January 23, 2000 ® FEB 09 2000 ED Monica Daniels-1\/P Weld County Department of Planning 1555 N. 17"' Street Greeley, CO 80631 The purpose of this letter is to voice our concerns about a business in operation at 3019 County Road 20-1/2, Longmont, CO 80504— Olson residence. Although many of us have not had the opportunity to meet our new neighbors, we would like to brine to your attention our opposition to their large-scale trucking operation located at the above address. In conversations with the code compliance officer(s) in your department, we understand the residents have recently been notified of being "out of compliance" with county regulations as to the following: • Pole barn constructed and given a Certificate of Compliance (COC) by your department is not being utilized as an agricultural-use building • Driveways constructed after residents moved in (May-June 1999) were not originally dug according to specifications. When the fact that driveways were being dug at all was brought to the attention of Julie Chester in Planning, she suggested we contact the Public Works department with a complaint. She maintained that no one could just dig driveways onto county roads without the proper authorization by public works. Only after public works was notified and confronted the issue were the driveways were put into compliance according to county standards. This business is operational although no special use permit or rezoning action has been either applied for or approved by either the Planning Department or the County Commissioners. We are concerned about this due to the traffic, noise and storage associated with 8-10 belly- , . _ •iUiitp se m; trucks located at this address. We 4ic upset that new residents tire aLlc to construct and run their business before obtaining the necessary permits and approvals prior to business operation. Additionally, this area is zoned agricultural, not commercial. Those of us who have inquired about rezoning issues associated with either business renewal, splitting parcels, rezoning for commercial use or recorded exemption information have been thwarted by the planning department insisting we go through "the process" which most times consists of applying for a PUD. We would like to know why most of us are unable to get planning support and direction associated with our inquiries, while others can just construct a business and deal with the specifics of compliance and approvals after the fact. At the advice of Bruce Barker, we chose to submit this letter to the appropriate parties associated with these particular compliance and approval issues for this "unapproved" business. This is my addendum to an earlier letter submitted to both the Planning Department and the Board of County Commissioners dated January 27, 2000. The following points reiterate earlier concerns noted relating to the trucking business in operation at 3015 County Road 20-1/2, Longmont, Colorado. CONCERNS: • Fumes and noise associated with 10-12 diesel semi-trucks at idle being housed at residential property • Disposal of waste (oil, vehicle fluids, etc.) associated with servicing the same in compliance with health safety standards • Pole barn building approved for construction under false pretenses (submitted to Building Inspection department as an agricultural building) • Possibility of foundation of pole barn poured and set without proper inspections because of information withheld about use of barn • Business in operation for many months after violation brought to the attention of Code Compliance Officers (Shawn Frasier, Vickie Brown, Joe Mendez, etc.) • Planning Department dismissing valid concerns of neighboring residents in favor of "working with" the applicant to help bring them into compliance after the fact, even though zoning, business, and building permit violations exist • Possible conflict surrounding the purchase of property specifically for gravel hauling trucking business (would be beneficial to both the agent (Margaret Kobobel - Kobobel Gravel Operations) and buyer as new Kobobel gravel pit starting up directly east of property) I have never met the Olsons personally or otherwise, but feel this blatant violation of county rules has drawn a wedge between them and some neighboring residents. = LE No.uL8 04/10 '00 11 :33 Jm:WELD CTY GOVT FAX=9701)520242 PAGE 2 04/05/00 14:23 PAX 303 702 01.,,,, MINIMS LONGMONT f®OU3 I believe property owners should have a right to use their land as they see fit. However, everyone should follow the aft standards and fee structures set by the county in regard to building inspections, permitting, and most os ecially, zoning issues. Many rezoning approvals (agricultural to residential) made by Weld County and by Frederick and Firestone annexing prime farmland outside of their own borders are taking a real toll on this area. it's time to consider the effects on the people (your constituents) who are already in place, and have some sympathy for their concerns. The Planning Department should be accountable for their inability to follow-Through with their own (county) policies. We are very disappointed that the county has allowed a trucking business to be in operation in our agricultural-residential zoned area. We feel the owners did not attempt to comply with county regulations and ordinances prior to starting their business, which has been in operation approximately 6 months. A few of our concerns are with the noise.fumes,traffic, maintenance and storage of a number of semi-trucks in our residential area. Because we are unable to attend the hearing, we would like to make our concerns known to the planning commission about our dissatisfaction with the Olson's business located at their residence, which is clearly in violation. Their request for the PUD is for the parking of trucks on their property. They live in an area with a great deal of truck traffic so, their request is not unusual. Their property is located at 3019 WCR 201/2. After plenty of lengthy discussion with the Olson's I believe that what we have is a neighborly dispute. What comes along with that is one person in their area that is very vocal and is exercising their rights without listening to the Olson's. Along the same line, I find that they are not listening to the fact that the Olson's have followed the proper channels with attempting to re- zone their property after receiving their initial violation. The Olson's have been working diligently with Sheri Lockman with the Department of Planning Services to get this resolved and even with that knowledge the neighbor has not quieted her attempt to end the parking of these trucks. It also needs to be noted that a violent act of shooting the windows on all of the trucks did occur on March 19, 2000 and was filed with the Weld County Sheriffs office. At this point it cannot be directly linked to them but, what a coincidence. With this type of violence happening I believe that a message does need to be sent that you cannot just run someone off their property or keep them from doing business. I do share their frustrations but, I believe in the system. My request is that you please allow the Olson's to pursue this PUD for the operation of their business. They would like you to grant them the time needed for processing their application. Both Ron and Claudia are hard worker's and will do what it takes to complete this application. They need you to give them the opportunity. I support them in this endeavor because Ito am in the trucking business and do believe there are a great number of us that are considerate, understanding, and willing to work with the public. On December 29, 1999, the Department of Planning Services filed a violation, (VI- 9900381), on the above referenced property. To afford the property owners due process, the Department of Planning Services has been working with the property owner to bring this property into compliance. On January 12, 2000, Sheri Lockman of the department, supplied the applicant with information and an application for a Use by Special Review permit. The department is presently waiting for the applicant to apply for the Use by Special Review permit. Should the department not receive a completed application within the next two weeks, we will refer this case to the Board of County Commissioners for a violation hearing to be conducted on March 14, 2000. Also in your letter dated January 23, 2000, you requested a written response from the Board of County Commissioners concerning this issue. At this point, commenting on this case is not judicious for the Commissioners,as there is a pending violation. Should the violation be forwarded to the Commissioners, then the Commissioners will have the opportunity to take testimony at the hearing.
