We live at 5080 WCR 1, the northwest corner of Section 6. The owner of the
neighboring property, 5052 WCR 1, is wanting to construct a commercial building.
The driveway access is primarily on our property. We have found no legal
documentation providing this address with legal access to enter via our property.
We are aware of the fact that 5050 has granted an access easement along their
property to 5052, but the majority of the entrance is on our land.
We have asked Mr. Carmichal to show us documentation allowing him right-of-
way. He has already widened the driveway at the road to 30 feet to accommodate
semi trucks. I was away from home on November 20, 1999 and upon my return
found the driveway widened and in an extremely muddy state. Although he was to
provide a drawing and map prior to any changes, he failed to do so.
We are asking the county to suspend issuing any permits until the access right-of-
way is settled. The access from WCR 1 serves three properties; 5080, 5090, and
5050 WCR 1, all of which are residential properties. A zoning change for the
adjoining property would greatly affect all that use this driveway.

We live at 5080 WCR 1, the northwest corner of Section 6. It has come to our
attention the owner of the property located at 5052 WCR 1 has submitted a request
for ..„..alt to build at 7200 square foot building for a cabinet manufacturing
business. A commercial business adjoining our property would greatly affect our
quality of life. We purchased our home because of the two acres it offered, the
location and the agriculture zoning. It is our belief that a zoning change would not
only change our country life style, it would also depreciate our property value and
decreases the salability of our property.
The access from WCR 1 is presently shared by three homes; 5080, 5090, and 5050
WCR 1 with the majority of the driveway being included within the property line of
5080 WCR 1 in which there is no legal access granted from 5080. Our children
ride their bicycles and wait for the school bus in this same driveway. A change in
the zoning allowing a commercial business on this site would greatly increase the use
of the driveway,not only for passenger vehicles, but for semi trucks as well. This
fact would put our children's safety at risk.
We suspect that Mr. Carmichael will claim a limited use for the commercial zoning
he seeks, but will eventually increase the use to a major distribution center for his
housing development here as well as in Vail, Colorado, due to the close proximity of
I-25 and quick route to I-70.
We ask that you deny the zoning change for the property at 5052 WCR 1 from
agricultural to commercial, thereby preserving the safety of our children, our
country way of life and the value of our property.
Your timely consideration and swift action in this matter will be greatly
