THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST
BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 21.4
of the Weld County Zoning Ordinance, as amended.
2. The submitted materials are in compliance with Section 21.5 of the Weld County Zoning
Ordinance, as amended as follows:
A. Section 21.5.1.1 - That the proposal is consistent with the Weld County
Comprehensive Plan. I. Goal 1 states"Encourage the expansion and diversification
of the industrial economic base,"and I. Goal 2 states "accommodate new industrial
development within planned industrial areas." The proposal is consistent with these
goals, as the site is located adjacent to other Industrial uses. The site will
encourage the"5 sion of the industrial economic base and provide for a variety
of employmyftt oppoftunities for Weld County citizens.
B. Sectio 21.5.1.2 -/he uses which would be allowed on the subject property by
granti the change of zone will be compatible with the surrounding land uses. The
Depart t of Planning Services believes that the granting of this change of zone
will have a minimal impact on the surrounding land uses. Surrounding land uses
include an Interstate Exchange, Commercial and Industrial uses and Agriculture.
A Site Plan Review will be required prior to any new uses that occur on the property.
The intent of the Site Plan Review is to "provide present and future residents and
users of land in the County a means whereby orderly and harmonious development
is ensured in the County. The Site Plan Review process requires additional
consideration to ensure that the uses permitted are established and operated in a

manner that is compatible with existing and planned land uses in the neighborhood.
Site Plan Reviews are designed to protect and promote the health, safety,
convenience,and general welfare of the present and future residents of the county."
Items addressed through the Site Plan Review include, but are not limited to,
number of employees, building construction, signage, landscape treatment,
drainage, parking, outside storage, loading/ service areas and environmental
criteria. The i Plan Review will ensure compatibility with surrounding land uses.
C. Section .5.1.3-A quate water and sewer service can be made available to the
site to se a the us s permitted within the proposed zone district. The applicant is
proposin well w er for site use and fire protection. The Weld County Department
/ of Public Heatt1 and Environment had no conflicts with the use of an Individual 7
Sewage Disposal System (I.S.D.S.) for the site. Referral agencies will have the
de opportunity to further address water and sewer during the Site Plan Review
application process.
D. Section 21.5.1.4 - Street or highway facilities providing access to the property are
adequate in size to meet the requirements of the proposed zone districts. The Weld
County Department of Public Works reviewed this request and deferred comment
regarding access to Colorado Department of Transportation(CDOT)and requested
to review any required site plan review. CDOT has agreed to grant access with the
location and design to be determined at a later date.
E. Section 21.5.1.5 - In those instances where the following characteristics are
- applicable to the rezoning request,the applicant has demonstrated compliance with
the applicable standards:
1) Section 21.5.1.5.1 - The proposed change of zone does not lie within the
Airport Overlay, Geological Hazard, Road Impact District or Flood Plain.
2) Section 21.5.1.5.2-The proposed rezoning does not contain the use of any
area known to contain a commercial mineral deposit in a manner which
would interfere with the present or future extraction of such deposit by an
extraction to any greater extent than under the present zoning of the
property.
3) Section 21.5.1.3 - Soil conditions on the site are not such that they present
moderate or severe limitations to the construction of structures of facilities
proposed for the site. Weld County Building Inspection's referral received
on August 18, 2000, indicated that building permits shall be obtained prior
to any excavation on site. A soils report and two sets of building and
engineered foundation plans(with registered Colorado Engineer stamp)are
required for all building permits. These issues are addressed through
conditions of approval and will also be a part of the Site Plan Review
process.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The Change of Zone from (A) Agricultural to C-3 (Commercial) is conditional upon the
following:
1. The change of zone plat map shall be submitted to the Department of Planning Services
for recording within 30 days of approval by the Board of County Commissioners.
2. Prior to recording the Change of Zone plat:
A. The following notes and information shall be delineated on the Change of Zone plat:
1) The Change of Zone allows for Commercial/Industrial uses which shall
comply with the C-3 Zone District requirements as set forth in Section 33.4
of the Weld County Zoning Ordinance. (Dept. of Planning Services)
2) Any signage located on the property shall require building permits and
adhere to Section 42.2 of the Weld County Zoning Ordinance. (Dept. of
Planning Services)
3) The site shall maintain compliance at all times with the requirements of the
Weld County Department of Public Works, Weld County Department of
Public Health and Environment, and Weld County Department of Planning
Services and Weld County Department of Building Inspection.
4) Any future structures or uses on site must obtain the appropriate zoning and
building permits.
5) If applicable, installation of utilities shall comply with Section 12 of the Weld
County Subdivision Ordinance. (Dept. of Planning Services)
6) The applicant shall adhere to all Site Plan Review requirements, as defined
in Section 23 of the Weld County Zoning Ordinance.
3. A Weld County septic permit is required for any proposed septic system. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(I.S.D.S.) regulations.

Your application and related materials for the request described above are being processed. I have scheduled
a meeting with the Weld County Planning Commission for September 19, 2000, at 1:30 p.m. This meeting
will take place in Room 210, Weld County Planning Department, 1555 N. 17th Avenue, Greeley, Colorado.,,
It is recommended that you and/or a representative be in attendance to answer any questions the Planning
Commission members may have.
A representative from the Department of Planning Services will be out to the property a minimum of ten days
prior to the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which
identifies the hearing time,date,and location. In the event the property is not adjacent to a publicly maintained
road right-of-way, one sign will be posted in the most prominent place on the property and a second sign
posted at the point at which the driveway(access drive) intersects a publicly maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the
Weld County Planning Commission. This recommendation will be available twenty-four(24)hours before the
scheduled hearing. It is the responsibility of the applicant to call the Department of Planning Services'office
before the Planning Commission hearing to make arrangements to obtain the recommendation.
