The Weld County Health Department has reviewed this proposal. We have also observed the site.
The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water
will be provided by the Little Thompson Water District and sewer will be provided by individual sewage
disposal systems. The minimum proposed lot size of 2.47 acres coupled with the overall density of
one septic system per 5.0 acres meets current Department policy. However, there was no
commitment letter from Little Thompson Water District in the application materials.
The application materials that we received did not include an impact plan as required in section 6.3.1
of the PUD Ordinance.
The application states that the property lies within Flood Zone C. All septic systems installed in a flood
plain are subject to the Weld County Flood Plain policy.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from the Little Thompson Water District for each lot.
2. A Weld County Septic Permit is required for each proposed septic system and shall be installed
according to the Weld County Individual Sewage Disposal Regulations.

each lot. Septic system envelopes should meet the required setbacks as described in the Weld
County Individual Sewage Disposal System Regulations
4. Language for the preservation and/or protection of the second absorption field envelope in the
development covenants. The covenants should state that activities such as landscaping (i.e.
planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.) are
expressly prohibited in the designated absorption field site
5 All septic systems installed in a flood plain are subject to the Weld County Flood Plain policy.
& Each septic system shall be designed for site-specific conditions, including but not limited to
maximum seasonal high groundwater, poor soils, and shallow bedrock.
7 During development of the site, all land disturbance shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions, at the request of the
Weld County Health Department, a fugitive dust control plan must be submitted.

The Weld County Public Works Department has reviewed this Subdivision's Change of Zone
request. Our comments and requirements are as follows:
External Roads: An access permit will be required from the Colorado Department of
Transportation. The developer will be required to verify that the silo is not within the intersection
sight distance triangle.
Internal Streets: Internal local streets have the required 60 feet of right-of-way. All internal
roadways in a Planned Unit Development are required to be paved. The minimum paved roadway
width is 32 feet wide (2-12 foot lanes and 2-4 foot shoulders). The "existing buildings to be
shortened" will be required to meet standard setbacks.
Drainage: The detailed Drainage study, signed by a Colorado licensed engineer, was not
submitted. This report will be required for the final plat. All roadway culverts will need to evaluated
in the study. Access should be provided to all drainage facilities. The developer should address
who will maintain the retention pond.
Traffic Report: A traffic impact study will not be required for this Subdivision.

Dear Mr. Gathman:
We have reviewed the additional information you sent to us via fax on June 7, 2000 related to
above referenced proposal to subdivide a 20-acre parcel into four single-family residential lots. We
recently commented by our letter dated June 1, 2000, indicating that we needed additional information
on the proposed water supply. The Little Thompson Water District (District) has been identified as the
water provider; and recently submitted information includes a letter dated April 3, 2000 for commitment of
service from the District. The District's letter of commitment refers to serving a total of three residential
dwellings and item (3) of that letter refers to serving only two new lots. Based upon District's letter of
commitment, we have no objection to the water supply for a total of three-lot subdivision. Additionally,
we also do not object to a four-lot subdivision provided the District commits to serving all four lots.
Based upon the above and pursuant to Section 30-28-136(1)(h)(II), the State Engineer's Office
offers the opinion that the proposed water supply will not cause material injury to existing water rights
and the supply is expected to be adequate provided the Little Thompson Water District provides a letter
of commitment for service to the County to serve the proposed number of lots.

1. Proper building permits shall be obtained prior to any construction or excavation.
2. Building permits are required for any accessory buildings being constructed or moved onto the
property. Additionally, permits are required for any decks and patios.
3. All foundations of principal dwellings will be required to be engineered. The engineered foundation
shall be based on a site specific geotechnical report or an "open hole" inspection made by a
Colorado licensed engineer. Any structural fill material placed must be of the type allowed by the
1997 Uniform Building Code (UBC) and be compacted to a minimum of 90%. The test results of
that compaction must be supplied to the Weld County Building Inspection Department.
4. Normally engineering is not required for accessory buildings. However, in some cases it is required
(See 20.1.13 of The Weld County Building Code Ordinance).
5. All buildings or structures shall maintain distances from property lines and adjacent buildings as
outlined in Table 5-A of the 1997 Uniform Building Code.
6. When building permit applications are accepted, a complete plan review is done. A review of the
building or structure by the Weld County Inspection Department may reveal other building issues or
areas needing attention.
There are some clarifications and additional requirements from the S-504 referral.

