RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
VI #0000230 AGAINST TIMOTHY BARTON FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Timothy Barton, VI #0000230, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, on the 10th day of October, 2000, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Timothy Barton, property owner, was present at said hearing, and
WHEREAS, at said hearing of October 10, 2000, the Board of County Commissioners
determined this is a temporary use similar to a Medical Hardship in the A (Agricultural) Zone
District, and deemed it advisable to dismiss said matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners cf
Weld County, Colorado, that VI #0000230 against Timothy Barton, be, and hereby is,
dismissed.
BE IT FURTHER RESOLVED by the Board that is directed to ensure the building is in
compliance with building regulations.
BE IT FURTHER RESOLVED by the Board that this use is a temporary until the
property owner can no longer care for his parents or they are deceased.

violations occurring on the property. As we discussed the above mentioned property is in violation of the
following Section(s) of the Weld County Zoning Ordinance:
31.2.1 "One(1)single family dwelling unit and auxiliary quarter per legal lot."
31.2.2 "One(1)single family dwelling unit and auxiliary quarters on a parcel of land created under the provisions
of Section 11 of the Weld County Subdivision Ordinance."
Your property is also currently in violation of the following Section(s) of the Weld County Building Code
Ordinance!
30 Building Permits for Buildings and Structures Other than Mobile and Manilla(cored Homes:
No building or structure regulated by this code shall be erected,constructed,enlarged,altered,repaired,moved,improved,
removed,converted,or demolished unless a separate building permit for each building or structure has been first obtained
from the Weld County Building Inspection Department. (Before any demolition permits are issued,approval must be given
by the Weld County Health Department.)
To bring the property into compliance the following option(s) are available:
The"apartment"dwelling unit can either be completely demolished(with a demolition permit through the Weld
County Building Department)or it can be vacated as a dwelling unit by sending us a letter stating that the structure
will not be used for any overnight or temporary housing. If you choose this option, the 'kitchen" and .my
"bathrooms" must be disassembled. Once you have completed dismantling them, please call our office and a
building inspector will inspect the unit.
This meeting will take place in the County Cormissioners' Hearng Room, ]:irst Floor, Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It 5 recommended that you ir a representative be in attendance

Weld County Board of County Commissioners:
The attached is a petition from the Homeowners of Parkland Estates regarding the
continued use of my outbuilding for the care of my parents, Wayne and Sylvia Barton.
In order to ensure an honest and an unbiased petition., neither any of my family nor I, but
rather many of my concerned neighbors performed the petitioning process.
Due to time restraints and difficulties in locating homeowners. not all residents were able
to participate in the petition. Fortunately, all of my immediate neighbors who are more
directly impacted by the situation were able to participate and the majority (82%), or all
but four lots, of the non-polled lots reside on the opposite side of the development. To
the best of my knowledge. no resident was avoided due to any known opposition that
they may have. It is my belief that if the remaining 23-lot owners who did not have the
chance to participate in this petition were to be given the opportunity to participate, there
would be similar results.
There are two homeowners who own multiple lots and they were taken into
consideration. In some cases, both homeowners at a residence signed the petition to
show their independent voice, however, to ensure a proper representation of the
individual lot owners in the sub-division I have included a more detailed evaluation:

PARKLAND HOMEOWNERS PETITION
I. the undersigned, understand that Tim nii Doris' Barton, of 4715 Sylvia Lane. of Weld County have an outbuilding structure that has
been approved by the County of Weld and the Parkland Architectural Control Committee as a workshop. This workshop has later
been modified to include a secondary usage as a temporary dwelling for Tim and Doris to care for Tim's parents, Wayne and Sylvia
Barton. This secondary usage is awaiting approval from Weld County Board of Commissioners. I have no objections to this
secondary usage and favor an approval for it to continue for parental care.

