Site Specific Development Plan and Special Review Permit was submitted by the applicant for the uses occurring on the property. 2000-0820 March 24, 2000 (approximately) Sheri Lockman called the property owners and discussed the limitations of a Site Specific Development Plan and Special Review Permit for a Home Business, in the Mixed Used Development(MUD) Area. Sheri informed the applicants that if they wanted to continue with their application, as submitted, a Planned Unit Development (PUD) would be required because the property is in the MUD. Sheri indicated to the applicants that an extension of time to complete the PUD would have to be granted by the Board of County Commissioners at the Violation Hearing, since the PUD process is lengthy and a violation is occurring on the property. March 27, 2000 Letter received from Michelle and Brett Bernhardt in support of their proposal. March 30, 2000 Letter sent to the property owners indicating that the violation case was scheduled before the Board of County Commissioners. There is still a commercial trucking operation on the property, therefore is a violation of Sections 31.3 and 31.4 of the Weld County Zoning Ordinance. To bring the property into compliance the property owner must have approved a Planned Unit Development Final Plan and record the plat or remove the commercial business from the property. The following points reiterate earlier concerns noted relating to the trucking business in operation at 3015 County Road 20-1/2, Longmont, Colorado. CONCERNS: • Fumes and noise associated with 10-12 diesel semi-trucks at idle being housed at residential property • Disposal of waste (oil, vehicle fluids, etc.) associated with servicing the same in compliance with health safety standards • Pole barn building approved for construction under false pretenses (submitted to Building Inspection department as an agricultural building) • Possibility of foundation of pole barn poured and set without proper inspections because of information withheld about use of barn • Business in operation for many months after violation brought to the attention of Code Compliance Officers (Sharyn Frasier, Vickie Brown, Joe Mendez, etc.) • Planning Department dismissing valid concerns of neighboring residents in favor of 'working with" the applicant to help bring them into compliance after the fact, even though zoning, business, and building permit violations exist • Possible conflict surrounding the purchase of property specifically for gravel hauling trucking business (would be beneficial to both the agent (Margaret Kobobel - Kobobel Gravel Operations) and buyer as new Kobobel gravel pit starting up directly east of property) I have never met the Olsons personally or otherwise, but feel this blatant violation of county rules has drawn a wedge between them and some neighboring residents. • 04/08/00 14:23 FAX 303 702 0130 MIMEOS LONGMONT II003 I believe property owners should have a right to use their land as they see fit. However, everyone should follow the same standards and fee structures set by the county in regard to building inspections, permitting, and most especially, zoning issues. I have done extensive work of my property and went through the proper channels with permits and inspections as required. I have a great deal of money invested and do not appreciate the Weld County Planning Department's lack of action on this violation for over 6 months. f feel this business is driving my property value down. Many rezoning approvals (agricultural to residential) made by Weld County and by Frederick and Firestone annexing prime farmland outside of their own borders are taking a real toll on this area. It's time to consider the effects on the people (your constituents) who are already in place, and have some sympathy for their concerns. The Planning Department should be accountable for their inability to follow-through with their own (county) policies. Those not in compliance or those who refuse to abide by rules and get caught should be met with a penalty of some kind. Determination of penalties for non-compliance of p, per inspections, permitting, business operation, and zoning issues need to be put i place and enforced. The county needs to penalize those who take advantat.. , of this (current) lack of • enforcement or the county will continue to lose revenue from such. Without any fine structures or penalties in force, it's a no-trainer as to why his continues. The Planning Department always offers to "work with" the applicant to help bring them into compliance, rather than "work with" the people these violations affect. The playing field needs to be leveled for all. They live in an area with a great deal of truck traffic so, their request is not unusual. Their property is located at 3019 WCR 201/2. After plenty of lengthy discussion with the Olson's I believe that what we have is a neighborly dispute. What comes along with that is one person in their area that is very vocal and is exercising their rights without listening to the Olson's. Along the same line, I find