Dear Mr. Hedberg,
This letter is in response to your proposed design modifications to your sanitary landfill that was
originally approved as a Use by Special Review (USR-895). Your modifications were reviewed
by the Department of Planning Services staff and Weld County Department of Environmental
Health and it was determine that your modifications would not be considered a substantial
change to your original application (USR-895). No further applications are therefore needed
from the Weld County Department of Planning Services. However, any future revisions to your
landfill will need to be reviewed by the Weld County Department of Planning Services and may
require the submittal of a new Use by Special Review application.

Minor Design Modification
Dear Mr. Gathman:
Pursuant to our meeting on May 15, 2000 and in accordance with Condition#34 of the Certificate of
Designation Development Standards included in USR-895, the NWSL is hereby filing this minor
design modification with the Weld County Department of Planning Services(WCDPS).
On June 27, 1990, the NWSL received its Certificate of Designation(CD) from the Weld County
Board of County Commissioners. The original D&O Plan as well as condition 7b of the
Certificate of Designation Development Standards, require that the entire landfill be underlain by a
two foot thick compacted clay liner having a maximum permeability less than or equal to 1 x 10-7
cm/sec. In July 1991, Waste Services Corporation(WSC) merged with Waste Management of
Colorado, Inc. (WMC). After the merger, WMC voluntarily requested approvals from the
Colorado Department of Public Health and Environment (CDPHE) and Weld County Department
of Public Health and Environment (WCDPHE) for certain design modifications in order for the
site to more closely reflect WMC corporate guidelines at that time. The request included approval
to increase the compacted clay liner thickness from two feet to three feet. Approvals were
received from the regulatory agencies and Module 1 was constructed with a three foot compacted
clay liner. The site opened to the public for the first receipt of solid waste on February 3, 1992.
Subsequently, Modules 2, 3 and 4 were also constructed with a 3 foot thick liner.
On July 15, 1999, NWSL submitted a request to the CDPHE and WCDPHE to begin using the
original two foot thick soil liner. The request for the original two foot thick liner was based on our
review of requirements under the Colorado Solid Waste Regulations, the Certificate of
Designation and corresponding Development Standards issued by the Weld County Board of
County Commissioners, the original Design and Operations Plan (D&O), waste types received at
the facility and site specific technical information.
We have received verbal approvals from the CDPHE and WCDPHE to use the original liner
design of two feet thick as specified in the CD Development Standards and are currently awaiting
written approval. The reduction in the liner thickness along with a previously approved six inch
reduction in the protective/drainage layer placed above the clay liner results in a slight change in
the set back from the permitted property from 200 feet to approximately 195 feet. Since the

NWSL owns an additional 320 acres adjacent to the site along the north and east sides of the
landfill, we believe the change in set back is of no technical consequence as it relates to any
defined property boundary or facility operations. The change in set back will not affect the site's
ability to comply with the Colorado Solid Waste Regulations and County requirements and will
continue to provide protection of public health and environment. We have enclosed a copy of the
site plan and a drawing that illustrates the effect the design modification has on the set back for
your reference. We have obtained concurrence from the WCDPHE that this modification
constitutes a "minor change." Accordingly, we are filing this minor change with the WCDPS in
accordance with Condition#34 of the CD Development Standards.
Since receiving approvals from the CDPHE and WCDPHE for this change, NWSL has initiated
design efforts to reflect this approval and construct the next disposal cell (Module 5) with a two
foot thick liner, including the resulting change in set back. Since time is of the essence as it relates
to our construction schedule, we would appreciate any questions you may have concerning this