Wayne and Sylvia Barton are under my care at the Kaiser Permanente Boulder Medical alike
for the following problems:
Mr. Barton has coronary artery disease and has previously undergone quadruple by-pass surgery .
fie suffers from progressive asthma, which is becoming less responsive to medications. Mr.
Barton also has Barrett's Esophagus, a pre-malignant condition of the esophagus associatec will_
extensive acid in the esophagus.
Mrs. Barton has osteoporosis resulting in two vertebral fractures, as well as degenerative lumbar
disc disease. She also suffers from significant osteoarthritis in her back, hips and knees resulting
in limited mobility. Mrs. Barton has a retinal condition which could lead to significant +isual
inmairment.
Due to the aforementioned medical problems and associated symptoms, it is clearly
advantageous for the Bartons to have continued assistance in their daily living. Please feel fre.

Dear Commissioners:
The Parkland Homeowner's Association Board of Directors has recently been made aware of a situation that exists at oni
of the residences in the subdivision. Tim and Doris Barton. homeowners at Parkland Estates, have informed us that they
have been caring for Tim's parents (Wayne & Sylvia Barton) in an out-building on his property.
Both Weld County P&Z and the Parkland Architectural Control Committee (ACC) originally approved this out-budding
as a partially finished workshop. It was later modified to include a secondary usage as the temporary dwelling for'finis
parents. Wayne and Sylvia Barton. These modifications were undertaken without the knowledge or concurrence of the
Parkland ACC or the Parkland Board of Directors. We further understand that these modifications by the homeowner
were undertaken without the proper pennitting and inspections by the correct Weld County personnel
However, tie Parkland Board of Directors is aware and appreciates the continued need for Tim and Doris Barton to care
for Wayne and Sylvia at this time. We also have a special appreciation for Wayne & Sylvia in that their determination an I
their efforts were responsible toward the reality for the development of our community_ In fact. Sylvia Lane was named
for Sylvia Barton.
Therefore, The Parkland Board of Directors and the Architecture Control Committee would like to request that the Count
Commissioners allow the Barton's to continue the use of this structure as temporary living quarters until suci time as the
natural course of life events dictate that the it is no longer needed as living quarters for Wayne and/or Sylvia Barton
The Parkland Board of Directors also understands and supports that steps may need to be taken in this case to ensure tha
county code and zoning issues are met and/or corrected. Also, Tim Barton has informed the Parkland Board if Directors
that when the structure is no longer needed as living quarters for Wayne and/or Sylvia Barton, he will convert the
structure back into it's approved use as a workshop. We request that any approval by Weld County to count ue rho curie it
use of the structure as temporary living quarters include this reversion timeline as a requirement including the provision
that if Mr. Barton sells the property that the structure be converted back to it's original approved use as a workshop prig
to any sale

Dear Ms. Salzman;
It has been brought to our attention that the Barton Family has been given notice that they
are in violation of Weld County zoning. As a direct neighbor living on the north side of
the Bartons, we can assure you that the situation as it exists is in our estimation necessary
for the care and well being of Tim Barton's medically in need parents, Wayne and Sylvii
Barton.
It is our understanding that this is a temporary arrangement and will remain so until
Wayne and Sylvia are no longer in need. We feel that Tim and Doris Barton wanting to
care for their parents and keeping the family unit together is to be commended not
penalized. The obvious caring and loving of a family such as the Barton's in today's
society is becoming more and more scarce. This arrangement is not only important lbr
the care of Wayne and Sylvia, but also for the Grandchildren to have a close relationship
with their Grandparents as it now exists. It would seem a tragedy to separate them.
We would request and support the Weld County Commissioners allowing the Barton's To
continue under the temporary living arrangement that now exists. We feel that the key
word in this instance is temporary and making an exception in this case would be
appropriate. However, we do not feel that the zoning ordinances should be changed. We
ask that the Barton's be allowed to take the actions necessary to meet the requirements
for a temporary residence that would put them in compliance.

