A regular meeting of the Weld County Planning Commission was held Tuesday, 2000, in the Weld County
Public Health/Planning Building, (Room 210), 1555 N. 17th Avenue, Greeley, Colorado. The meeting was
called to order by Chairman, Fred Walker, at 1:30 p.m.

The summary of the last regular meeting of the Weld County Planning Commission held on December 21,
1999, was approved as read.

LEGAL DESCRIPTION: SW4 of Section 27, Township 2 North, Range 66 West of the 6th P.M., Weld
County, Colorado.
REQUEST: Kennel in the (A)Agricultural Zone District.
LOCATION: South of and adjacent to Hart; east of and adjacent to Cassler.
Kim Ogle, Planner, presented Case USR-1252 and asked for a continuance until February 1, 2000, as the
original application was not signed for two weeks, delaying the referral letters being mailed by two weeks. The
applicant is aware of the continuance and is in concordance with the continuation.
The Chair asked if there was anyone in the audience who wished to speak for or against this continuance.
No one wished to speak.
Stephen Mokray moved that Case USR-1252 be continued until February 1, 2000. Christie Nicklas seconded
the motion.

Kim Ogle, Planner, presented Case AmUSR-897. Kim passed out a letter from the applicant's agent, Tuttle
Applegate, asking for a continuance until February 15, 2000. This continuance is supported by the
representative for the surrounding property owners as well in order to work on solving the issued between the
two groups.
The Chair asked if there was anyone in the audience who wished to speak for or against this continuation.
Kim Davis, a representative of CAMAS, Inc., wished to state that CAMAS, Inc. is supporting this continuance
as they would like to continue working with the surrounding property owners to settle the issues involved.
Stephan Mokray moved that Case AmUSR-897 be continued to February 15, 2000. Bryant Gimlin seconded
the motion.

APPLICANT: Jim Perry
PLANNER: Monica Daniels-Mika
LEGAL DESCRIPTION: Part of the SE4 of Section 24, Township 1 North, Range 66 West of the 6th P.M.,
Weld County, Colorado.
REQUEST: Site Specific Development Plan and Use by Special Review permit for a Home Business for
Storage of Commercial Vehicles and Building Supplies.
LOCATION: North of and adjacent to WCR 6; approximately 'IA mile west of WCR 37.
Monica Daniels-Mika, Planning Director, presented Case USR-1249. Monica read the case into the record
and stated that the Department of Planning Services is recommending approval of this application. Monica
handed out an additional field check by Vicki Brown to replace the one in the file.
John Folsom asked if this would be for storage only or if there would be fabrication on the site. Monica stated
that this permit is for storage and office space. John also wanted to see if it had been looked into whether
or not there were apartments as there were six mailboxes in front of the property. Monica stated that no
apartments had been noticed on the site visit.
Jim Perry, Applicant, stated that the building is to store the vehicles and supplies for his rain gutter business
to keep them out of bad weather. He also stated that the mailboxes of several neighbors are placed at his
driveway.
The Chair asked if there was anyone in the audience who wished to speak for or against this application. No
one wished to speak.
John Folsom asked if the county roads would be adequate as they were for this operation. Don Carroll stated
that they are county maintained and adequate for the use planned on this road.
Bryant Gimlin moved that Case USR-1249 be forwarded to the Board of County Commissioners along with
the Conditions of Approval and Development Standards with the Planning Commission's recommendation
of approval. Stephan Mokray seconded the motion.

APPLICANT: John Carmichael
PLANNER: Julie Chester
LEGAL DESCRIPTION: Lot A RE-1500; Part of the SW4 of Section 6, Township 1 North, Range 68 West
of the 6th P.M., Weld County, Colorado.
REQUEST: Site Specific Development Plan and Special Review Permit for a Home Business (Storage
of equipment in an accessory structure).
LOCATION: East of and adjacent to WCR 1; south of SH 52.
Julie Chester, Planner, read Case USR-1250 into the record along with the Department of Planning Service's
recommendation to approval. Julie stated that Development Standard #2 was requested by the applicant in
order for the business to stay with the family and the USR would only be good during the lifetime of the owners
of the property.
John Folsom asked about the increase in the road access easement and how it would be legal. Julie stated
that this access was approved with the recording of RE-1500, where this USR sits, that the Department of
Planning Services is just asking that this be shown on the plat.
John Carmichael, Applicant, stated that he wants to run this family business from his property, with less than
one large truck per week. Mr. Carmichael stated that he understands the concerns for the children and is glad
to change his access. He wanted to state they are waiving the right to pass this USR on with the property.
Don larussi, Applicant, stated that there would be very little actual storage at the site, just for those rare
occasions when the cabinets are ready earlier than needed, usually the cabinets go straight to the job site
from the manufacturer.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
Charles Connellogue, surrounding property owner, spoke about the letter he circulated to neighbors asking
to not support this application. Mr. Connellogue is concerned with the possibility of renting this business out,
the size of the building, and the access used by truck traffic to the site. Julie stated the Development Standard
#2 takes away the possibility of renting this business and the final language for this Development Standard
will be finalized by the Board of County Commissioners hearing. Lee Morrison stated that the intent is to have
the business stay with the applicant only. John asked if Mr. Connellogue was still concerned with the large
trucks. Charles stated that one truck per week is not a lot, but the trucks take a lot of time to make the turn.
Don Carroll stated that Public Works feels the access needs to be widened and moved over, but when
finished should be adequate for the trucks to use.
Don larussi, Applicant, stated that the extra square footage in the building is to be used for personal storage
as their home is in the flood plain and has no basement to store items in. John Folsom asked for verification
that there will be no fabrication of cabinets at the site and if this is a wholesale business. Don stated that very
rarely do they not deliver the pre-made cabinets to the job site, he has been able to use a semi trailer in the
past and that has been adequate. Fred Walker asked Don Carroll if the road standards are acceptable. Don
stated that once the two separate accesses are finished, they will be adequate for this purpose. Mike Miller
asked if the language used would cover the access issue. Julie stated that Condition of Approval#2 B should
cover it.
Stephan Mokray moved that Case USR-1250, be forwarded to the Board of County Commissioners along with
the Conditions of Approval and Development Standards with the Planning Commissions recommendation of
approval. Christie Nicklas seconded the motion.

