HomeMy WebLinkAbout820621.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 539 - KENNETH AND DOROTHY RASMUSSEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 539, being the property of Kenneth and Dorothy Rasmussen, described as part of the NWn, Section 17 , T5N, R66W of the 6th P.M. , Weld County, Colorado, being more particularly described in Exhibit "A" , attached hereto and incor- porated herein by reference, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the hereinabove described parcel of land owned by Kenneth and Dorothy Rasmussen be, and hereby is , exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicants providing for a reservation of seventy-five (75) feet right-of-way east of the centerline of 83rd Avenue in order to accomirodat.e future expressway expansion. March 17, 1982 COLORADO Board of County Commissioners Weld County Colorado 915 10th Street Centennial Building Greeley, Colorado 80631 Re: Recorded Exemption #539 Dear Commissioners: The attached application, plat and related items are in reference to a request from Kenneth and Dorothy Rasmussen for a recorded exemption. The parcel of land on which this request is being made is described as the NW-14, Section 17, T5N, R66W of the 6th P.M. , Weld County, Colorado. This property is located one and one-half (1.5) miles west of the city of Greeley, southeast of the intersection of 83rd Avenue and Weld County Road 58. The property contains approximately 154.6 acres, more or less. The request is to split the property into parcels of one (1) acre and one-hundred-fifty-three and six-tenths (153.6) acres, more or less. The applicants wish to remove the residential improvement adjacent to Weld County Road 27 from the farm operation in order to satisfy a County District Court decree. The applicants immediate plans are to continue farming the larger parcel (Lot "B") . Based on the submitted information and policies of the County, the Depart- ment of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2 C. of the Weld County Subdivision Regulation submission requirements. 2. The request complies with Section 9-2 E. of the Weld County Subdivision Regulations as follows - The 154,6 acres, more or less, under consideration will allow agricultural and related uses to be the predominant uses. The use will be compatible with existing and surround- ing agricultural uses. These facts also support the proposal as being consistent with the intent clause of the Agricul- tural District. The two parcels under consideration each have existing improvements; no reduction agricultural land use for production will occur. 820621 Board of County Commissioners March 17, 1982 Page 2 - The proposal was reviewed by the city of Greeley and was found to comply with the long-range comprehen- sive plan. It also is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan, therefore, the proposed use is not inconsistent with efficient and orderly develop- ments. - A letter from the State Highway Department dated March 1, 1982, indicated no objections to this proposal. - A letter from the Weld County Health Department indicates an adequate means for the disposal of sewage. - The city of Greeley provides water to this residence. - The proposal does not exist in an Overlay District Area. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The proposed lots meet the minimum size requirements for land division. The Department of Planning Services staff recommendation for approval is conditional based upon the following: 1. The applicants shall provide for a reservation of seventy-five (75) feet right-of-way east of the centerline of 83rd Avenue in order to accomodate future expressway expansion as requested by the Greeley Planning Commission.
