The following itemized list of issues was discussed and resolved. Oliver and Droegemueller stated during the meeting that they had not received the redline copies of Sheets 1 and 2 of the Final PUD Plat. Ogle stated that copies had been sent to Oliver's address in Longmont. Ogle provided a second set of redlines to applicant. Oliver noted the discrepancy in the calculations for the Landscape Improvements as calculated by Planning Staff. All parties agreed to increase the Landscape Improvement portion of Exhibit A of the Improvements Agreement to be 106,000.00 dollars. This revised estimate requires a Letter of Credit for 285,000.00 dollars for the cost of improvements and supervision. Oliver and Droegemueller agreed to have Violation VI-0000252 closed prior to November 1. 2000 for the non-commercial junkyard present in the confines of"Outlot J". Should this ce se not be closed by this date, Bethany Salzman of Code Compliance will take this case to the Board. Notice was given to Salzman by Ogle through direction of Mika to schedule this case immediately. Case has been scheduled for November 14, 2000. Further, Oliver was provided a demolition permit application. Said application to be submitted to the Department of Planning Services prior to commencing any demolition activities on E ite. Oliver and Droegemueller stated that they had not provided an Erosional Drainage Plan for this filing as required. Ogle stated that the entire site will be graded and planted in native/ blue grass planting. Oliver stated that Construction Road Plans were submitted for the Elms for First Filing. Ogle stated that Public Works has no record of plans. Oliver stated that plans will be made available for Public Works as requested. Daniels-Mika signed off that the Erosional Control Plan will not be required as requested by Diane Houghtaling, Department of Public Works. Discussion continued regarding the conditions/ issues to be met prior to recording the PUD Final Plat. 1. The Board of County Commissioners shall review and approve the signed and dated Improvements Agreement According to Policy Regardinc; Collateral for Improvements (Public Road Maintenance) including the form of collateral. Ogle provided Private Road Maintenance Agreement application in triplicate. 2. The Restrictive Covenants for the Elm's at Meadow Vale shall be approved by the Weld County Attorney's Office and be ready for recording in the Office of the Clerk and Recorder. Droegemueller t submit "Supplement" of Covenants to Lee Morrison for review. 3. The applicant shall submit final construction drawings for the roadways to the Department of Public Works for review and acceptance, per Section 7.2.9.2 of the Subdivision Ordinance. Oliver agreed to provide this information. 4. The applicant shall modify the Final Plat to delineate "Common Open Space" and remove all reference to "Outlots." Oliver agreed to this condition. 5. The applicant shall close violation number VI-0000252 concerning noncompliance with the Weld County Zoning Ordinance regarding a "Non-Commercial Junkyard." Oliver agreed to this condition. Violation will be closed prior to November 1, 2000. If violation is not closed, Bethany Salzman has a violation hearing scheduled for November 14, 2000 before the Board of County Commissioners. Oliver and Droegemueller left meeting with a copy of the Redlines for sheets 1 and 2 for the PUD Final Plat. As a matter of information, the Second Filing of The Elms At Meadow Vale Planned Unit Development is located in the Northwest Quarter of Section 4, Township 2 North, Range 68 West of the 6th P.M., in Weld County, Colorado The recorded change of zone plat has previously been provided with the First Filing and is not being submitted again because the information is already available in the County's file In response to item 3 of the application, included with this letter please find a photocopy of a Commitment issued by First American Title Insurance Company dated June 6, 2000, which identifies the owners of the property, and lists any Mortgagees, Judgement Lienholders, Easement Holders, Contract holders or any beneficiary of an agreement that would be required to loin in and approved the application for the PUD being submitted. In addition please find a photocopy of the Warranty Deed by which the Elms Land Company took title on May 25, 1999 In response to item 4 of the application, Saint Vrain Valley Public Schools accepted an Elementary School site in the First Filing of The Elms At Meadow Vale and no additional land dedication will be necessary for the Second Filing. Enclosed is a letter dated July 5, 2000 fiom the District which confirms that an impact fee of$427.00 per unit will be assessed for each Lot in the Second Filing. The fee will be payable to the District to address the impact caused by the Development. In response to item 5, it will not be necessary to provide a warranty deed or other documents of dedication for public purposes because there are no dedications occurring to any public agency for areas other than the streets within PUD. In response to item 6, enclosed please find a certificate from the County Treasurer which shows there are no delinquent taxes or special assessments relating to the property included within the PUD. In response to item 7, enclosed please find the required certificate from ICBN Engineering indicating it was responsible for the design of the utilities within the PUD. In response to item 8, enclosed is a draft of the First Supplement to the Declaration of Covenants, Conditions and Restrictions for the Elms At Meadow Vale. The Supplement will be recorded simultaneously with the Filing Plat and the combination of the filing of those two instruments will expand the existing Covenants to the Second Filing. The original Covenants were recorded on November 19, 1999 at Reception No. 2733551 of Real Estate records of the Clerk and Recorder of Weld County. A draft of those Covenants was provided to the Planning Department with the first phase of the Development and is not being included again. In response to item 9, the applicant proposes to provide an improvements agreement t Weld County two weeks prior to the recording of the Plat. A majority of the infrastructure for the Second Filing has been completed and the applicant feels it would be premature to provide an improvements agreement at this time. Elsewhere in this submission the applicant is providing letters of acceptance from all utilities except U. S. West and the television cable provider. The applicant believes the Department of Public Works will inspect curb, gutter and sidewalk prior to the recording of the Plat and a more appropriate time period for submission of the improvements agreement would be two weeks prior to the recording of the Plat. In response to item 10, traffic studies have been submitted to the Department of Public