RE: AUTHORIZATION TO PURCHASE FRONT END LOADER (CATERPILLAR 966C)
FROM WAGNER EQUIPMENT COMPANY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on January 28 , 1981, the Board of County Commis-
sioners of Weld County, Colorado awarded the bid for a front end
loader to Wagner Equipment Company, and
WHEREAS, the bid submitted by Wagner Equipment Company
included the stipulation that the 2 front end loaders currently
in stock were subject to prior sale, and
WHEREAS, Wagner Equipment Company has informed the Board
of County Commissioners that one of the units has been sold
and that the remaining unit has been on demonstration to several
customers and has incurred approximately 175 hours of use on
it, and
WHEREAS, Wagner Equipment Company has offered to sell the
remaining unit to Weld County at a reduced rate of $103,957 .40 .
Further, the remaining unit would be given a new bucket, tires
and considered a new machine under warranty for 1000 hours from
the date of delivery to Weld County, and
WHEREAS, the Board deems it advisable to accept the offer
of Wagner Equipment for the front end loader (Caterpillar 966C -
serial number 76J15483) .
NOW, THEREFORE, BE IT RESOLVED that the Board of County Com-
missioners of Weld County, Colorado hereby authorizes the purchase
of the front end loader (Caterpillar 966C - serial number 76J15483)
from Wagner Equipment Company at the reduced price of $103, 957 .40

which includes a new bucket, tires and warranty for 1000 hours
from the date of delivery to Weld County.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 2nd day of
February, A.D. , 1981.

On January 13, 1981, Wagner Equipment Co. submitted a bid to Weld County
on a front end loader. The bid was $ 109,657.40 for a Caterpillar 966C loader.
Included in the bid was a stipulation that Wagner Equipment had only two of
these units available because Caterpillar had a model change in the 966 size
machine occur, so the 966C were no longer being produced and a new 966D was
being produced. Wagner Equipment Co. stated that these two units were subject
to prior sale. The situation which Wagner finds itself in is that one of the
units has been sold (s/n 76J16087) and the remaining unit has been on demo—
stration to several customers and has occurred approximately 175 hours on it.
Therefore, we (Wagner) would like to offer the remaining unit (s/n 76J15483)
to Weld County at a reduced price due to the hours that are on it. We will
offer this 966C at $ 109,657.40 less $ 5,790.00 which equals $ 103,957.40.
If this is satisfactory to your approval, then Wagner will have to decline the
bid due to the fact that we can not meet delivery based on our bid. This 966C
would be given a new bucket, tires and considered as a new machine under
warranty which would be 1000 hours from date of delivery to Weld County.
I would at this time like to take this opportunity and thank each of you
for allowing us to bid to Weld County. I hope that we can continue to do
business with you in the future.