CASE NUMBER: USR-1251
APPLICANT: Pat Weakland
PLANNER: Julie Chester
LEGAL DESCRIPTION: Lot B of RE-1425; part of the E2 SW4 of Section 18, Township 6 North, Range
67 West of the 6th P.M., Weld County, Colorado.
REQUEST: Site Specific Development Plan and Special Review Permit for an Agricultural Service
establishment primarily engaged in agricultural, animal husbandry, or horticultural services
on a fee or contract basis, including a commercial greenhouse.
LOCATION: North of and adjacent to SH 392, between WCR 13 and 15.
Julie Chester, Planner, read Case USR-1251 into the record stating that the Department of Planning Services
is recommending approval. Julie stated that Condition of Approval#2 D has been changed by adding 1, 2,
and 3, with small changes to grammar and numbering.
Stephen Mokray asked whether or not this application included anything to do with animal husbandry. Julie
stated that the wording of that part of the Zoning ordinance covers several things and that this application does
not include anything concerning animal husbandry.
Pat Weakland, Applicant, stated that he and his wife have run a mobile, temporary greenhouse that they put
up and bring down every season inside the town limits of Windsor. They want to run a permanent
establishment on their property that includes a garden center. Stephen Mokray asked why there are four
greenhouses on the site plan if they are only going to build two. Pat stated that they wanted to put all
possibilities down on this plat in case everything goes really well for them in the future to avoid an amended
USR at that time. Pat also stated that they are changing the steel office building on the plat to a second
greenhouse for cost reasons, keeping the office inside the second greenhouse. Julie stated that the applicant
should be careful not to make many changes in order to avoid starting all over again with a new application.
Julie also requested that the new plat be brought into the Planning Department as soon as possible in order
for the Planning Department to check out all the changes before the Board of County Commissioner meeting.
Pat stated that they will be employing 3-5 people at this time, but possibly getting as many as 10 in the future.
Fred Walker asked several questions concerning the floodplain and where it is located on the property. Pat
stated their intentions to raise the level of the land to place the greenhouses out of the floodplain.
Discussion followed concerning the choice of dedicating or reserving the easement along the road, with a final
choice by the applicant to reserve the easement in order to keep the property rights.
Christie asked what changes would be made to the Development Standards. The wording will be changed
in Development Standard#4 to state "The facility will consist of existing structures, two 41'x72' steel framed
greenhouses with three future 30'x96' foot greenhouses as proposed in the application materials. All
appropriate permits must be obtained prior to construction." Development Standard #12 will be changed to
say office/greenhouse instead of office.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
Scott Balstadt, Planner with the town of Windsor, brought the seven recommendations made by the Planning
Commission of Windsor. The seven points included the following: That the applicant work with the
Windsor/Severance Fire Protection District on service to the site, that the flood datum be checked again for
accuracy, the plat map be updated with the Windsor town limits, look into the dedication with Colorado
Department of Transportation, follow the criteria involved with having a business along a main street in
Windsor, contact Windsor Parks and Recreation about possible trails, and an agreement to annex when the
site becomes an enclave in order to avoid the three year waiting period that would be in effect. Julie stated
that without an Intergovenmental Agreement in place, the county can only list these as recommendations, not
as requirements as there is no method to enforce those choices. The Conditions of Approval include a
mention of a good effort to negoitiate.

Jason Struck, Windsor/Severance Fire Protection District Plans Examiner, also wished to speak concerning
the fire hydrant the site would need as the building is V Non-Rated. He stated that the fire district is flexible,
allowing up to two years before the fire hydrant needs to be in place. The Weaklands and Windsor/Severance
F.P.D. are working together to come up with a workable schedule.
Fred Walker asked the applicant if he was comfortable with the Conditions of Approval and Development
Standards placed on the application by the Department of Planning Services. Pat stated that he is, but wanted
to discuss the conditions that the Town of Windsor wanted to place on the permit. Mr. Weakland stated that
they are working with the F.P.D., personal engineer is signing off the flood data, the vicinity map is addressed
on plat, the Right Of Way will be reserved, they want to try to keep as close to the city standards, but will do
so as money allows.
John Folsom discussed best efforts, which Lee Morrison stated that the Planning Department will decide at
the time of recording the plat.
Christie Nicklas moved that Case USR-1251, be forwarded to the Board of County Commissioners along with
the corrected Site Plan Map, the Conditions of Approval including the changed wording on Conditions of
Approval #4 and #12 and Development Standards with the Planning Commissions recommendation of
approval. Mike Miller seconded the motion.
