RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 366 , LOT "B"
VIRGIL N. OTTINGER
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners did approve Re-
corded Exemption No. 366 , Lot B, concerning property described
as part of the Sz, Section 22 , T6N, R64W of the 6th P.M. , Weld
County, Colorado, and
WHEREAS, Virgil N. Ottinger has requested that Recorded Ex-
emption No. 366, Lot B, be amended as follows: To amend the
divided property into parcels of 72 . 027 acres and 3 . 220 acres,
more or less. The proposed amended recorded exemption would allow
the applicant to separate a 3 acre, more or less, parcel that
contains an existing residence from the 75 acre, more or less,
parcel known as Lot "B" of Recorded Exemption No. 366, and
WHEREAS, the Board of County Commissioners has studied said
request to amend Recorded Exemption No. 366 , Lot "B" and deems
it advisable to approve the amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove amend-
ment to Recorded Exemption No. 366 , Lot "B" for Virgil N. Ottinger
be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 30th day of
March, A.D. , 1983 .

Re: Amended Recorded Exemption #366, Lot "B"
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Virgil N. Ottinger for an amended recorded exemption. The
parcel of land on which this request is being made is described as part
of the s', Section 22, T6N, R64W of the 6th P.M. , Weld County, Colorado.
The property is located 1/2 mile north of Gill on Weld County Road 66.
The property contains approximately 75.247 acres of Class IIs, IVe, and
IVs irrigated soils and IVe and VIe nonirrigated soils.
The request is to amend the divided property into parcels of 72.027
acres and 3.220 acres, more or less. The proposed amended recorded
exemption would allow the applicant to separate a 3 acre, more or less,
parcel that contains an existing residence from the 75 acre, more or
less, parcel known as Lot "B" of recorded exemption #366.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld
County Subdivision Regulations submission requirements;
2. The request complies with Section 9-2 E. of the Subdivi-
sion Regulations as follows:
The 75 acres, more or less, under consideration will
allow agricultural and related uses to be the predomin-
ant uses. The uses will be compatible with existing
surrounding uses. These facts support the proposal
as being consistent with the intent clause of the
agricultural zone district.

- The proposal is in compliance with Section 1-3 of the
Weld County Subdivision Regulations and the proposed
land division complies with the Weld County Comprehen-
sive plan, therefore the proposed use is consistent
with efficient and orderly development;
- The proposal does not exist in an overlay district area;
- The proposed lots meet minimum lot size requirements for
land division;
- The North Weld County Water District has indicated in
RE-366 that adequate water service is available for
this parcel;
- The two lots proposed will have adequate access from
Weld County Road 66;
- Existing residences are presently served with adequate
sewage facilities.

residence, outbuildings, hog buildings and pens.

To Whom It May Concern:
This letter is written to explain the reason why I , Virgil
N. Ottinger, want my home and a small acreage that goes
with the homestead divided off from the farm owned jointly
by Virgil N. and Olena W. Ottinger h/w and Charles and
Renee' Ottinger h/w.
I have a severe asthma condition caused by hog dandruff,
manure mold and grain molds . This home is almost constantly
subject to manure mold, minute particles in the air, from
one direction or the other. Due to this particular health
hazard, I cannot live there .
For this reason, I pray for your consideration in granting
my wife and I our request, so that we can make our home
in a more suitable environment for my health.
