Pt , C A , C m , sa, He_ RECEIVE • . 8 PETITION FOR ANNEXATION OF UNINCORPORATED TERRITORY IN 1'ti_z COUNTY OF WELD, STATE OF COLORADO TO THE TOWN OF LASALLE, COLORADO TO THE MAYOR AND BOARD OF TRUSTEES OF THE TOWN OF LASALT F, COLORADO: The undersigned, in accordance with the Municipal Annexation Act of 1965, Part 1, Article 12, Title 31, Colorado Revised Statutes, as amended, hereby petition the Board of Trustees of the Town of LaSalle, Colorado, for the annexation of the following described unincorporated territory locates, in the C.nunty of Weld. State of Colorado. to-wit: FOR LEGAL DESCRIPITION, PLEASE SEE ATTACHED In support of said Petition, your Petitioners allege: 1. It is desirable and nr-ecvlry that the above-described unincorporated territory be annexed to the Town of LaSalle, Colorado. 2. The requirements of Section 31-12-104, C.R.S., as amended, exist or have been met, to-wit: a. Not less than one-sixth of the perimeter of the area proposed to be annexed is contiguous with the Town of LaSalle; b. A community of interest exists between the area proposed to be annexed and the Town of LaSalle; c. Said area is urban or will be urbanized in the near future; and d. Said area is integrated with or is capable of being integrated with the Town of LaSalle. 3. The requirements of Section 31-12-105, C.R.S., as amended, exist or have been met, to-wit: a. In establishing the boundaries of the area proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of 8. Pursuant to Town of LaSalle Ordinances Section 15-10, the following information is provided: a. Petitioners have read the LaSalle Annexation Ordinance and will comply with its provisions. b. The boundries of all special districts having jurisdiction over the area to be annexed as well as rights-of-way, utility easments, water and ditch rights are identified on Exhibit B. c. A Certificate of Ownership and Encumbrances showing that the property to be annexed is owned in fee simple, clear of all liens and encumbrances except for the current year's property taxes is attached hereto and known as Exhibit D. d. The names and street and mailing addresses of all property owners within 300 feet of the land proposed to be annexed is attached and known as Exhibit D. c. Petitioners propose that the property to be annexed be zoned R-1 and PUD. 9. The Petitioners agree to pay, prior to final approval pf annexation by the Board of Trustees, all publication costs, recording fees, and any other reasonable expenses incurred by the Town in reviewing this Petition. 10. Subject property is presently under contract for purchase by Thomas G. Fisher and or assigns. The closing date may occur prior to the final approval of annexation, at which time Denise Nicholson, Trustee for the Fern E. Johnson Trust, and Stephanie Barron, Trustee for the Fern E. Johnson Trust, will both withdraw their signatures from the Petition. Upon the withdrawl of their signatures. Thomas G. Fisher's signature will be the remaining petitioner signature. If the closing on subject property does not occur prior to the final annexation approval, Thomas G. The Board of Trustees of the Town of LaSalle,Colorado hereby finds that the Annexation Petition submitted for the annexation of the property denominated as the Sunset Ridge Annexation, as described on Exhibit A attached hereto and incorporated herein, is in substantial compliance with the requirements of C.R.S. 31-12-107(1) as amended. 2. The proposed for PUD will be named Fern Estates and the R-1 use will be known as Sunset Ridge. 2.
