RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST HARRY GARTRELL FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Harry Gartrell, VI #9900307, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of May, 2000, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Harry Gartrell, property owner, was not present nor represented at said
hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until May 19, 2000, to allow adequate time for the property owner to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Harry Gartrell to remedy the violation of the Weld
County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until May 19, 2000, to
allow adequate time for the property owner to bring the subject property into compliance.

CASE SUMMARY
October 18, 1999 An inquiry was made via an other source regarding this
property. The individual stated that there was a
Noncommercial Junkyard consisting of various derelict
Vehicles on the property.
October 18, 1999 Vicki Brown, previous Zoning Compliance Officer,
completed a site inspection. She noticed several
derelict vehicles.
October 21, 1999 Five day compliance encouragement letter issued.
December 1, 1999 Thirty-day Zoning Violation Notice was sent giving an
extension for thirty days to Mr. Gatrell.
December 3, 1999 Mr. Gatrell called in. He was very upset stating that
he had just had a heart attack and this would take him
a little time. He stated that he would be putting an
engine in one of the cars and that his truck worked;
therefore, he would be getting plates for it shortly .
March 31, 2000 Bethany Salzman, current Zoning Compliance Officer,
completed a site inspection. The property does have a
Noncommercial Junkyard consisting of at least two or
more unscreened derelict vehicles.

April 28, 2000 Letter sent (certified) to the property owner, Mr.
Gatrell, indicating that the violation hearing was
scheduled before the Board of County Commissioners on
May 9, 2000 at 10 :00 a.m. .
Th're is a violation of Section of section(s) 31.3 and 31.3 .9 of the Weld County
Zoning Ordinance. To bring the property into compliance the property owner must
remove or screen all derelict vehicles from adjacent properties or public rights-
of-ways .
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

Upon a visual inspection of this property, the following pictures were taken (please see attached). Mr.
Gatrell now has four derelict vehicles instead of two. He has two cars on the North side (see pictures#1 &
#2), one car in front of his garage on the West side (picture#3), and one car in front of his house on the
South side (pictures#4 & #5). He also has a Pepsi machine that appears to be broken (picture #3), and
miscellaneous debris (picture#3). This case is scheduled to be heard by the Board of County
Commissioners at the violation hearings on May 9, 2000 @ 10:00 a.m..

Dear Mr. Gatrell:
The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled
a meeting with the Board of County Commissioners on May 9, 2000, at 10:00 a.m., to consider the violations
occurring on the property. 32.6 "The R-5 (Mobile Home Residential) District" and 40 "Supplementary District
Regulations"A Noncommercial Junkyard consisting of derelict vehicle(s) is not a Use by Right or an Accessory
Use in the R-5 District. In order for your property to come into compliance the Noncommercial Junkyard,
consisting of one or more derelict vehicle(s), must be removed or screened from adjacent properties and public
rights-of-ways per 32.2.3.6.and they must meet the guidelines established per Section 42-12-101 CRS(Colorado
Revised Statute). This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld
County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative
be in attendance to answer any questions the Board of County Commissioners might have about the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call
me.
I will be at the property on May 8, 2000 to re-inspect and complete a video to provide at the Violation_Hearing.

to and compatible with residential Uses Allowed by Right in the District.
32.2.2 Uses Allowed by Right in.the R-1 District No BUILDING, STRUCTURE or land shall
be USED, an no BUILDING or STRUCTURE shall hereafter be erected, structurally
altered, enlarged, or maintained in the R-1 District except for one (1)or more of the
following USES. Land in the R-1 District must be USED in compliance with the Bulk
Requirements contained in Section 32.7. USES within the R-1 District are subject
to the additional requirements contained in Section 40, Supplementary District
Regulations and Section 50, Overlay Districts.
32.2.2.1 One (1) SINGLE FAMILY DWELLING per LEGAL LOT, said SINGLE FAMILY
DWELLING shall be connected to and served by a PUBLIC WATER system and a
PUBLIC SEWER system. This requirement does not apply to any LEGAL LOT
created prior to the enactment date of this Ordinance.
32.2.2.2 PUBLIC parks and PUBLIC recreation areas.
32.2.2.3 PUBLIC SCHOOLS, and PUBLIC SCHOOL extension classes.
32.2.2.4 Police and fire stations or facilities.
32.2.2.5 UTILITY SERVICE FACILITIES.
322.3 Accessory Uses in the R-1 District. The following BUILDINGS, STRUCTURES, and
• USES shall be allowed in the R-1 District so long as they are clearly incidental and
ACCESSORY to the Uses Allowed by Right in the R-1 District. Such BUILDINGS,
STRUCTURES, and USES must be designed, constructed, and operated in
conformance with the Bulk Requirements contained in Section 32.7. ACCESSORY
USES within the R-1 District are also subject to the additional requirements
contained in Section 40, Supplementary District Regulations and Section 50, Overlay
Districts. Note: The comibined GROSS FLOOR AREA of all ACCESSORY
BUILDINGS constructed after the original effective date of this Ordinance (August
25, 1981) on LOTS in an approved or recorded subdivision plat or LOTS part of a
map or plan filed prior to adoption of any regulations controlling subdivisions of less
than ten (10) acres shall not exceed 4% (four percent) of the total lot area, except
in the Mixed Use Development Area (MUD), which shall adhere to MUD
development standards. However, in no case shall such an accessory building
exceed twice the GROSS FLOOR AREA of the primary residence on the lot except
by variance. Any accessory structure made non-conforming by application of this
subsection may be repaired, replaced or restored in total.
32.2.3.1 Garages, carports, and parking areas.
32.2.3.2 Swimming-pools, tennis courts and similar RECREATIONAL FACILITIES.
32.2.3.3 SIGNS, in accordance with the provisions of Section 42, Signs.
32.2.3.4 HOME OCCUPATIONS.
32.2.3.5 Service BUILDINGS and facilities.
32.2.3.6 Storage of those vehicles, or parts thereof, which are defined in Section 42-12-101,
CRS, as amended, and are SCREENED: and/or the storage of no more than two
vehicles which regardless of their condition and/or classification as DERELICT
VEHICLES, have been operated at any time during the past one year period in a
sanctioned or sponsored race, derby, or event and are SCREENED.
32.2.3.7 Any other STRUCTURE or USE clearly incidental and ACCESSORY to a Use
