We recommend for approval of the proposed use with the following conditions: 1. The applicant shall remove, handle,and stockpile manure front the livestock area in a manner tl at will prevent nuisance conditions. The manure piles shall not he allowed to exist cr deteriorate u a condition that facilitates excessive odors,flies, insect pests,or pollutant runoff. The surface beneath the manure storage areas shall he of materials which are protective of State waters. These areas shall be constructed to minimize seepage or percolation of manure contaminated water. In no es cot the facility impact or degrade waters of the State in violation of the Confined Animal Feeding Operations Control Regulation (5 CCR 1002-19). 2:. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Faci.lites At t, 30-20-100, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. 4.. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive coat, blowing debris, and other potential nuisance conditions. 5. Fugitive dust shall be confined to the site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial ic ne as delineated in 25-12-103 C.R.S., as amended. 7. Any existing septicsystem(s)whichisnotcurrentypermittedthroughtheWeldCountyDepartment of Public Health&Environment, Environmental Health Services will require an l,S.D.S. Evaluation prior to the issuance of the required septic permit(s). In accordance with Section 3.1 of the Weld County Individual Sewage Disposal System Regulations a toilet and sewage disposal system shall be provided for patrons of the facility. A) In the event the facilities available in the existing home,or any other existing on-site facilities, wi II serve patrons of the site the septic system serving the structure shall be reviewed by a Colorad=o Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sizec or constructed the system shall be brought into compliance with current Regulations. B) In the event a new septic system will he installed to serve patrons of the facility the system shall he designed by a Colorado Registered Professional Engineer according to the Weld County End ivid ual Sewage Disposal Regulations. 9. The facility shall maintain compliance with Confined Animal Feeding Operations Control Regulations (5 CCR 1002-19) and Sections 45 and 47 of the Weld County Zoning Ordinance, as amended. 10. The facility shall be operated in a manner to control odors. Additional controls shall be implemer ted at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off-site meet or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations,or in the:judgemen of the Weld County Health Officer,there exists an odor condition requiring abatement. 11. The facility shall be operated in a manner to control flies. At all times,the facility shall be operated in accordance with the approved fly control plan. Additional fly control measures shall be implemented at the request of the Weld County Department of Public Health and Environment in the event that flies(which can be determined to be associated with the facility)are in such a number to be considered a nuisance condition. The plan shall also be implemented in the event the Weld County Department of Public Health and Environment receives a significant number of fly (associated with facility)complaints,and in the judgement of the Weld County Health Officer,there exists a fly condition requiring abatement. 12. September 27, 2000 SEP 29 2000 Sheri Lockman RECEIVED Weld County Planning Department 1555 N. 17th Avenue Greeley, CO 80631 Subject: USR-1288 Michael Goss Site Specific Development Plan and Special Review Permit for an Agricultural Service Establishment(Animal Training and Boarding) in the Agricultural Zoning District Ms. Lockman, The City of Greeley Planning Commission considered the Site Specific Development Plan and Special Review Permit submitted by'Mike Goss yesterday at its regularly scheduled meeting. Planning commission voted 7-0 ro recommend denial of the proposal to the Weld County Planning Commission. The City of Greeley Planning Commission found that the proposed animal training and boarding facility with up to 40 animals does not comply with the policies and intent of the City of Greeley's Comprehensive Plan and would not be compatible with the anticipated urban population of residents and businesses in the immediate vicinity.. It should be noted that the subject property is located approximately 800 feet from the nearest current City of Greeley municipal limit and there is an annexation located south of US Highway 34 between 65th Avenue and 71" Avenue currently under review by the City. If that annexation is approved, the subject property would he immediately adjacent to the City of Greeley municipal limits and would be eligible for annexation. If the Weld County Planning Commission does approve the proposal,the City of Greeley Planning Commission recommends the following conditions: 1)The site should comply with the City of Greeley odor regulations. 2)The maximum number of cattle allowed on the property should be limited to 2 per acre, 3) All access and parking areas on-site should be paved in concrete or asphalt. 4) A buffer yard E(standards attached) should be provided to the residential properties to the east and west. This project falls under the purviev of the Weld County Use by Special Review Standards. Our comments and requirements are as follows COMMENTS: West 28th Street is considered a frontage road controlled by the Colorado Department of Transportation (CDC T), who has all jurisdiction to the state highway system. Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify an access permit or for any additional requirements that may be needed to obtain or upgrade he permit. REQUIREMENTS: ?arking and Circulation: The applicant shall identify a 60-foot turning radius between the garage and the ho se barn. This clear area shall accommodate a turnaround for trucks with horse trailers utilizing the site. There Nill be no parking allowed in this clear zone. Additional parking shall be identified south of the garage and adjac nt to the property line. Both areas shall be identified on the plat. There shall be no staging of trucks with horse trailers or overflow vehicle parking on West 28th Street adjacen to the proposed facility.
