HomeMy WebLinkAbout20001056.tiff RESOLUTION C;L RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #2669 -YONGGE VUE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rula Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Recorded Exemption #2669 was submitted by Yongge Vue, 1428 West 102nd Avenue, Denver, Colorado 80260, for property which is located in part of the SE1/4 of Section 24, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 23.324 acres and 10 acres, and WHEREAS, after reviewing the Planning staffs concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan as required by Section 11.5.1.1 of the Weld County Subdivision Ordinance. 2. The Board feels this division would be inconsistent with efficient and orderly development as required by Section 11.5.1.4 of the Weld County Subdivision Ordinance. 3. The Board feels this proposal is not consistent with the Recorded Exemption standards as set forth in Section 11.8 of the Subdivision Ordinance as required by Section 11.5.1.5 of the Subdivision Ordinance. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance, as follows A. Section 11.4.2.1 - Conformance with the Weld County Comprehensive Plan Urban Growth Boundary Goals and Policies and any approved intergovernmental agreement(s) when the recorded exemption application is located within a specified intergovernmental boundary area(s). 1) Comprehensive Plan A.Goal 4. - Provide a mechanism for the division of land which is agriculturally zoned. The intent of this goal should be to maintain and enhance the highest level of agricultural productivity in Weld County. Mr. Vue purchased a 151-acre farm. He then requested a fee split determination along the Bull Canal. Planning Staff did determine that Mr. Vue has 2 legal parcels. Subsequently, on July 6, 1998, Mr. Vue applied for a Recorded Exemption on the north side of Bull Canal. On October 12, 1998 the Weld County Board of County Commissioners approved Recorded Exemption 2300. If approved, this recorded exemption will create the 4th lot owned by Mr. Vue in the quarter section. At no time in this process has the agricultural productivity of the site been taken .nto consideration. 2) Comprehensive Plan A.Goal 9. - The minimum lot size of parcels in the Agricultural zone district should remain at 80 acres to encourage parcels large enough to retain viable farming operations or to accommodate modern agricultural equipment and irrigation practices. Lots of lesser size are not generally practical to farm due to large scale management practices existing today. Mr. Vue purchased a 151-acre farm. If this application is approved the 151 acres will be split into 10, 23.3, 34.9 and 78.5 acre parcels. Even the 78.5 acre lot has been split by an access road, creating smaller parcels. None of these lots are viable farms according to A.Goal 9. B. Section 11.4.2.4- Consistency with the purpose of efficient and orderly development as expressed in Section 1.3 of the Weld County Subdivision Ordinance. 6,7000- /O5e, 1) Section 1.3.1 -Assisting orderly and integrated development. On October 12, 1998 the Weld County Board of County Commissioners approved Recorded Exemption 2300 for Mr. Vue directly north of this site. Lot A of RE-2300 was created for Mr. Vue's brother in law, Yia Lo, who had 1/3 ownership in the property. The Board of County Commissioners approved this lot after hearing testimony regarding Mr. Lo's wish to obtain this property. Since that time Mr. Vue has obtained sole ownership of both Lot A and Lot B and no home has been built. This lot was created to fit a special circumstance that did not come to pass. 2) Section 1.3.10-Preserving agricultural land and promoting its most productive agrarian use. The site is designated as "Prime if it becomes irrigated". Planning Staff concurs that no consideration has been given to the effect the accumulation of these smaller lots has on the agricultural productivity of the property. 3) Section 1.3.16-Preventing loss and injury from land slides, mud flows, and other geologic hazards The entire property is classified as a Low Geological Hazard area. C. Section 11.4.2.5- Compliance with the recorded exemption standards set forth in Section 11.8 of the Weld County Subdivision Ordinance. 1) Section 11.8.10- The proposed recorded exemption does not evade the statement of purpose as set forth in Section 1.3 of this Ordinance. The lots, past and currently proposed, on the quarter section cannot be considered orderly and integrated development. A more appropriate application for this amount of lots would be a minor subdivision or a Planned Unit Development. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached:. