Gentlemen:
On October 31, 1980, representatives of this Division conducted an unannounced
inspection of the Erie Solid Waste Disposal Site, located in southwestern Weld
County, in response to written complaints received by us (see enclosures) .
We found this site to be operated in compliance with minimum standards of the
Solid Waste Disposal Sites and Facilities Act, Title 30-20-Part 1, C.R.S. 1973,
as amended, and Department regulations. Our representatives observed no sig-
nificant amounts of windblown debris or roadside litter, on or off site. The
working face was small and well operated. Evidence of recently applied inter-
mediate cover was noted on areas adjacent to the existing working face. Fugitive
dust was minimal, and a water truck was standing by on site.
By agreement between all parties, the bird hazard question is currently being
studied by an expert committee appointed at the time of Designation. To date,
their reports have indicated no significant bird hazards.

Dear Mr. Horst:
In response to your request for information, applications for
certificates of designation are obtained through the Radiation and
Hazardous Waste Division of the Colorado Department of Health. Mr.
Orville Stoddard of that Division will send you a copy of those regu-
lations. If you do not receive them or have additional questions
concerning certificates of designation, Mr. Stoddard can be reached
at 4210 East 11th Avenue, Denver, Colorado 80220 - telephone 320-8333.
Please note that in 'the packet of information previously sent to
you are criteria by which the Board of County Commissioners reviews a
certificate of designation for approval or denial.
A copy of the Special Use Permit application forms and criteria
for approval are enclosed. Please note that sanitary landfills are allowed
only by approval of a Special Use Permit in the agricultural zone
district.
The Board of County Commissioners entered into an agreement with
Colorado Landfill, Inc. on June 6, 1979 which designates that corporation
as the sole operator of landfill, dump and disposal facilities throughout
Weld County. For anyone else to operate these type facilities in the County
an agreement would have to be made with Colorado Landfill, Inc. and any
lease assignments approved by the Board of County Commissioners. The owner
of Colorado Landfill, Inc. is Mr. Lynn Keirnes. He may be contacted at
