HomeMy WebLinkAbout20002600.tiff HEARING CERTIFICATION DOCKET NO. 2000-60 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1282 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT AND ANIMAL CONFINEMENT OPERATION IN THE A(AGRICULTURAL) ZONE DISTRICT -JOHN JOHNSON A public hearing was conducted on October 25, 2000, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair- EXCUSED Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Julie Chester Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 9, 2000, and duly published October 12, 2000, in the South Weld Sun, a public hearing was conducted to consider the request of John Johnson for a Site Specific Development Plan and Use by Special Review Permit #1282 for an Agricultural Service Establishment and Animal Confinement Operation in the A(Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Julie Chester, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Chair Pro-Tem Geile advised John Johnson, applicant, that he has the option of continuing this matter to a date when the full board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Kirkmeyer will listen to the record and make the determining vote. Mr.Johnson indicated he would like to proceed today. Ms. Chester gave a brief description of the location of the site. She stated seven referral agencies responded in favor of the application and proposed Conditions of Approval. Ms. Chester stated staff recommends approval as indicated in the Administrative Review. In response to Commissioner Hall, Ms. Chester stated Condition of Approval #2.A requires Special Use Permits #201 and#450 for this site be vacated. Responding to Commissioner Baxter, Ms. Chester stated the Special Use Permits were done in the 1970's and there is no record of use on the site prior to 1973. She explained the site was previously owned by Chuck Carlson and was used for a feedlot. 2000-2600 PL0741 HEARING CERTIFICATION - JOHN JOHNSON (USR#1282) PAGE 2 Ms. Chester stated the site is serviced by the Galeton Fire Protection District, which did not respond to a referral; however, she did call and the District indicated no conflicts. In response to Commissioner Hall, Trevor Jiricek, Weld County Department of Public Health and Environment, stated the lagoons will be next to an irrigation canal; however, they will have to be lined in accordance with the Confined Animal Feeding Operation (CAFO) Regulations and provide evidence of such. Mr. Jiricek stated the CAFO Regulations do not address setbacks between holding ponds and other waters or wells. In response to Commissioner Baxter, Mr. Jiricek stated the facility will have to design the ponds to specifications for a 25-year, 24-hour storm event, and he is satisfied that they are properly sized. Mr. Johnson stated he owns J.F. Cattle Company, which feeds Holstein heifers to supply dairy replacements throughout Weld County. Mr. Johnson stated he has owned the operation for five years, and it was previously owned by Chuck Carlson. He further stated it is consistent with surrounding uses because Booth Feedlot is located across the road to the north, and he would like to expand his operation. In response to Commissioner Hall, Mr. Johnson estimated most of the traffic at the site is generated from hauling in feed; however, there may be one or two semi-trucks per day to bring in or remove cattle. Mr. Johnson explained Weld County Road 47 leads to the airport and is not generally used by the haul trucks. Responding to Commissioner Hall, Don Carroll, Department of Public Works, stated the access is on the eastern end of the facility to accommodate semi-trucks. He stated there is an adequate turning radius and sight distance. No public testimony was offered concerning this matter. Thomas Haren,AgPro Environmental Services, LLC, represented the applicant and stated he and the applicant have reviewed and agree with the proposed Conditions of Approval and Development Standards. Commissioner Hall moved to approve the request of John Johnson for a Site Specific Development Plan and Use by Special Review Permit #1282 for an Agricultural Service Establishment and Animal Confinement Operation in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. Commissioner Hall commented the Draft Resolution needs to be amended to remove any language regarding amendment of the previous Special Use Permits on the site because they will be vacated.