Re: Markham PUD
We have completed our review of the materials submitted in support of the above
referenced application as well as the general and engineering geology of the site. A field
visit was performed on Jan. 3,1999 to confirm site conditions.
• There appear to be no geology-related conditions associated with this site which would
preclude this development as proposed. Pierre Shale bedrock or soils derived from it
may be present at shallow depth, requiring specialized foundation and ,perhaps, septic
system design. Additionally, there is some potential for the accumulation of radon gas in
dwellings built on these soils.
We suggest that the foundations for these structures be based on site-specific soils
investigations and that radon-mitigative design be considered for all occupied structures.
Given the above comments, we have no objection to the approval of this PUD
application.

Thompson School District R2-J Development Impact Report
Markham SD, dated 5/15/00 with 4 dwelling units, is located within the current attendance boundaries of Berthoud
Elementary School,Turner Middle School,and Berthoud High School. Construction is estimated to start in 2001
months and build at an annual rate of 2 dwelling units per year resulting in an expected growth in enrollment of 2
elementary, 1 middle school and 1 high school students by 2002.
According to Master Plan 1999's five-year projection, the estimated student population from this development,
and others that have received final plat approval, will not cause district enrollment to exceed service level C.
Five years is the longest projection time frame considered reliable. (Currently, the high schools in the Loveland
area are at service level D. This situation will continue until the new high school opens in the fall of 2000. However,
this development is not expected to have major impact on student enrollment prior to that time)

• Berthoud Elementary is currently at service level A. Berthoud Elementary is expected to remain at this level
during the next five years. The 1996 bond package included additions scheduled for 1999 at Berthoud High
School and for 2001 at Turner Middle School. Turner is expected to be temporarily operating at a service level U
in five years.
• The District's citizen-based Master Plan Committee (MPC) monitors capacity levels at each of the district
schools and makes annual recommendations for responding to projected enrollment changes. In consideration of
the probable impact(s) of this development, the MPC may recommend using one or more of the tools described on
the back of this report. The selection and timing of the most appropriate tool(s) will be determined by the Board
of Education. These tools do not affect class size or services available to students. The student-to-teacher ratio

The Berthoud Fire Protection District has completed it's review of the plans submitted for the
Markham Subdivision, Case Number Z-545. The Berthoud Fire Protection District is requiring
the following:
1. Two approved fire hydrants, with an available fire flow of a minimum of 1,000 gallons of
water per minute, shall be located at the following locations:
A. 600 feet South of the Intersection of Highway 56 and Markham Court.
B. 600 feet South of the above proposed fire hydrant site.
2. A turnaround is required 600 feet South of the Intersection of Highway 56 and
Markham Court in addition to the Cul-de-Sac at the South end of Markham Court.
Please reference the two attached policies regarding the above requirements:

SECTION I PURPOSE
1 . 1 The purpose of this policy is to set standards within the
Berthoud Fire Protection District regarding fire department
development access .
SECTION II ACCESS PREFERENCE :
2 . 1 The Berthoud Fire Protection District, as a safety
consideration, prefers two points of access to a development .
a. Two points of access provides the fire department an
alternative access to the development in the event that
one of the two access points is blocked.
b. Two points of access also provides the public emergency
egress from a development should a site evacuation be
required.
SECTION III SPECIFICATIONS
3 . 1 Dead-Ends : Dead-end fire department access roads generally
will not exceed 400 ft. within urban areas and 600 ft , within
rural areas of the District, as defined by the chief.
Special consideration for fire apparatus turnaround will be
made for dead end fire department access roads which exceed
400 ft . within the urban areas and 600 ft. within the rural
areas of the District, as defined by the chief.
a. Street may be widened to allow for fire apparatus
turnaround which meets Section 3 . 2 .
b. Fire apparatus turnarounds will be required for dead end
roads which exceed 400 ft. within the Town of Berthoud
and 600 feet within the rural areas of the District.
1 . Fire apparatus turnarounds will be required on dead
end roads within the urban areas as defined by the
chief as follows : 401 ft. and portions thereof in
400 ft. increments .
2 . Fire apparatus turnarounds will be required on dead
end roads within the rural areas of the District as
follows : 601 ft. and potions thereof in 600 ft.
increments .