This letter is in reference to a situation which has come to my attention concerning a property owned by Tim
Barton here at Parkland Estates,and currently occupied by himself, his family. and Mr. &Mrs. Wayne Barton, his
parents. I understand that the county has initiated contacts with Mr. Barton to the effect that the apartment tha'
Wayne Barton and his wife are living in does not meet the Covenant Requirements of Parkland Estates,arid that hc:
county has initiated procedures to force compliance with those Covenants,e.g,that the county is contemplating
actions that would force the elder Barton's to move off the property they have built and occupied for the past 29
years. It is my understanding that Tim Barton officially purchased the property from his parents in June of !9%.
and is now the owner of record. His parents,the builders of the property, are currently living with Tim on the same

First,if you will bear with me, I feel it is important to understand the situation with the Bartons. Wayne
Barton is THE founding father of the Parkland Estates Airpark,starting that effort 29 years ago,and persevering all
those formative years through great difficulties to establish a dream of his and his friends where pilots and airplane
owners could have a dedicated place to live and enjoy our aviation activities. While I have only lived at Parklanc.for
six years, I have talked extensively with my neighbors who have been here since the beginning,and they are universal
in their praise of Wayne, saying that many times, it was only his dedication to the whole concept that saw them
through many periods of what seemed insurmountable difficulties in making this project happen. Without his hat d
work all those formative years, those of us living here now would not have the wonderful homes and living
environment that are so special to our interests. And so valuable an asset to Weld County.
Mr. Barton has also through all those years built for himself one of the most attractive home, hangar, and
workshop combinations that exists in our development. It is obviously a labor of love, and I personally always point
out his homesite efforts to visitors to our development. I will also add that in those years, Mr. Barton built. ,n his
workshop/hangar behind his home, a homebuilt airplane he named Silkie,and that homebuilt airplane took the Grand
Champion Homebuilt award at the Experimental Aircraft Association's National Fly-In at Oshkosh, Wisconsin. This
is the single most prestigious award there is in private aviation. It is a huge •lonor to have this man why har,
produced this kind of effort in our community.
Through those years, Mr. Barton also gradually built an area in his beautiful Dutch Barn design shop that
initially was just kind of a den area, the purpose of which was merely to be a pleasant relaxation area when the shop
work was completed for the day. All of us hangar owners have something similar,it is a pleasant place to relax, and
• entertain friends.
Mr. Barton, though, is a highly innovative person, and he was constantly fiddling with the room, and it
gradually grew,almost without thought,into a guest apartment for occasional visitors. l don't believe that at t ha i

