HomeMy WebLinkAbout20000835.tiff RESOLUTION RE: APPROVE VACATION OF SPECIAL USE PERMIT, SUP #340 - DON ANDERSON, INC. 714a WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #770242 on November 30, 1977, the Board did approve Special Use Permit#340 for a Hog Operation for Don Anderson, Inc., Route 2, Box 36, Eaton, Colorado 80615, on the following described real estate: Part of the W1/2 of the NW1/4 of Section 2, Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, Barbara Anderson, on behalf of Don Anderson, Inc., has requested vacation of Special Use Permit #340 on the above described property, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Special Use Permit#340 be, and hereby is, vacated. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 12th day of April, A.D., 2000. TO: Members of the Board of County Commissioners c�C�1 COLORADO FROM: Anne Best Johnson, Long-Range Planner. _ SUBJECT: Eaton IGA: Vacation of Land Use Cases April 6, 2000 An outcome of the land use research conducted during the Eaton IGA process is that four property owners are requesting the vacation of land use permits. The property owners were contacted by either telephone or letter. The process of the vacation hearing and purpose was explained to the property owner. A total of five property owners were contacted. One property owner did not want to vacate their permit. The four property owners who desire a vacation of these permits are listed as follows: 1. CUP 53 for Sharon Pickrell (February, 1980) A Conditional Use Permit for the cutting, splitting, storage and sale of firewood on a parcel of land located in the S2 SW4 Section 14, Township 6 North, Range 66 West, of the 6th P.M., Weld County, Colorado. 2. SUP 340 for Don Anderson (October, 1977) A Special Use Permit for a hog operation located in the NW4 of Section 2, Township 6 North, Range 66 West, of the of the 6th P.M., Weld County, Colorado. 3. SUP 151 for Duane Wilson (May, 1972) A Special Use Permit for a sheep operation located in the E2 W2 NW4 and the W2 E2 NW4 of Section 35, Township 7 North, Range 66 West, of the of the 6th P.M., Weld County, Colorado. 4. SUP 330 for Glenn Wilcox (July, 1977) A Special Use Permit for the expansion of a hog operation located in the SE4 of Section 5, Township 6 North, Range 65 West, of the of the 6th P.M., Weld County, Colorado. The Department of Planning Services is recommending that these four land use permits be vacated at the request of the property owners, as evidenced by the attached four letters. This agreement outlines a cooperative planning agreement between the Town and County. As part of this agreement, staff from the Weld County Department of Planning Services conducted research into all land-use applications in the Eaton planning boundary. This research included a permit on your property for case number: SUP 340, hog confinement operation. After telephone conversations with you, it was discovered that you no longer have this business in place on your property. For your ease, I have enclosed a letter for you to complete in requesting that this use be vacated from your property. By vacating the land-use application, the operation will no longer be tied to your property. Please complete the enclosed form and mail it back to me in the enclosed self-addressed envelope.
