RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST BRUCE WALKER FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Bruce Walker, VI #9900151, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of May, 2000, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Bruce Walker was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against the individual as
hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Bruce Walker to remedy the violation of the Weld County
Zoning Ordinance, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 9th day of May, A.D., 2000.

May 4, 1999 Initial complaint received by Sharon Frazer, Previous Zoninc
Compliance Officer.
May 10, 1999 Initial inspection completed by Sharon Frazer. A
Noncommercial Junkyard consisting of derelict vehicles and
miscellaneous debris was found.
May 10, 1999 Five day compliance encouragement letter issued.
May 21, 1999 Mr. Walker called in to discuss concerns with the five day
letter. Sharon Frazer extended his case for 60 days .
May 25, 1999 Sixty day extension Zoning Violation Notice was maiLed.
July 23, 1999 Sharon Frazer completed a site inspection. She noted that
some of the preparations had been made however a fence had
not been completed yet. Miscellaneous debris and
approximately 5 derelict vehicles still on property.
July 26, 1999 Sharon Frazer sent a letter to Mr. Walker explaining that a
toning Violation had been s hed:.lcd fox August i_ 39 .
August 18, 1999 Mr. Walker called, an inspection revealed that Mr. Walker had
made substantial progress. The Violation hearing was
canceled.

January 25, 2000 A site inspection completed by, Vicki Brown, Previous Zoning
Compliance Officer, revealed that Mr. Walker indeed had cut
up a fence; however, he still had not placed all derelict
vehicle behind it.
January 26, 2000 Mr. Walker called and spoke with Vicki Brown. She extended
his case for another thirty days .
April 25, 2000 Bethany Salzman, current Zoning Compliance Officer, completed
a site inspection. The property does have a Noncommercial
Junkyard consisting of unscreened derelict vehicles, plies
of wood and metal, and various other miscellaneous debris .
April 28, 2000 Letter sent (certified) to the property owner, Mr. Bruce
Walker, indicating that the violation hearing was scheduled
before the Board of County Commissioners on May 9, 2000 at
10 : 00 a.m. .
This property is in violation of Section(s) 31. 3 and 31. 3 . 9 of the Weld County
Zoning Ordinance. To bring the property into compliance the property owner must
remove or screen the Noncommercial Junkyard from adjacent properties and public
rights-of-ways .
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties .

The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled
a meeting with the Board of County Commissioners on May 9, 2000, at 10:00 a.m., to consider the violations
occurring on the property. 31.3 "Accessory Uses in the A District" and 31.3.9 "Noncommercial Junkyard" In
order to bring the property into compliance the Noncommercial Junkyard consisting of piles of metal, derelict
vehicles, and other miscellaneous debris must be screened from adjacent properties and public rights-of-ways
or removed from the property. This meeting will take place in the County Commissioners' Hearing Room. First
Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call
me.
I will be at the property on May 8, 2000 to re-inspect and complete a video to provide at the Violation Hearing.

1/26/00 MR WALKER CALLED IN TODAY, HIS NEIGHBOR NOTIFIED
HIM AND ALSO GAVE HIM MY BUSINESS CARD. HE DID PHONE IN
TODAY. WE DISCUSSED THE FENCE, WHICH IS FINE, HOWEVER THE
OTHER 2 VEHICLES ARE PARKED OUTSIDE OF THE FENCE. ONE OF
THE VEHICLES DOES HAVE CURRENT TAGS, THE JEEP DOES NOT
BELONG TO HIM. HE WILL CALL THE OWNER THIS WEEKEND AND HAVE
IT REMOVED. ALSO ONE OF THE RV'S DOES NOT BELONG TO HIM. HE
WILL ALSO BE SURE THAT IS GONE FROM HIS PROPERTY. I WILL
GIVE MR WALKER AN EXTENSION. I WILL BE OUT TO THE PROPERTY
ON FEB. 17, 2000 TO RE-INSPECT. AT TIME IF THE PROPERTY IS
IN COMPLIANCE, I WILL CLOSE THIS VIOLATION.
