Zoning change proposal for Podtburg Dairy
I am here to express concern about increasing the size of the Podtburg Dairy. The affect it
will have on the quality of life and the property owners of NorthMoor Acres can only be
adverse.
NorthMoor Acres has 121 sites and has been in existence since 1974, which was before the
existing dairy site was purchased and built by Mr. Podtburg. Therefore I believe that the
NorthMoor area does not fall under the common practice that we knew about the dairy when
we purchased property in NorthMoor and should accept the dairy as a part of our life.
The posting of the notice has not been very good. People walk and drive daily along County
road 42, from county road 11 to 13 and only saw the notice for a couple of days. It did blow
down but no attempt by the Dairy to re-post it is evident. The Planning and Zoning Office
was called on February 23 & 24 to find out what was being proposed. I was informed that
the Planning & Zoning Office was advised by the Dairy that the notice had been down since
February 18. This proposed change seems to want to go unnoticed.
The past practice of the Dairy has not been very honest with North Moor Acres. There has

been past practices of piling manure next to the property line on the East and Ali side of
NorthMoor. It was brought to the attention of the dairy about the smell and flies which did
_ not concern the dairy as the practice did not stop. There has been reports to the County
Health Department about the waste water running off the property into the ditch/bar pit along
County road 44. This brings up the concern of the present Lagoon system; (1) are they
properly sealed as required by the State; (2) are they adequate to hold the present waste water
being created as well as that which could be caused by the 100 year rain for all the land that
presently drains through this area; (3) the protection of irrigation ponds so they do not receive
any run off from the dairy pens.
If the dairy has not met these requirements in the past what is going to change this practice in
the future. The dairy has also violated the number of head that it is authorized. With this
type of attitude in the past how can we be assured that the dairy will meet all the regulations
in the future.
I believe this request should be denied or at least a continuance should be granted so that
NorthMoor Acres home owners can get copies of; (1) documents that control the present
dairy, (2) cattle confinement requirements for over 1000 head, (3) present approved county
dairy plans, (4) manure removal plans, (5) how any use of lagoon water will be confined to
Podtburg property, (6) dairy plans for the proposed expansion, and what changes in the
controls would occur if the dairy is granted this increase so any specific issues can be
addressed.
We know that there is a very high concern by the State of Colorado about any water pollution
that could aet into the around water and rivers as we are.

Enclosed are all of the permeability tests results for the above referenced facility. Samples
tea\.
were taken with Shelby Tubes in the existing liners all of the ponds. Refer to the attached
Location of Testing(Drawing No. 1)for the sample locations.
The pond depths were measured directly with probes from the shore and from a boat.
Measurements were taken on February 16 and 22,2000,with the pond water elevations at near
capacity in all the ponds. Measurements were taken at various areas of the ponds to determine
the water depths. Refer to the attached drawing for the water depths and locations. The
maximum depths measured range from eight feet to ten feet(8' to 10')deep.
The lagoon liners were sampled and laboratory tests were performed to determine the
Unified Soils Classification of the on-site liner/berm material. Permeability tests were also run on
the,sampled soils at insitu density and moisture content. Refer to Table 1 for the Summary of

The coefficient of permeability(k)for all of the ponds range from 4.24 x 10-7 to 2.26 x
10-8 cm/sec. For an eight foot(8')water depth with an eighteen inch(18")liner, the maximum
required permeability factor(k) needs to be 1.45 x 10-7 cm/sec. to meet the maximum seepage
requirements. For an ten foot(10')depth with an 18" liner, the maximum coefficient of
permeability(k)needs to be 1.20 x 10-7 cm/sec. to meet the maximum seepage requirements.
Liner samples were taken at twelve to eighteen inch(12"-18")depths,with relatively consistent
soils throughout. Because the berm thickness are a minimum six to eight feet(6'to 8')at the top
and ten to twelve feet (10' to 12')at the bottom, the coefficient of permeability results will give
seepage rates that are within the required seepage rates of 104 cm/sec. for the water depths
measured. The berm liner material is the same as the berm material used. For a 10'water depth,
a coefficient of permeability of 1.84 x 20''cm/sec. is required for a thirty inch(30")liner
r , thickness. .For ten feet(10')thickness, a coefficient of permeability of 4.76 x 10''cm/sec. is
required. The non-berm samples would correspond with the deepest water depths measured(8' to
10'). The coefficient of permeability(k)for the non-berm liner samples are such that the seepage
rates for 8' to 10' depths within the maximum seepage rate requirements for an 18" liner
thickness.
The United States Department of Agriculture Soil Conservation Service National
Engineering Handbook" Agricultural Waste Management Field Handbook" shows that one order
of magnitude can be taken for the coefficient of permeability(k)if effluent ponds with liners
containing greater than 15%clay. Our laboratory testing shows 52.9%to 72.9%passing the No.
200 sieve(clay and silt sizes). Refer to Summary of Test Results. Therefore, the liner soils with
the effluent contained would allow for this additional decrease in permeability(k). This added
decrease was not used for the seepage rate calculations discussed, but would allow for an

Therefore, all the berm and bottom liner materials sampled meet the maximum seepage
rate 1/32" per day(1 x 10-6 cm/sec.). The samples taken,but not tested, visw4iy appeared
consistent with the samples tested. Refer to the attached Location of Testing and Summary of
Test Results for the locations of liner samples and coefficient of permeability(k)results.
In summary, for the water depths measured and the sampled liner penneabilities, the ponds
are within substantial compliance of the maximum seepage rate of 1/32" per day
(1 x 104 cm/sec.). In all areas sampled,liners are greater than the minimum twelve inches(12")
per the confined Animal Feeding Operations Control Regulations.
