RE: APPROVE MINOR RESUBDIVISION, S #529 - JOHN WINDELL AND LAURANN RINK
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 24th day of
April, 2000, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the
application of John Windell and Laurann Rink,for a Minor Resubdivision, S#529, on the following
described real estate, to-wit:
Lots 1-3, Lupton Meadows Land Company Division
No. 1 of Section 13, located in the NE1/4 of Section
13, Township 2 North, Range 67 West of the 6th
P.M., Weld County, Colorado, and
WHEREAS, Section 8.2.6 of the Weld County Subdivision Ordinance provides standards
for review of said Minor Resubdivision, S #529, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having
been fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8.3.1 of the Weld County Subdivision Ordinance.
2. The request is in conformance with Section 8.3.2.3 of the Subdivision Ordinance,
as follows:
a. Section 8.3.2.3.1 -The lot line revision complies with the approved recorded
final plat. The proposed resubdivision will not affect existing utility
easements, nor will it impact access to properties adjacent to the
subdivision. The applicants have agreed to dedicate sufficient public road
right-of-way to Weld County in order to ensure the location of a 60-foot right-
of-way along the northern boundaries of the reconfigured Lots 1-3. The
applicants have also agreed to enter into a Nonexclusive License
Agreement for the upgrade and maintenance of a roadway along the 60-foot
right-of-way. This will ensure sufficient access for Lots 1-3.
b. Section 8.3.2.3.2 - The application complies with the adopted rules,
regulations,and ordinances currently in force and affecting the subdivision.
This application will revise the location of lot lines within the Lupton
Meadows Land Company Division No. 1 of Section 13, recorded in 1909.
No records have been found regarding covenants for this subdivision. No
utility easements were dedicated within this subdivision at the time of the
original platting. Due to the fact that dedication of easements along property

lines at this time may interfere with existing easements on these properties
and there are no other lots within this subdivision which have dedicated
utility easements, the applicants will not need to so dedicate such
easements on the plat. The resubdivision satisfies all other County
requirements upon providing access along the northern property lines.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of the Weld County Board of Commissioners for a Minor
Resubdivision, S #529, on the hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1. The Minor Resubdivision plat shall be submitted to the Weld County Department of
Planning Services within 30 days of approval by the Weld County Board of County
Commissioners for recording in the Office of the Weld County Clerk and Recorder.
The map shall be prepared in accordance with the requirements of Section 8.2.5.6
of the Weld County Subdivision Ordinance, but will not be required to dedicate any
utility easements thereon.
2. Prior to recording the plat:
A. The applicants shall dedicate to Weld County sufficient public road right-of-
way in order to ensure the location of a 60-foot right-of-way along the
northern boundaries of the reconfigured Lots 1-3. The applicants shall also
enter into a Nonexclusive License Agreement for the upgrade and
maintenance of a roadway along the 60-foot right-of-way. This will ensure
sufficient access for Lots 1-3.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 24th day of April, A.D., 2000.

THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS APPROVAL OF THIS REQUEST
FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 8 3 1 of tl e
Weld County Subdivision Ordinance.
2. The request is in conformance with Sections 8.3.2 1-8.3.2.2 of the Subdivision Ordinance , as
follows:
8.3.2.1 - The lot line revision complies with the approved recorded final plat. The proposed
resubdivision will not affect existing utility easements on the property nor will it impact access 'o
adjacent properties in the subdivision. The applicants will dedicate a 60' right-of-way along tf e northe n
boundary of the property and sign a non-exclusive license agreement for the upgrade and rn:iintena-re
of a roadway. This will ensure sufficient access for Lots 1-3.
8.3.2.2 - The application complies with the adopted rules, regulations, and ordinances curie!ithv in fc n e

The Department of Planning Services recommends approval with the following
conditions:
1 . The resubdivision plat shall be submitted to the Weld County Department of Pllanrirg

RE: Request for an internal lot line change
Dear Sir/Madam:
Please consider our request for an internal lot line change for the property located at 99`)9
Weld County Road #25, (Fort Lupton, Colorado 80621. The purpose for this request is is
follows:
I. The 115-acre farm is divided into 3 long narrow lots approximating 38 acres each
that run in an east west direction.
2. The west-end of the three lots includes approximately 40 acres of wetland that can not
be used for agricultural purposes.
3. The east-end of the lots are farmed with corn and alfalfa with a smaller acreage
dedicated to the production of wetland plants used in reclamation projects.
4. I will be 70 on April 4, planning retirement and would like to sell the tillable portion
of the property (eastern two-thirds) to my sons and daughter-in-law. They have no
use for and do not want the wetland portion of the property nor can they afford to buy
the wetland acreage.
5. Therefore, it is our desire (owners) to change the direction of the lot lines that extend
east and west to north and south. Nothing else will change. This would permit us to
retain the wetland portion of the farm where our home is located and sell the
remaining two lots (70 acres) to family members and continue our family business.
I urge the planning department to give this request your strongest consideration and look
forward to your honoring this request.

The Weld County Public Works Department has reviewed this subdivision's Final Plat reoue si
Our comments and requirements are as follows:
External Roadways: WCR 25 is designated as a local road in the Weld County Comprehensive
Transportation Plan. The roadway has the require 60' of right-of-way.
Internal Roadway: With the present configuration each lot has access to a public road. In _fruer
to provide this to the new lots, 60' of right of way will have to be dedicated to Weld County along
the north edge of the property. The owner will also be required to sign a non-exclusive license
agreement for the upgrade and maintenance of a roadway.
Drainage: The storm water study is waived on this re subdivision.
Traffic: A traffic study will not be required for this re-subdivision.