3. 2 Turning Radius : Dead-end fire department development access
roads shall have a minimum of a 50 ft . turning radius for the
turning around of fire apparatus .
The Berthoud Fire Protection District may also approve the use
of Y on hammer head turnarounds .
3 . 3 Grades : The Berthoud Fire Protection District would prefer
that on open streets the grade of incline would not exceed 6%
and on intersections the grade of incline would not exceed 4% .
However, fire department development access roadways shall not
have a grade of incline which exceeds the standards set forth
by the appropriate political subdivision planning department
street standards.
3 . 4 Street Widths: Street widths shall be in accordance with the
appropriate political subdivision planning department street
standards .
3 . 5 Street Names : Street names shall have the names of existing
streets which are in alignment in the county or in an
adjoining county or municipality.
There shall be no duplication of street names within the area.
3 . 6 Street Surface: Fire department development access roadways
shall be designed and maintained to support the imposed loads
of fire apparatus and shall be provided with a surface so as
to provide all weather driving capabilities .
3 . 7 Timing: Access roadway for use of fire apparatus shall be
provided to the immediate job site at the start of above
ground combustible construction.
The temporary fire department access roadway shall be at least
20 ft . in unobstructed width, with an unobstructed vertical
clearance of 13 ft . 6 in. and capable of supporting fire
apparatus .
Fire department development access shall be completed as
outlined in Section 3 . 1 through 3 . 6 prior to occupancy.

FIRE PROTECTION SPECIFICATIONS
SECTION I PURPOSE
1.1 The purpose of this policy is to set a standard within the authority of the Berthoud Fire
Protection District regarding water distribution lines, fire hydrant specifications/location and
required fire flow.
SECTION II WATER DISTRIBUTION SYSTEM
2.1 All areas served by municipal or district water distribution systems or located within one (I)
mile of systems capable of supplying required fire flow shall meet the following water
distribution line size:

2.2 Larger diameter water distribution lines may be required. For above types of developments,
based on the required fire flow outlined in Table No. A-111-A-1, Minimum Required Fire
Flow and Flow Duration for Buildings,Uniform Fire Code, 1991 Edition.
2.3 Dead end water distribution lines shall be minimized by looping all main lines when possible.
2.4 Dead end water distribution lines,in residential and commercial/industrial areas, over 300 feet
shall be an oversized water distribution line if used for fire protection as recommended by an
Engineer's report.
The Engineer's report shall specify the following:
1. water distribution line size
2. residual water pressure at proposed hydrant locations
3. available water (g.p.m.) at proposed hydrant locations

SECTION III FIRE HYDRANT SPECIFICATIONS/LOCATIONS
3.1 All fire hydrants installed within the authority of the Berthoud Fire Protection District shall
meet the following standards:
a. All fire hydrants will be A24015 Mueller improved, A423 AWWA Mueller Centurion
or approved equal.
b. All hydrants will have a five and one-quarter (5 1/4") inch or larger valve opening,
two (2)two and one-half(2 1/2) inch hose nozzles, one (1) pumper nozzle and a six
(6) inch or larger mechanical joint inlet.
c. All nozzles shall have National Standard threads.
d. The hydrant shall be of traffic hazard type with safety features which will prevent
barrel breakage.
e. Specifications for the operating nut and stubs and cups shall be one (1) inch square
or pentagon and open right.
3.2 Single and two family residential developments shall have fire hydrants spaced so that no
structure shall be more than 500 feet from the hydrant as measured via the street. Hydrants
shall not be more than 1,000 feet apart.
3.3 Multiple family(higher density than two family) developments shall have fire hydrants spaced
so that no structure shall be more than 500 feet from a fire hydrant as measured via the street.
Hydrants shall be not more than 1,000 feet apart.
3.4 Commercial and industrial developments shall have fire hydrants spaced so that no structure
shall be more than 500 feet from a hydrant as measured via the street. Fire hydrants shall not
be more than 1,000 feet apart.
3.5 When a multiple family dwelling, commercial or industrial building protected by a fire
protection system and the fire department connection is in excess of 150 feet from a fire
hydrant, there shall be required an on site fire hydrant and water distribution lines capable of
supplying the required fire flow.
3.6 Fire hydrants shall be connected to loop water distribution lines, whenever possible.
3.7 Fire hydrants shall be within 15 feet of the curb or designated roadway and with no
obstruction within 3 feet.
3.8 When fire protection facilities (i.e., fire hydrant, water distribution lines, etc.) are to be
installed, such facilities, including all surface access roads, shall be installed and made
serviceable prior to and during the time of construction.

