Dear Mr.Hanson:
Your letter of 4-27-2000 has been forwarded to me for response. I am attaching a copy of our letter of 4-
27-2000 addressed to you,which sets forth our evaluation of your claim arising from a motor vehicle
accident on 1-25-2000.
We are resolute in our view that the proximate cause of the subject accident is clearly due to the negligence
of the operator of your 1992 Dodge Caravan who failed to comply with the turning movement prohibited
by C.R.S. 42-2-903.
We remain mystified about the citation issued to the operator of the involved Weld County truck,as no
basis in fact exists to support it. The truck operator was not in violation of any traffic rule or regulation.
Obviously the citation was issued in error to the truck operator.
As I explained to Margo Hanson during her phone call to us on 4-24-2000,no payment can be expected for
the claim for damages to your vehicle.

Dear Mr. Hanson:
As you know,we administer the loss function for Colorado Counties Casualty and Property Pool(CAPP)
of which the above listed County is a participating member.
This letter is being provided you on the basis that it is not to be construed as a waiver of any provisions of
the Colorado Governmental Immunity Act, nor as a recognition that the notice provisions of that Act have
been met.
We have had an opportunity to reviewthe information we have received regarding this matter. It is our
• opinion that the proximate cause of this loss was an improper turn made by the operator of the 1992 Dodge
Caravan. Please see C.RS. 42-4-903,which states(in part)-(1)No person shall...tum a vehicle to enter a
private road or driveway, or otherwise turn a vehicle from a direct course or move right or left upon a
roadway unless and until such movement can be made with reasonable safety...
Based on the information we have, we are respectfully denying your claim for damages.
