Harper, I respectfully submit this Letter of Intent for Annexation and land use change of major impact for the Lake Ridge development. As requested by the Town, Weld County Road 32 and the associated right-of-way(approx. 9.994 acres), from the I-25 Frontage Road to the eastern boundry of the below mentioned property, is included in this annexation request. Lake Ridge is composed of 10.0 acres of land that lie within the Mead Area of Influence as outlined in the Mead Area Comprehensive Plan(MACP). This project is consistent with the goals and strategies of the MACP. The parcel is located in the SW 1/4 of Section 13, T3N, R68W of the 6th P.M., Weld County, Colorado, (5425 WCR 32, Longmont, CO), approximately 1 mile east of I-25 on Weld County Road 32. The annexation of this property would infill areas already annexed to the Town, the property lies approximatly 1.25 miles east of the Single Tree Subdivision and the Town's current boundary (I-25 Frontage Road), and is approximatley 1 mile west of Grandview Estates, which is already annexed to the Town. The proposed annexation will divide this already developed lot into four lots, with one lot being zoned for Independent Living Apartments for Seniors (Lot 3, approx. 5 acres), one lot being dedicated to the Town of Mead for use as a wastewater treatment facility(Outlot A, approx 2/3 acre), and the remaining 2 lots(Lots 1 and 2, approx. 2.5 acres each) being zoned single family residential estate lots. The single-family homes will be larger homes (2500-5000 sf) designed to take advantage of the fabulous views of Lake Thomas to the north, and the mountains to the west. Design and architectural guidelines will be strictly applied and enforced to ensure an attractive estate setting that provides unimpaired views of the lake, fields, and mountains, and allow for use as"horse properties". This property is currently in the Agricultural District of Weld County and has a USR(USR#860) to operate as a Care Facility. The existing 25,000+/- sq. ft. building is a one story red brick ranch, with a pitched roof, and a walkout basement, all in the typical style of the early 1970's. The existing single story farmhouse, also located on the property, is a 3 bedroom, one bath, typical farmhouse built in 1958 and renovated in 1999. The plans call for using the existing building and making non-structural changes to the interior of the building, converting it for use as Independent Living for Senior Apartments. Improvements to the building will not increase the existing "foot print". Depending upon final interior design, the existing building will be converted into approximately 21 one-bedroom, and 7 two-bedroom units for seniors. In addition to the fabulous setting and views, amenities will include; on-site manager/maintenance, laundry facilities, recreation room, library/community room, community garden, outdoor recreation and picnic areas. The existing three-bedroom house and out buildings will be used in conjunction with the senior complex. The 2/3 acre parcel of land (Outlot A), which includes an existing sewage treatment facility, and is currently leased to the Town of Mead, will be dedicated to the Town upon annexation as outlined in the Lease Agreement. The engineer-designed aeration and chlorination treated discharge facility is permitted by the State of Colorado, permit #COG-582017. In order to streamline the time frame for annexation, preliminary plat, and final plat, I would like to request that the overall Concept Plan/Utility.Plan/Preliminary Plat be considered as such so that upon approval of annexation only the final plat will be required. Because the majority of the development involves existing buildings and improvements, and since all engineering and other reports were submitted and approved by all Weld County departments and referral agencies during the PUD process last year, I feel this reasonable request makes sense and should be supported. The two properties to the east of the proposed annexation are what would be considered Estate lots,they are both about 2 acres in size. The surrounding properties as shown on the vicinity map,are primarily agricultural related properties,although there are seven dwellings within one-half mile of the subject property. Six of the seven dwellings are located on properties which would probably be defined as Estate lots,the other dwelling is on what would be described a farm house on a large agricultural lot used for farming. 5. Give a brief nonlegal description of the proposed land use change including the number of living units, type of home occupation proposed,the placement of a mobile home, etc. The proposed annexation will divide this already developed lot into four lots,with one lot being zoned for Independent Living Apartments for Seniors(Lot 3,approx.5 acres),one lot being dedicated to the Town of Mead for use as a wastewater treatment facility(Outlot A,approz 2/3 acre),and the remaining 2 lots(Lots 1 and 2,approx.2.5 acres each)being zoned single family residential estate lots. The change of zone is a very similar,yet significantly less intensive,use of the site. Essentially substituting one type of housing facility,for another less intensive type of housing. The basis for this claim is that the existing USR allows this property to be used as a Nursing Home/Health Care Facility. The approved use is for an 87 bed facility. With the 87 patients and a 24 hour staff of approximately 95,the total occupancy load is about 120 persons at any one time. The proposed use,including the 2 Estate lots,will reduce the total