time, Mr. Barton ever really contemplated what it was to actually oe, it just kind of grew. I am sure that he never
considered the remote possibility that it might be becoming in conflict with our rather arcane Covenants.
As Mr. and Mrs. Barton grew older, and started experiencing failing health, they arranged for their son,
Tim,and Tim's family to come live with them and help care for them in their elder years. As I said before, Tim
Barton eventually formally purchased the property from his parents. Wayne Barton has had extensive heart singer:
in recent years,and is experiencing increasing ashama problems.
During this time,it was finally arranged within the family that Tim and his family would take over the main
house,and a final very minor modification of the shop living quavers was made so that the elder Bartons could live
comfortably in that area. Unfortunately,that modification, as I understand it,the adding of a small cooking stove to
a very small kitchen/cooking area, did technically place those occasional-use guest quarters over the legal limits of
our Covenants. Again, I don't honestly believe that any of this was done intentionally,or even with the thought that
there might be a legal problem with it being done. It was just a common-sense thing that was needed for the
situation. The elder Bartons did move into that living space over four years ago There has never been a problem
with that situation within our development to my knowledge, and all of us that I know of were very happy that the
Barton's had been able to arrange their lives and living arrangements so that Wayne and his wonderful wife wet e le
to stay in the development that they were so instrumental in bringing to this stage.
I will reinterate at this point that all of the Barton's buildings, including the beautiful Dutch Barn building.n
which are the living quarters the elder Barton'i currently occupy are some of the most attractive in our
development. There is no practical or objectionable problem with the property in any respect,except that the actual
end development of a complete living space within the Dutch Barn shop does technically cross over the Covenant
line. I am told that the"straw on the camel's back"item in the apartment is that there is not allowed a stove for
cooking facilities in the space. The Barton's do have a very small"kitchen"for hat purpose.
The Barton-s have been living at Parkland Estates for the entire life of the development, indeed, Mr. Barton
is the founding father of the development. Throughout all those years, he has dedicated enormous effort to both
making sure that the development did fulfill his dreams,and he built the home of his dreams, a beautiful and complete.
very valuable addition to our overall development. In his elder years, he made a judicious and good arrangement for
both his son's family plus he and Mrs. Barton"s continued care in their elder years. Mr.&Mrs. Barton have always
been a tremendous asset to our development, and the arrangement whereby the entire family could enjoy what Mr.
Bar:on had built, and continue to live in his creation for as long as possible,is one of the best arrangements that I
know of for a total family. All of the people at Parkland,and I have talked to a lot of my neighbors about this,are
very happy that Wayne and his wife are able to live out their lives in this manner. and we are very happy to still have
them here to share his creation with the rest of us.
While the creation of the apartment in the Dutch Barn workshop night be technically, split-hairs legally not
completely within the Covenant requirements of Parkland Estates,it is my strong feeling, shared by all the neighbors
that I have talked to,that the Covenant restriction was not violated intentionally by Wayne. This is not a rental
situation,(which the Covenants were specifically designed to prevent),nor is it a multi-family arrangement lie and
his wife have been living in the apartment for over four years now,they are both in declining health,the living
arrr:ngement with the elder Bartons and the Tim Barton family has been a wonderful arrangement for the complete
family,and for the ability of the rest of us in the development to continue to enjoy the elder Barton's continue i
company.
It is my sincere hope that the county will consider an unofficial,temporary, and special arrangement with the
Barton's as to the enforcement of the Covenant restriction which has threatened to force the elder Bartons to move
off the property. It is my firm conviction that such an accommodation to the Barton family is completely justified m
compassionate and hardship grounds,plus the Grandfather rights of a long-existing situation. To force the elder
Batton's to move away from their lifelong home and the development for which Mr. Barton was primarily responsible
in bringing to life, in my honest opinion, would be an abomination of major legal hairsplitting. Simply because their

current living quarters do not technically comply with the Covenant requirements does not in any way reduce the tact
that the Barton's are a major asset to our community,their living arrangement is one of the best for a total family that
l know of, the elder Barton's deserve to live out their final years in the comfort of the overall product of their!fife's
work,and the Barton family deserves to live together for as long as it is possible
Tim Barton has expressed to me that he is fully willing to work with the county to affect any agreements that
are necessary so that his parents can continue to live within their family,and that he is fully willing to agree to tiny
reasonable demands that the current Covenant non-compliant facilities will be dismantled within the shop at the time
that it is no longer possible for the elder Barton's to continue living there. Until that time,it is my fervent hope that
the county will come to some working arrangement with the Barton family so that this highly beneficial living
arrangement can be continued for the remaining years of the elder Barton's lives.
They very much so deserve that,that is the wishes of all my neighbors I have talked to,and I sincere!). hope
that the county will make all reasonable efforts to work with the Barton's so that this can be accomplished. l have
directly discussed this situation with the Parkland Estates Architectural Control Committee and the Board of
Directors, and I am informed that you will shortly be receiving a similar written request from them. To three the
elder Barton's off of the property on the grounds that they have inintentionally violated a hair-splitting interpn;tation
of the Covenant requirements would be just plain cruel and unjustified considering the circumstances.

This letter is written in support of a variance to approve the secondary living quarters
currently occupied by the parents of Tim and Doris Barton at 4715 Sylvia Lane, in
Parkland Estates.
Wayne and Sylvia (the parents) our are neighbors and were instrumental in starting the
development years ago. They are wonderful people and definitely add value to the
community. There is no objectionable problem with the property in any respect.
Parkland has developed into an upscale community of ninety-one home sites, each with a
value approaching $400,000. This has added to the prosperity of Weld County and the
State of Colorado. Had it not been for the Barton, this may well have remained just.
another landfill or junkyard since the soil was poor and water not available.
We support the temporary. auxiliary living quarters and favor approval for Tim and Denis
Barton to continue caring for their parents.
We have no negative comments to make about this outstanding family.
