HomeMy WebLinkAbout20001277.tiff RESOLUTION RE: APPROVE COMMUNITY CORRECTIONS ALLOCATION LETTER AND AUTHORIZE CHAIR TO SIGN - COLORADO DEPARTMENT OF PUBLIC SAFETY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Community Corrections Allocation Letter between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the 19th Judicial District Attorney's Office, and the Colorado Department of Public Safety, commencing July 1, 2000, and ending June 30, 2001, with further terms and conditions being as stated in said letter, and WHEREAS, after review, the Board deems it advisable to approve said letter, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Community Corrections Allocation Letter between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the 19th Judicial District Attorney's Office, and the Colorado Department of Public Safety be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said letter. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 24th day of May, A.D., 2000. Box 758 Greeley, CO 80632 Dear Ms. Spangler: Pursuant to paragraph 1 .A.1 of the contract between the Department of Public Safety, Division of Criminal Justice (DCJ), and the Board of Commissioners of Weld County, DCJ hereay notifies you of the following funding allocations for Fiscal Year 2000-2001 . 1) The maximum amount payable from the State for community corrections services under Contract # DCJ 00-04-19, for the period July 1, 2000 through June 30, 2001, is as follows: $ 926,808 for residential transition placements at a daily rate of $36.80 per offender, $ 94,024 for residential parole placements at a daily rate of $36.80 per offender, Bill Owens $ 77,000 for residential transition specialized female services as described in Exhibit GOVERNOR "A" at $14.67 per day per offender, which is the difference between the specialized AristeTes IN.Zavams female services per diem ($51 .47) and the regular transition residential per diem EXECUTIVE DIRECTOR ($36.80). Division of Criminal Justice Colorado State $1,047,696 for residential diversion direct sentence and diversion condition of Patrol probation placements at a daily rate of $36.80 per offender, Colorado Bureau of Investigation $ 147,635 for diversion non-residential placements at no more than $257.00 per Division of Fire Safety month per offender, not to exceed an average of $5.12 per day per offender, $ 25,787 for 3/4 house placements at a daily rate of no more than $14.13 per offender, (J no more than $8.24 per day per offender for day reporting center services, and per diem supplements to provide specialized services, with prior approval by the State, for offenders with special needs. DCJ Home Page.www.state.co.us/gov_dir/cdps/dcj/dcj.hlm E-Mail:raymond.slaughter@cdps.stateco.us Allocation Letter - Board of Commissioners of Weld County May 12, 2000 Page Two 2) Payment pursuant to this Allocation Letter shall be made as earned, in whole or in part, from available State funds encumbered in an amount not to exceed $38,045,534 for the purchase of community corrections services for all Contractors, subject to the ii rite item and per diem expenditure limitations in Paragraph 1 . above. It is further understood and agreed that the maximum amount of State funds available for fiscal year 2000-2001 for the purchase of community corrections services is in the amount of $38,045,534. Total liability of the State, at any time, for such payments shall ae limited to the unencumbered amount remaining of such funds. 3) Funds allocated in this Funding Letter are for services rendered during the current contract period and cannot be used to pay for community corrections services provid ad in prior or future fiscal years. 4) Any unexpended funds allocated or advanced to the Contractor by the Funding Letter shall be reverted to the State no later than September 1, 2001 . 5) The State may prospectively order an increase or decrease in the amount payable and the corresponding levels of service under this Funding Letter through a "Change Orcer Letter", approved by the State Controller or his designee, in the form attached, mark ed as Exhibit "C" and incorporated herein by reference, subject to the following conditions: a) The Change Order Letter ("Letter") shall include the following: 1) Identification of Contract by Contract number, Allocation Letter Number and affected paragraph number(s); 2) Types of service or programs increased or decreased and the new level of each service or program; 3) Amount of the increase or decrease in level of funding for each service or program and the total; 4) Intended effective date of the funding change; 5) A provision stating that the Change shall not be valid until approved by the State Controller or such assistant as he may designate. b) Upon proper execution and approval, such Letter shall become ar amendment to this Contract and, except for the Special Provisions of the Contract, the Letter shall supersede the Contract in the event of a conflict between the two. It is understood and agreed that the Letter may be used only for increased or decreased funding, and corresponding adjustments to service levels and any budget line items. c) If the Contractor agrees to and accepts the change, the Contractor shall execute and return the Letter to the State by the effective date indicated in the Letter. In the event the Contractor does not accept the change, or fails to Allocation Letter - Board of Commissioners of Weld County May 12, 2000 Page Three timely return the executed Letter, the State or the Contractor, upon notice to the other, may terminate this Contract effective at any time after twenty (20) days following the return deadline specified in the Letter. Such notice shall specify the effective date of termination. In the event of termination, the parties shall not be relieved of their obligations up to the effective date of termination. d) Increases or decreases in the level of contractual funding made through the Letter process during the term of this Contract may be made under the following circumstances: 1) Adjustments to reflect current year expenditures; 2) Supplemental appropriations resulting in an increase or decrease in the amounts originally budgeted and available for the purposes of this program; 3) Closure of programs and/or termination of related contracts; 4) Delay or difficulty in implementing new programs or services; and 5) Other special circumstances as deemed appropriate by the State. This amendment to the contract is intended to be effective July 1 , 2000, but in no event shall this amendment be deemed valid until it shall have been approved by the State Controller or his designee. This letter provides the per diem rates and allocations for the second fiscal year of the five-year community corrections contract. Please follow the signature instructions on the enclosed pink checklist. Then return all three copies of the letter to me BEFORE JUNE 19,2000. Original signatures are required on all three copies. You will receive a fully executed copy of this letter,upon completion of processing. Also enclosed are three copies of Contract Amendment# 1, which makes a change to the five-year community corrections contract. This amendment increases from$10.00 to $13.00 the maximum amount that community corrections providers are allowed to charge residential offenders in their program.