occupancy load to about 40 persons,a reduction of 66%. The impact to public services should be to an extent far less than already exists under the use as a Nursing Home/Health Care Facility. If the proposed land use change involves the annexation of land,the applicant must submit a petition and supporting documents in the form prescribed by C.RS. 31-1 2-101,et seq. In addition,the applicant shall post a bond or other security as required by Section 1 7-1-4.1 of the Mead Land Use Code. 6. Provide a sketch plan of the proposed land use change, including a site analysis consisting of a map,plot plan or diagram showing the total acreage,abutting landowners and land uses,streets,highways,utilities that will service the proposed development;and major physical features, including drainage and the location of natural hazards. Notary Public PETITION FOR ANNEXATION The Board of Trustees of the Town of Mead, Colorado We, the undersigned land owners, in accordance with Colorado law, hereby petition the Town of Mead and its Board of Trustees for annexation to the Town of Mead of the following described unincorporated territory located in the County of Weld and State of Colorado, to wit: See Attached Legal Descriptions— Lake Ridge Annexation No. 1 to the Town of Mead, Lake Ridge Annexation No. 2 to the Town of Mead, Lake Ridge Annexation No. 3 to the Town of Mead. As part of this petition, your petitioner further states of the Board of Trustees of Mead, Colorado, that: 1. It is desirable and necessary that the territory described be annexed to the Town of Mead. 2. The requirements of C.R.S. Sections 31-12-104 and 31-12-105, as amended, exist or have been met in that: A. Not less than one-sixth of the perimeter of the area proposed to be annexed is contiguous with the Town of Mead or will be contiguous with the Town of Mead within such time as required by 31-12-104. B. A community of interest exists between the area proposed to be annexed and the Town of Mead. C. The area proposed to be annexed is urban or will be urbanized in the near future. D. The area proposed to be annexed is integrated with or is capable of being integrated with the Town of Mead. E. No land within the boundary of the territory proposed to be annexed which is held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has been divided into separate parts or parcels without the written consent of the landowner or landowners thereof, unless such tracts or parcels were separated by a dedicated street, road or other public way. F. No land within the boundary of the area proposed to be annexed which is held in identical ownership, comprises twenty acres or more, and which, together with the buildings and improvements situated thereon has an Assessed value in excess of two hundred thousand dollars (200,000.00) fin ad valorem tax purposes for the year next preceding the annexation, has been included within the area proposed to be annexed without the written consent of the landowner or landowners. G. No annexation proceedings have been commenced for any portion of the territory proposed to be annexed for the annexation of such territory to another municipality, H. The annexation of the territory proposed to be annexed will not result in the detachment of area from any school district. I. The annexation of the territory proposed to be annexed will not have the effect of extending the boundary of the Town of Mead more than three miles in any direction from any point of the boundary of the Town of Mead in any one year. J. Prior to completion of the annexation of the territory proposed to be annexed, the Town of Mead will have in place a plan for that area, which generally describes the proposed: Location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the Town of Mead, and the proposed land uses for the area; such plan to be updated at least once annually. K. In establishing the boundary of the territory proposed to be annexed, if a portion of a platted street or alley is to be annexed, the entire width of the street or alley has been included within the territory to be annexed. The Town of Mead will not deny reasonable access to any landowners, owners of any easement, or the owners of any franchise adjoining any platted street or alley which is to be annexed to the Town of Mead but is not bounded on both sides by the Town of Mead. 3. The owners of more than fifty percent of the area proposed to be annexed, exclusive of dedicated streets and alleys, have signed this petition and hereby petition for annexation of such territory. 4. Accompanying this petition are four copies of an annexation map containing the following information: A. A written legal description of the boundaries of the area proposed to be annexed. B. A map showing the boundary or the area proposed to be annexed, said map prepared and containing the seal of a registered engineer. C. Within the annexation boundary map, a showing of the location of each ownership tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat numbers of plots or of lots and blocks. D. Next to the boundary of the area proposed to be annexed, a drawing of the contiguous boundary of the Town of Mead and the contiguous boundary of any other municipality abutting the area proposed to be annexed, and a showing of the dimensions of such contiguous boundaries. 5. Upon the Annexation Ordinance becoming effective, all lands within the area proposed to be annexed will become subject to all ordinances, rules and regulations of the Town of Mead, except for general property taxes of the Town of Mead which shall become effective as the January 1st next ensuing. 