HomeMy WebLinkAbout20000558.tiff RESOLUTION RE: APPROVE AGREEMENT FOR FEDERAL TRANSIT ADMINISTRATION FUNDING AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for Federal Transit Administration funding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the Colorado Department of Transportation, Division of Transportation Development, commencing January 31, 2000, and ending December 31, 2000, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, the local match for rural general public transportation will be in the amount of $57,229.00. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for Federal Transit Administration funding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the Colorado Department of Transportation, Division of Transportation Development, be, and hereby is, approved. Speckman, Executive Director way C� DATE: March 6, 2000 COLORADO SUBJECT: Agreement between the Weld County Division of Human Services and the State Department of Transportation Enclosed for the Board resolution and signature is the agreement between the Weld County Board of County Commissioners and the State Department of Transportation covering the funding and Scope of Services for the Weld County Human Services Transportation Program for Year 2000. Funding will be made available to the Weld County Transportation Program through federal transit funding sources for rural transportation programs, providing services for elderly, disabled, and general public. Federal funds awarded under this contract will be $62,200.00. Please contact Patsy Drewer at extension 3490 if you have questions. 2000-0558 Hkcc 1: AGREEMENT THIS AGREEMENT,made this 6°i day of March 2000, by and between the State of Colorado for the use and benefit of the STATE DEPARTMENT OF TRANSPORTATION, DIVISION OF TRANSPORTATION DEVELOPMENT,hereinafter referred to as the State, and WELD COUNTY. 1551 North 17th Avenue, Greeley, Colorado, 80632, a public body, hereinafter referred to as the Grantee. WHEREAS, authority exists in the Law, and funds have been budgeted, appropriated and otherwise made available, and a sufficient unencumbered balance thereof remains available for payment in Fund Code 400,Organization Code 9886 and 9887, Appropriation Code 415, Program Code 5000, Function Code 1510, Object Code 5180 1 N, GBL Code NN83 and NP 83,Reporting Code 0526_ FEIN Number 846000813, Encumbered Amount$57,229.00, and; WHEREAS,required approval,clearance, and coordination has been accomplished from and with appropriate agencies; and WHEREAS, Section 5311, of 49 U.S.C. 5301 et.seq., as amended,hereinafter referred to as the Federal Transit Act or the Act, institutes a program offering federal assistance for public transportation in rural and small urban areas by the way of a formula grant program administration by the State; and WHEREAS,the Grantee has proposed a project in the form of an application for funding under Section 18 of the Act,hereinafter referred to as the"Project"; and WHEREAS, Sections 43-1-701 and 702, C.R.S. 1973 authorize the State Department of Transportation to take all steps and adopt all procedures necessary to make and enter into such contracts as in grant programs for the purpose of assisting transportation services; and WHEREAS, the Governor of the State of Colorado, in accordance with a request by the Federal Transit Administration, hereinafter referred to as FTA,has designated the State to manage the Section 18 agencies,local public bodies and agencies thereof(including Indian Tribes), and nonprofit operators of public transportation services in areas other than urbanized; and WHEREAS,the Grantee desires to and has the legal capacity and authority to contracts with the State; and WHEREAS, the Grantee possesses the necessary fiscal and managerial capability to implement and manage the project and utilize grant funds for public transportation in nonurbanized areas of the State; NOW,THEREFORE, it is hereby agreed that: SECTION 1. PURPOSE OF AGREEMENT. The purpose of this Agreement is to state the terms, conditions, and mutual understandings of the parties as to the manner in which the Project will be undertaken and completed.
