The Weld County Public Works Department has reviewed this change of zone request. Our comments and
requirements are as follows:
COMMENTS: The engineer has submitted a sketch showing an acceptable intersection alignment. The
plat shall be modified to show a right-of-way dedication limited to 60 feet along this alignment. The
developer should consult with the Department of Planning Services on the use of the remaining parcel. The
secondary access shall be gated.
The drainage study proposes individual detention areas for each lot. This will be very difficult to maintain.
One detention basin for the entire site will be required. The information provided did not include a water-
surface elevation for the 100-year storm event. This should be provided.
RECOMMENDATION: Approval
DEVELOPMENT CONDITIONS (If Approved):
❑ The final plat shall be modified to show a 60-foot right-of-way on the internal street.
❑ The drainage study shall be modified to allow a detention pond for the entire site, and a water
surface elevation shall be provided for the 100-year storm.

The Weld County Health Department has reviewed this proposal. A member of our staff has
also observed the site. The application states the proposal is for 4 lots with a conservation
easement. However, the maps included in the application have delineated 5 lots and a
conservation easement.
The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service.
Water will be provided by the Little Thompson Water District and sewer will be provided by
septic systems. The proposed lot sizes(minimum of 2 acres) and the overall density of one
septic system per 9 acres meets current Departmental policy. A commitment letter from Little
Thompson Water District was included in the submitted materials.
The initial impact plan provided in the application materials adequately addresses all potential
impacts as required by section 4.2.5.14 of the PUD Ordinance
In a memo concerning this sketch plan dated June 14, 2000, the Department requested a
percolation test and a logged profile pit/hole to 10 feet on each lot due to shallow groundwater
in the 1993 Empire Laboratories site investigation. The Department did not receive any current
data on the depth to groundwater or percolation rates. However, if engineered septic systems
are required, there should be space to accommodate the absorption fields. The Department
also requested that primary and secondary septic system envelopes be designated on each
lot, and that there be language included in the development covenants for the preservation
and/or protection of the second absorption field envelope for future use. This was not included
in the application materials.
Therefore, the Department recommends for approval with the following conditions:
1. The applicant shall obtain water service from the Little Thompson Water District .
2. Primary and secondary septic system envelopes shall be designated on each lot. Each
envelope must meet minimum current setbacks as specified in the Weld County
Individual Sewage Disposal System Regulations. -
3. Language for the preservation and/or protection of the second absorption field envelope
shall be placed in the development covenants. The covenants should state that
activities such as landscaping (i.e. planting of trees and shrubs) and construction (i.e.
auxiliary structures, dirt mounds, etc.) are expressly prohibited �, ianninS Deft

4. A Weld County Septic Permit is required for each proposed home septic system and
shall be installed according to the Weld County Individual Sewage Disposal System
Regulations. Each septic system shall be designed for site-specific conditions, including
but not limited to maximum seasonal high groundwater, poor soills, and shallow bedrock.
5. The applicant shall obtain a storm water discharge permit from the Water Quality
Control Division of the Colorado Department of Public Health and the Environment, if
required. Silt fences shall be maintained on the down gradient portion of the site during
all parts of the construction phase of the project.
6. During development of the site, all land disturbance shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions, at the request
of the Weld County Health Department, a fugitive dust control plan must be submitted.
7. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and
practical methods which are technologically feasible and economically reasonable in
order to minimize dust emissions.
8. If land development creates more than a 25 acre contiguous disturbance, or exceeds 6
months induration, the responsible party shall prepare a fugitive dust control plan,
submit an air pollution emissions notice, and apply for a permit from the Colorado
Department of Public Health and Environment.
9. The current Right to Farm Covenant as included in the Weld County Comprehensive
Plan dated October 31, 2000 shall be placed on the plat.
10. The installation of any septic system within the 100-year flood plain shall comply with the
Weld County I.S.D.S. Flood Plain Policy. In accordance with the Colorado Department
of Public Health and Environment I.S.D.S. Guidelines, no septic system shall be
installed within the floodway.

Dear Ms. Chester:
Based on the authority conferred to the U.S. Fish and Wildlife Service (Service) by the Endangered
Species Act of 1973 (ESA), as amended (16 U.S.C. 1531 et seq.), the Service reviewed the Albert
Challenger development in Weld County, Colorado (Section 29 , Township 5 North, Range 67
West). Mr. Challenger contacted the Service following a suggestion from the Colorado Division of
Wildlife (CDOW) that the proposed project be reviewed for possible impacts to the Preble's
/^ meadow jumping mouse, Zapus hudsonius preblei, (P,reble's). While we consider the Big
Thompson River to support potential Preble's habitat, Preble's has not yet been documented to
occur on the Big Thompson River in Weld County.
Proposed lots #1 through#5 are composed largely of existing agricultural fields. After reviewing
project plans with Mr. Challenger, we believe that the proposes development of lots 1 trough 5 will
not adversely affect any Preble s population that may be present along the Big Thompson River
provided that:
• restrictions are placed on lots #3, #4, and#5 regarding any activities that may degrade
riparian and wetland habitats within the 100-year floodplain of the Big Thompson River, and
• restriction are put in place to prohibit lot owners from allowing domestic dogs and cats to
range unsupervised into riparian and wetland habitats.
In addition, we recommend that future development of any "public viewing area" minimize impact
to existing habitat and avoid disturbance to the heron colony.