6. The zoning classification requested for the area proposed to be annexed is Mead Performance District 1. 7. The existing buildings are served via a 1" tap off of the Little Thompson 6"water main located in the WCR 32 right-of-way. Sewage Disposal Provisions All uses within the proposed annexation will be served by the existing sewage treatment facility. The engineer- designed aeration and chlorination treated discharge facility is permitted by the State of Colorado, permit #COG-582.017. The sewage treatment facility was constructed in 1989 and upgraded in 1.994. This treatment facility is monitored by the State of Colorado on a monthly basis. The treatment facility is permitted to handle 12,000 gallons per day, the equivalent of approximately 160 persons. The occupant level of the.proposed annexation will allow this treatment facility to operate at about 30% of it's capacity,allowing the Town to utilize the excess capacity as it sees fit. As addressed in the Lease Agreement, the Town of Mead is responsible for ongoing operation and maintenance of the wastewater treatment plant as well as improvements required for sewer service to the 2 single-family estate lots. STATEMENT Town's Plans for Financing Municipal Services to be Extended Adequate urban services are already extended the site. No changes or additions will be necessary for the existing buildings. The 2 single-family estate lots will be easily served by the existing services which are located in the WCR 32 right-of-way, the sanitary sewer service improvements necessary for the 2 single family estate lots will be provided by the Town as outlined in the Lease Agreement dated August 18, 1999. Streets There will be no internal streets for the Lake Ridge Annexation, all uses will be served via private driveways. Weld County Road 32 is proposed to be annexed from the I-25 frontage road to the east end of annexed property. Weld County Road 32 is a paved road and will be maintained by the Town upon annexation. The current USR allows 5 access points off of WCR 32 to the property, the concept plan for the project also shows 5 access points into the property. Sewer The existing wastewater treatment facility will be dedicated to the Town as called for in the Lease Agreement. Therefore future land uses should provide for the widest possible variety of residential densities and uses. The Lake Ridge annexation will provide two types of housing, Independent Living for Senior Apartments and 2 single-family homes. The design of this development will allow residents to live in a pleasant surrounding, as proposed in the Mead Comprehensive Plan. The Town of Mead and the surrounding area, currently offer no senior housing. There is a tremendous demand for senior independent living housing, Lake Ridge is designed to fill this need. The annexation of Lake Ridge will meet both the existing and future needs of the Town, and the surrounding community,by expanding housing opportunities to the senior population. Demographic studies indicate that the housing needs and other services for this particular sector of the population will continue to exhibit rapid growth. Plans call for using the existing building and making major non-structural changes to the interior of the building, converting it for use as Independent Living for Senior Apartments. Improvements to the building will not increase the existing "foot print". Depending upon final interior design, the existing building will be converted into approximately 21 one-bedroom, and 7 two-bedroom units for seniors. In addition to the fabulous setting and views, amenities will include; on-site manager/maintenance, laundry facilities, recreation room, library/community room, community garden, outdoor recreation and picnic areas. The existing three-bedroom house and out buildings will be used in conjunction with the senior complex. It is extremely important to note that the proposed annexation will in actuality, change the zoning to a much less intensive use. The change of zone is a very similar, yet significantly less intensive use of the site, essentially substituting one type of housing facility, for another less intensive type of housing. The basis for this claim is that the existing Weld County USR allows this property to be used as a Nursing Home/Health Care Facility. The approved use is for an 87-bed facility. With the 87 patients and a 24-hour staff of approximately 95, the total occupancy load is about 120 persons at any one time. The proposed use, including the 2 single-family estate lots, will reduce the total occupancy load to about 40 persons, a reduction of 66%. The impact to public services and facilities should be to an extent far less than already exists wider the use as a Nursing Home/Health Care Facility. Mother major benefit for the community with this annexation will be the dedication of the existing wastewater treatment facility to the Town. The addition of the treatment facility to the Town's infrastructure portfolio will allow the Town to forgo making lease payments for the facility. Additionally, and of significant importance to the Town, the wastewater facility will provide the strategic benefit of having a permitted facility located in a major drainage basin that lies within the Town's Area of Influence. Further,the strategic benefit of having an existing permitted wastewater treatment facility at Lake Thomas will allow the Town tremendous flexibility with regard to future planning, and opportunities related to future wastewater treatment needs.