that they are not listening to the fact that the Olson's have followed the proper channels with attempting to re- zone their property after receiving their initial violation. The Olson's have been working diligently with Sheri Lockman with the Department of Planning Services to get this resolved and even with that knowledge the neighbor has not quieted her attempt to end the parking of these trucks. It also needs to be noted that a violent act of shooting the windows on all of the trucks did occur on March t9, 2000 and was filed with the Weld County Sheriffs office. At this point it cannot be directly linked to them but, what a coincidence. With this type of violence happening I believe that a message does need to be sent that you cannot just run someone off their property or keep them from doing business. I do share their frustrations but, I believe in the system. My request is that you please allow the Olson's to pursue this PUD for the operation of their business. They would like you to grant them the time needed for processing their application. Both Ron and Claudia are hard worker's and will do what it takes to complete this application. They need you to give them the opportunity. I support them in this endeavor because Ito am in the trucking business and do believe there are a great number of us that are considerate, understanding, and willing to work with the public. We hope this will resolve questions concerning how we use the land in this area. Ron Olson has been driving trucks for o er thirty years for local over-the -road companies and for local construction companies. Ir 1994, he decided to buy his own truck and haul products for himself Double O Trucking, Inc was created at this time to protect the investment of the truck. As we grew we purchased additional trucks, having a total of three in 1999. We haul aggregate, asphalt, potatoes and mail. To be close to those companies we haul for, we paid rent to park these trucks in this area on a farm. Also, having lived in the country ten years agog we had a dream of living in the country again With this in mind, plus knowing we were paying rent to park our trucks, we set out to purchase a home with enough area to have a few pigs, raise a steer, and park our trucks. After spending time looking for the rightlarea, we found the property at 3019 WCR 20 1/2 ideal, and with road seven on the west ssie of the property so well traveled, it was convenient to those businesses for who we haul. After we purchased the home with the small acreage, we had dreams for improvements as do all new home owners- Because they Were bent, won; and not meeting code, we replaced the culvert pipe to the south, Rbad 20 1/2, to 18" to code and the culvert pipe on Road 7 to 30" to code and for safety. Oirr son's construction company had it left over and he brought a backhoe and blade to p}ace them correctly. We have a horse barn, but we wanted a building to store tools and 4xtra hay for more organization of area, plus to be out of the weather. A pole barn was pi ed and built. Having lived on farms before we had no idea we needed a permit to build the barn, but were notified by a Weld County inspector a few days after the material was delivered, that we needed to apply for a ag-exempt certificate. We did apply for the certificate, and a permit for electrical. We started the barn in September and it was'completed in December. Currently, we have three trucks for Double O Trucking, Inc parked on the property We have one driver. Because these trucks have to be plugged in during winter months, Dequasie pays four electricity. The drivers of all trucks arrive daily from 6:00 A.M to 7:00 A.M. Their vehicles are parked on the east side of the property by the pole barn during the day. The drivers start the trucks in the morning to allow them to warm up for about ten minutes in the rater, much less time is required in the summer. The neighbors here rarely know when t ey have gone for the day. The noise they create is very minimal. In fact, the local traffic o Road 7 (on the west side of the property) is much more noticeable with regard to n ise. There are no trucks working on the property during the day. The trucks park and end their day from 4 to 6 in the evening. These trucks haul sand, gravel, asphalt, potatoes, etc for businesses needing their services. There are no customers or advertising. All trucks have a name on them as required by the Department of Transportation. They also have stickers in the window required by the Public Utilities Commission. These trucks must follow all rules as set by the State of Colorado for safety. The Department o,'Transportation can inspect any and all trucks randomly. In conclusion, this is not a home based usiutess. All income is made by delivering goods for a business (point a)to a specific location (point b) as determined by that business. All hauling business is done daily "On The Road" and not at 3019 WCR 20 1/2, Please note that we have been told on ❑ merous occasions, that this acreage looks better than it did before we purchased it.