SECTION IV REQUIRED FIRE FLOW
4.1 All areas served by municipal or district water distribution systems or located within one(1)
mile of systems capable of supplying required fire flow shall meet the following minimum fire
flow:

4.2 Additional fire flow Gallon age may be required, for the above types of developments, based

4.3 In an area where a building is to be constructed and there are no fire hydrants to obtain
available water (g.p.m.), the following will be required prior to this agency completing the
plan review process:
1. An Engineer's report stating.:
a. if not installed, the water distribution line size required to meet fire flow
calculations
b. residual water pressure at proposed fire hydrant location(s)
c. available water(g.p.m.) at proposed fire hydrant location(s)
d. number of fire hydrants needed to provide required fire flow
SECTION V WATER SUPPLY IN AREAS WITHOUT MUNICIPAL OR
DISTRICT WATER DISTRIBUTION SYSTEMS
5.1 In areas more than one mile from a municipal or District water distribution system capable
of supplying the required fire flow, rural water supplies may be utilized.
5.2 Design and construction of cisterns,reservoirs, etc., shall be in accordance with NFPA 1231.
5.3 The owner/occupant shall provide and maintain fire department accessibility.

Dear Chris:
_ We have reviewed the above referenced proposal to subdivide a 20-acre parcel into four single-family
residential lots. We previously commented by our letter dated December 17, 1999, on a proposed five
lot subdivision of this 20-acre parcel. As commented before, the Water Supply Information Summary
requested in the State Engineer's memorandum of August 7, 1995 was not included and no water supply
requirements were identified. In addition, the Little Thompson Water District has been identified as the
water provider; however, no letter of commitment for service was included. As outlined in 30-28-133(3),
C.R.S., the subdivider is required to submit adequate evidence that a water supply that is sufficient in
terms of quality, quantity and dependability will be available to ensure an adequate supply of water The
applicant has not provided adequate evidence to support this requirement.
Based upon the above and pursuant to Section 30-28-136(1)(h)(II), it is our opinion that sufficient
evidence has not been submitted, documenting that the proposed water supply can be provided without
causing injury to existing water rights or that the proposed water supply is adequate.

Dear Mr. & Mrs. Markham,
This is a correction letter regarding the fire protection and access requirement for the above
subdivision. The requirements outlined in our letter to you dated May 20, 2000 are incorrect.
These requirements were drafted upon review of the previous plot plan. Based upon the revised
zone plat the fire protection and access requirements are as follows:
1. Install one approved fire hydrant, on a minimum of a six inch water distribution line, at the
South end of the proposed cul-de sac. The minimum required fire flow for a residential
subdivision is 1,000 gallons of water per minute.
Note: The above requirement applies to one and two family dwellings having a fire area
which does not exceed 3,600 square feet. For one and two family dwellings exceeding
3,600 square feet additional fire flow is required as follows:
3,600 sq. ft. to 4,800 sq. ft 1,700 gallons of water per minute
4,801 sq. ft. to 6,200 sq. ft 2,000 gallons of water per minute
6,201 sq. ft. to 7,700 sq. ft 2,250 gallons of water per minute
7,701 sq. ft. to 9,400 sq. ft 2,500 gallons of water per minute
9,401 sq. ft. to 11,300 sq. ft 2,750 gallons of water per minute
11,301 sq. ft. to 13,400 sq. ft 3,000 gallons of water per minute
13,401 sq. ft. to 15,600sq.ft 3,250 gallons of water per minute