Re: Challenger Ranch PUD
Dear Ms. Chester
The above referenced PUD is proposed for approximately 54 acres in part of the
northwest quarter and north half of the southwest quarter, section 29, township 5 north, range
r.. 67 west of the 6"' P.M., in Weld County. The PUD proposal suggests that because only 5
residential units will be located in the project, the impact on the school district will be minimal
and that the developers recognize the need for a cash in lieu of land contribution.
Although the addition of 5 housing units in itself does not have a great impact on the
school population, the cumulative impact of multiple PUD's similar to this, in scattered, small
subdivisions will ultimately have a substantial, negative impact on the school issues of facility
capacity, site selection, and increased transportation costs. Specifically, given the sparcity of
the populations it is more difficult to serve the transportation needs of the students.
Recommendations
The school district remains very concerned about the recent trend toward accelerated
residential activity and the ensuing enrollment that will follow as well as the district's physical
and financial abilities to serve that growth. it is recommended that the cash in lieu of land
contribution be set at the amount of $750 per housing unit. Further, it is requested that
mitigation be provided to offset the unmet capital costs that will be experienced for school
structures. Without such mitigation and agreement, the school district reserves the right to
recommend denial of the proposed preliminary plan and plat as well as any subsequent
subdivision applications. Another option may be to request action by the County to adopt a
growth management mechanism that will limit residential development to a pace that the district
can feasibly accommodate.

1. Proper building permits shall be obtained prior to any construction, remodeling, demolition or
excavation.
2. Any construction connected with the rookery will also require appropriate permits and inspections.
Public areas will likely require handicap accessibility. (See Appendix Chapter 11 of the 1997
( ' Uniform Building Code-UBC)
3. Building permits are required for any accessory buildings being constructed or moved onto
property. Any accessory buildings containing livestock or poultry, shall be wired according to
Article 547 of the 1999 National Electrical Code (NEC).
4. Separate building permits are required for all monument signs. Signs shall adhere to Section 42 of
the Weld County Zoning Ordinance and Section 2.8 of the Weld County MUD Ordinance as
applicable. Engineering may be required.
5. Engineered foundations are required for all primary residences and may be required for accessory
buildings. Engineered foundations shall be based on a site-specific geotechnical report or an open
hole inspection performed by a Colorado licensed engineer. Any fill material shall contain no rock
or similar irreducible material with a maximum dimension greater than 12 inches. All fills shall be
compacted to a minimum of 90 percent of maximum density. Engineering reports shall be supplied
for all fill material.
6. All buildings or structures shall maintain distances from property lines and adjacent buildings as
outlined in Table 5-A of the 1997 Uniform Building Code.
7. Setbacks to oil and gas facilities shall be as required by The Weld County Zoning Ordinance.

The Division of Wildlife received the request from you agency for
comments concerning case #'S-533, Albert Challenger
development/conservation easement.
According to the information provided, a conservation easement has
been included on about 12 acres (outlot 1-A) of this development
proposal. This is encouraging, since it will prevent further
development of some of the most valuable wildlife habitat type
(lowland riparian, river bottom, and wetland) in Colorado. The Big
Thompson River meanders through this portion of the property. A
mature stand of cottonwood trees along the river provides for a
well established Heron Rookery.
Outlot 1-B (27 acres) consists mainly of lowland riparian - wetland
habitat, including a gravel pit pond, warm water slough and
approximately 200 yards of the Big Thompson River. This portion of
the property is. not included in the conservation easement, yet is
also very valuable in terms of quantity and diversity of wildlife
species. Many species including deer, waterfowl, shorebirds,
raptors (including bald eagles) , pheasant, coyote, red fox, raccoon
beaver, fish, and herptiles are directly dependant on wetland-
riparian habitat. This habitat provides for the potential
existence of treble' s Meadow Jumping Mouse which is listed as
Federally Threatened. Since there is no evidence that a Preble's
survey has been conducted on this property, consultation with the
0. S. Fish and Wildlife Service is highly recommended.

Use of the above two portions of the property (outlot 1-A and
outiot 1-B) should be limited, including carefully managed grazing
by domestic animals, in order to maintain the quality of the
wildlife habitat. The public viewing area at the East end of
outlot 1-A will benefit watchable wildlife enthusiasts. However,
stipulations or covenants for this development should minimize
human disturbance within these two parcels, especially during
nesting season (April-July) . Domestic dogs and cats running at
large in the area would have a definite adverse impact on wildlife.
Residential lots in this development for the most part will
displace agricultural farm ground. However, lots #3, #4, and #5
include some of the wetland-riparian areas within their boundaries.
Unless strict covenants are established and enforced in order to
protect this habitat from overgrazing, infilling, burning, etc. the
riparian-wetland environment could likely be destroyed. Strict
specifications for septic systems within these residential lots
should be established in order to prevent contamination of the
wetlands and the Big Thompson River.

Dear Ms. Chester:
We have reviewed the above referenced proposal to subdivide a 54-acre parcel
into 5 single-family residential lots. The proposed water source is the Little Thompson
Water district and a'iettter of commitment for service was included. The letter from the
District (dated August 7, 2000) obligates service for up to 5 residential lots.
This office previously commented (our letter of June 20, 1996) on a proposed 4-
lot subdivision of land. This letter supercedes our previous correspondence.
The District will supply treated water to the development. As a condition of
activation of the taps, the applicant must transfer 1 unit of Colorado-Big Thompson
(CBT) raw water (acre-foot per unit)for each lot, administered by the Northern Colorado
Water Conservancy District, to Little Thompson Water District. The applicant must
provide evidence that the CBT water has been transferred to the District prior to final
platting.
Pursuant to Section 30-28-136(1)(h)(II), C.R.S., it is our opinion the District has
submitted sufficient evidence documenting that the proposed water supply can be
provided without causing injury to existing water rights, and with the District serving the
proposal, the supply is expected to be adequate.