Works in 1998, February of 2000 and May of 2000. The applicant received no adverse response from the Department of Public Works regarding the submission. It is the applicant's belief that the streets and offsite roads providing access to the property are adequate in every respect. The applicant understands construction of streets, sidewalks, curbs and gutters within the second filing i; at the applicant's risk. The applicant believes Weld County has accepted the design of the streets and classifications as presented in the information provided to the Department of Public Works In response to item I I, no offsite roads improvement agreement is being provided. All offsite improvements to Weld County Road 5 '/ as it relates to the Second Phase at The Elms At Meadow Vale have been completed It is the applicant's understanding no additional improvements will he required to Weld County Road 5 '/ for the Second Phase of The Elms At Meadow Vale. Ar offsite improvements agreement was presented to an approved by the County for the First Phase of this Pt.D and applicant is obligated to comply with the provisions of that offsite improvements agreement In response to item 12, no construction schedule is being submitted by the applicant All infrastructure will be complete by September I, 2000 All open space will be complete with fencing, seeding, and irrigation system Immediately adjacent to Pearl Howlett Road and to the northeast of this property is a Mail Center and open space which will also be complete by September 1. 200C 2 In response to item 13, the method of financing of the infrastructure includes payment of some portion of the infrastructure from funds available to the applicant together with infrastructure loan from FirstBank of Longmont. The Bank has secured its position with a First Deed of Trust and the applicant and the Bank have agreed to partial release provisions which will allow any Lot transferred from the applicant to third party to be free of any lien for construction of improvements within the Second Filing. No statement of estimated construction cost is provided because the improvements will have been completed prior to the recording of the PUD Plat. In response to item 14, enclosed is a certified list of the names, addresses, parcel identification numbers of owners within 500 feet of the property subject to the application. The applicant certifies that such list has been assembled within 30 days of the submission date of this application. In response to item 15, the name and address of the sole mineral lessee is HS Resources, Inc. whose address is 1999 Broadway, Suite 3600, Denver, CO 80202 A photocopy of a surface use agreement between HS Resources and the developer of Elms At Meadow Vale was included in the submission for the First Filing of this PUD and the terms and conditions of that agreement apply to the Second Filing. In response to item 16, it is the developer's belief the proposed PUD Final Plan is in compliance and meets all criteria as set forth in the Change of Zone. Essentially the PUD Final Plan is a re-submission of the information contained in the change of zone application. The use of the property is for the development of a single family housing subdivision In addition to the resident lots there will be open space which is developed and then maintained by a Homeowners Association. Lots within the subdivision will receive treated domestic water from the Left Hand Water District The developer has built an irrigation and fire protection system for each lot within the subdivision as well as in the common areas The system will be incorporated with facilities that have been put in place for the Meadow Vale Farm subdivision. The subdivision's public sewer service will be provided by St Vrain Sanitation District Public Service Company of Colorado will provide natural ga,; to the subdivision. United Power will provide electrical service to the subdivision. US West will provide telephone service to the subdivision. Each of the utility providers have indicated in writing that services are available for this project In response to item 17, a Final Plan plat map is being submitted. In response to item 18, a Landscape Map is being submitted. In response to item 19, the applicant has provided letters of acceptance from each of the utilities companies who will serve this project with the exception of U. S. West and the television cable provider who have not yet provided the letters of acceptance to the applicant. In reviewing the draft of the filing Plat which has been submitted, two issues need to he addressed. The certificate of dedication, ownership and maintenance incorrectly states the owner of the property as Meadow Vale Farm, Inc The owner of the property is the Elms Land Company, 3 LLC. Secondly, the filing Plat does not contain signature lines for the Lienholder. The Mylar of the Plat will correct these two issues. The projected student imp act upon the St. Vrain Valley School District of what appears to be the possibilty of 77 new single family units on 34.4 acres is a total of 51 students. Any students living in this subdivision would attend Mead Elementary School, Mead Middle, and Skyline High School under the present school boundaries. However, due to potential growth in these schools his development and other existing developments in this feeder could be placed in another attendance area in the futire. This development would impact all levels of school in the current attendance area. While there are new schools planned in this area which should reduce overcrowding, there are other approved developments which would, together with this proposal, have a significant cumulative impact on these schools. As the volume of developments increases in this attendance area with no alleviation of the existirg overcrow led conditions, the ability to provide the same quality education for these new students that is provided students in o her areas becomes increasingly difficult. Typically the District would oppose development that would overcrowd the schools however, this developer has signed an agreement to pay a cash-in-lieu of land fee to address the school site needs for this area. This payment is required prior to the issuance of a building permit for each individual lot. The District wil issue a receipt as each lot is paid for that will serve as proof of satisfaction of this requirement. Based on the hydraulic studies submitted the required fire flow of 1,000 gallons per minute will be provided. Fire apparatus access throughout the filing meets the requirements of the Fire District as shown on the plans submitted. The Fire District has no objection to the recording of the 3rd Filing of the Elms at Meadow Vale. Before street construction may begin and permits issued, street construction plans must be submitted to the Fire District for review and approval.