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: A. Lot A and Lot B shall be granted one shared residential/agricultural access point from Weld County Road 13 No circle drives or additional accesses shall be granted. Access will be placed in such a location as to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. This access shall be a minimum of 75 feet from any intersecting County or State roadways. B. Lot B shall utilize the existing oil and gas/ditch road access points necessary for agricultural operations. No circle drives or additional accesses shall be granted. C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved access point. If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert, please contact the Department of Public Works to adequately size the culvert. D. Weld County Road 6 is designated on the Transportation Plan Map as a collector status road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 40 feet from the centerline of Weld County Road 6 shall be delineated on the plat as right-of-way reservation for future expansion of Weld County Road 6. This road is maintained by Weld County. E. Weld County Road 13 is designated on the Southwest Study Area Capacity Improvement Needs as a paved rural road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 13 shall be delineated on the plat. This road is maintained by Weld County. F. The applicant shall attempt to address the requirements of the Mountain View Fire Protection District as stated in a referral response received January 25, 2000. C. The applicant shall provide the Weld County Department of Planning Services with a certificate from the County Treasurer showing no delinquent taxes for the original parcel (mother parcel)area. H. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Zoning Ordinance, the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits for any structure exceeding 3,600 square feet, the applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code, as recommended by the Mountain View Fire District. 4) Prior to the release of building permits the applicant shall submit evidence to the Department of Planning Services that Lot A and Lot B have an adequate water supply of sufficient quality, quantity and dependability. 5) RIGHT TO FARM COVENANT Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 6) Prior to the release of building permits, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. The legal description on such deed shall include the lot and Recorded Exemption number. 7) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169k 8) Effective December 1, 1999, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Southwest Weld Road Impact Program area 3. (Ordinance 211) 9) All construction or improvements occurring in a geological hazard area as delineated by the Colorado Geological Survey shall comply with Overlay District requirements of Section 27 of the Weld County Zoning Ordinance. 3. The applicant shall submit a mylar plat to the Weld County Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. The 33 acre parcel is north of and adjacent to Weld County Road 6 and west of and adjacent to Weld County Road 13. Although the site is outside of the Ordinance 201 Intergovernmental Agreement area, Dacono has annexed land within '/2 of a mile of this property. Planning staff maintains the number and configuration of the lots being created by Mr. Vue in the quarter section are not consistent with efficient and orderly development and are an evasion of Section 1.3 of the Subdivision Ordinance. For this reason we are requesting the case be reviewed by the Board of County Commissioners. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. In instances when a request is for a recorded exemption and not a subdivision, water supply for fire protection is not required for a single family residence that is not larger than 3,600 gross square feet and is placed on at least a 2.5 acre site. If a residence exceeds 3,600 gross square feet or is placed on less than 2.5 acres,water supply for fire protection requirements apply. • When water supply for fire protection is required, a minimum fire flow of 1,000 gallons of water per minute, measured at a residual pressure of 20 pounds per square inch (p.s.i.), is required for one- and two-family dwellings not exceeding 3,600 gross square. All other buildings (including larger one- and two-family dwellings) require a minimum fire flow of 1,750 gallons of water per minute, measured at a residual pressure of 20 pounds per square inch (p.s.i.) and may require more depending on the building size and type of construction as per Appendix III-A of the Uniform Fire Code. Water supply must be provided by hydrants located within 650 feet of the residence as measured along the fire apparatus access road and around the exterior of the residence. If the required fire flow is not available, the installation of a residential fire sprinkler system will be accepted as an alternative to meeting the required fire flow. • If a residential fire sprinkler system is proposed, the plans for the fire sprinkler system must be submitted to the Fire District for review and approval prior to installation. At least two copies of plans must be submitted for review. Submittals must include specifications on all devices to be installed and the State plans registration form. Fire apparatus roads shall be extended so fire apparatus may reach to within 150 feet of all portions of the building. Apparatus access roads shall be a minimum of 20 feet in width and be designed and maintained to support the imposed loads of fire apparatus (60,000 pounds). When residential sprinkler systems are installed, the minimum required road width is reduced to 14 feet. Roads must have a surface that provides all-weather driving capabilities. Roads in excess of 150 feet in length must be provided with approved provisions for the turning around of fire apparatus. The minimum turning radii for all turns shall be thirty-five (35) feet inside turning radius and forty-eight(48) feet outside turning radius. • A final site plan for a residence must be provided to the Fire District for review and approval prior to the issuance of any building permit in order to assure compliance with the above requirements.
