SUBJECT: Condition of approval fe Z,544, Reflection Bay
The Department of Planning Services received the following faxed letter from Welborn Sullivan
Meck & Tooley, P.C., attorneys for Union Pacific Resources Company and Union Pacific Land
Resources Corporation. They are requesting that a condition of approval be added addressing the
mineral rights on the property. The following condition is proposed:
2. Prior to recording the Change of Zone plat:
E. The applicant shall submit a copy of an agreement with Union Pacific Resources
Company and Union Pacific Land Resources Corporation, stipulating that all
concerns of the company have been adequately addressed or submit evidence that
reasonable accommodations have been made. (Department of Planning Services)
Re-lettering after the new condition should also be implemented. Thank you for your consideration
in this matter.

Dear Julie:
Enclosed is a letter addressed to the Weld County Board of County Commissioners with
respect to the above-referenced application for a rezoning request ("Application")to be heard before
the Weld County Board of County Commissioners at a hearing on July 19. I ask that you please
provide a copy of this letter to the Board at the hearing tomorrow.
I have documented in the letter to the Board the mineral interests owned by Union l'aci lie
Resources Company and Union Pacific Land Resources Corporation in the property that is included
in the Application and ask that the Board make an agreement between the Applicants and the 1 J P
entities and their mineral lessees or assignees a condition of approval of the rezoning request I hn •e
left a message with Mr. LaFaver to call me. but we have not as yet had an opportunity to discuss the
matter.

Ladies and Gentlemen:
This law firm represents Union Pacific Resources Company ("UPRC") and Union Pacifti
Land Resources Corporation ("UPLRC") with respect to the application for a change of zone
("Application") for property located in the SW4SW4 of Section 29, Township 2 North, Range 68
West ("Property") which is currently pending before the Board.
UPRC and UPLRC (together the "UP entities") own all of the minerals that underlie the
Property.
UPRC owns the oil, gas and associated liquid hydrocarbons under the Property. U PRC
has given an oil and gas lease for the Property which has been assigned to HS Resources, Inc.
("HS"). HS operates a producing well on the Property identified as the Champlin 86N#1 .
UPLRC owns all of the minerals other than the oil and gas under the Property. UPLRC or
an affiliate, Rock Springs Royalty Company, gave a lease to C&M Ready Mix to develop the
sand and gravel under the Property. It appears that the sand and gravel lease has expired;
however, UPLRC believes that there may be potential for other hard rock mineral development
other than the sand and gravel.
The UP entities have no objection to the rezoning of the Property subject to the
understanding that the Applicants and UPRC and HS work out an acceptable surface use

agreement for the present and future development of the oil and gas prior to the time that the
Property is platted and that they reach an agreement with UPLRC for the sale or other disposition
of the minerals other than the oil and gas.
We ask that an agreement between the Applicants and the mineral owners and lessees be
made a condition of approval of the rezoning application.
