RE: APPROVAL OF RECORDED EXEMPTION #2697 - RICHARD AND LINDA METTLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat
known as Recorded Exemption #2697, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #2697 was submitted by Richard and
Linda Mettler, 24245 Highway 52, Hudson, Colorado 80642, for property which is located in part
of the W1/2 NE1/4 SW1/4 and E1/2 NW1/4 SW1/4 of Section 6, Township 1 North, Range 64
West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat
which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 36 acres and 2.5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2697 by Richard
and Linda Mettler is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic
system shall be installed according to the Weld County Individual Sewage
Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The applicant shall submit the appropriate zoning and building permit
applications and pay the appropriate fees to the Department of Planning
Services for the mobile home and storage structure located on Lot B.
B. Submit evidence to the Department of Planning Services that any existing
septic system(s) meets all requirements of the Weld County Department
of Public Health and Environment. The Environmental Protection
Services Division of the Weld County Department of Public Health and
Environment was unable to locate a septic permit for the septic system of
the unoccupied trailer located at 24245 Highway 52, Hudson, Colorado
80642. Any existing septic system(s) which is not currently permitted
through the Weld County Department of Public Health and Environment
will require an I.S.D.S. evaluation prior to the issuance of the required

septic permit(s). In the event the system(s) is found to be inadequate,
the system(s) must be brought into compliance with current I.S.D.S.
regulations.
C. A 30-foot wide joint access easement extending across Lot A via the
access from State Highway 52, for the benefit of both Lots A and B, shall
be clearly shown on the plat. The joint access easement shall be
dedicated for the use as shown utilizing the language set forth in
Section 11.7.1.12.5 of the Weld County Subdivision Ordinance.
D. Lots A and B shall utilize the existing access from State Highway 52 on a
Weld County road right-of-way (not County maintained) which was
deeded to Weld County by deed recorded in the Office of the Weld
County Clerk and Recorder on June 19, 1951, at Book 1305, Page 458.
No circle drives or additional accesses shall be granted. These roads will
be graded and drained to provide all weather access.
E. The applicant shall attempt to address the requirements of the Army
Corps of Engineers as stated in a referral response received March 15,
2000.
F. The applicant shall provide evidence to the Department of Planning
Services that an access permit from the Colorado Department of
Transportation has been granted for access to Highway 52 or evidence
that the applicant has complied with the requirements of the Colorado
Department of Transportation.
G. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property
is located. Pursuant to the definition of setback in the Weld
County Zoning Ordinance, the required setback is measured from
the future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate
zoning and building permits.
3) All construction or improvements occurring in the flood plain as

4) The installation of any septic system within the One Hundred Year
Flood Plain shall comply with the Weld County I.S.D.S. Flood
Plain Policy. In accordance with the Colorado I.S.D.S.
Regulations, no septic systems shall be installed within the
floodway.
5) All mobile homes as accessory farm uses are temporary.
Allowance of the mobile homes shall be extended only if the use
continues to be in conformance with the criteria set out in
Section 43.2.3.1.1 of the Weld County Zoning Ordinance. The
mobile homes shall be removed from the property upon the
cessation of the use of the mobile home as an accessory farm
use or at any such time as the mobile home is used for other than
the allowed use.
6) Prior to the release of building permits the applicant shall submit
evidence to the Department of Planning Services that the lot has
an adequate water supply of sufficient quality, quantity and
dependability.
7) Right to Farm Covenant as stated on Page 7-1 of the Weld
County Comprehensive Plan, effective March 25, 2000.
8) Prior to the release of building permits on Lots A or B, the
applicant shall submit a recorded deed describing the lot upon
which the building permit is requested with the building permit
application. The legal description on such deed shall include the
lot and Recorded Exemption number.
9) Should noxious weeds exist on the property or become
established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Ordinance #169-A.
10) The plat shall show and denote a future right-of-way reservation
for State Highway 52, being 75 feet from the centerline of said
highway.
3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall
be prepared in accordance with the requirements of Section 11.7 of the Weld
County Subdivision Ordinance. The plat shall be submitted within sixty (60) days
from the date of approval by the Board Of County Commissioners. The applicant
shall be responsible for paying the recording fees.

1) Section 11.8.3 -An adequate legal access exists for all proposed lots to a public roae. All acce.i,us
shall be in accordance with Section 3 of the "Weld County Public Works Policies", Ordinar or No. I r 0.
as amended.
The applicant has a legal point of ingress and egress to the property via a (lac I::t thn is
located along the east property line off of State Highway 52. The width of the flag let is t rty
(30) feet wide. This access will be required to be improved to provide all weather drai tai le and I
adequate sight distance in both directions.
Should the Board of County Commissioners approve this request, the Department of Planning Services' staff
recommends the following conditions be attached:
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed ic;ordii it to
the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The applicant shall submit the appropriate zoning and building permit applications and pay the app opriate has

Weld County is one of the most productive agricultural counties in the United States. Thr' r..ral a it-as
of Weld County may be open and spacious. but they are intensively used for agriculture Per:ns
moving into a rural area must recognize there are drawbacks, including conflicts with 'nngstard ng
agricultural practices and a lower level of services than in town.
Agricultural users of the land should not be expected to change their long-established agricu t, ral
practices to accommodate the intrusions of urban users into a rural area. Well run agricultual acti ryes
will generate off-site impacts, including noise from tractors and equipment; dust from animal wens, 'i plc!
work, harvest, and gravel roads; odor from animal confinement, silage, and manure. smoke from _ilch
burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the u ;c of
aerial spraying. Ditches and reservoirs cannot simply be moved out of the way or •esidf" ial
development without threatening the efficient delivery of irrigation to fields which is essen'ial to to rm
production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of De aware) o th
more than 3,700 miles of state and county roads outside of municipalities. The sheer mag :,de o hie
area to be served stretches available resources. Law enforcement is based on responses to
complaints more than on patrols of the county and the distances which must be traveled ran deft} all
emergency responses, including law enforcement, ambulance, and fire. Fire protectie r s us is fly
provided by volunteers who must leave their jobs and families to respond to emergencies. Co i ty
gravel roads, no matter how often they are bladed, will not provide the same kind of sulfa::e expe_t ed
from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may nc �e
cleared for several days after a major snowstorm. Snow removal for roads within subdiv siuns a n o'
the lowest priority for public works or [nay be the private responsibility of the homeowne s. Sera
in rural areas, in many cases, will not be equivalent to municipal services.
Children are exposed to different hazards in the county than in an urban or suburban setting. F o m

Dear Commissioners:
Richard & Linda Mettler have requested a Recorded Exemption to occur on part of the W2 of the
NE4 of the SW4 and part of the E2 of the NW4 of the SW4 Section 6, Township 1 North, Range '5 =
West of the 6TH P.M. The 38 acre parcel is north of and adjacent to State Highway 52,
approximately two miles east of the town of Hudson. There is one existing home, and one
unoccupied trailer located on proposed Lot B. The parcel of land under consideration is the total
contiguous land holdings of the applicant.
Based upon the submitted information, referral agencies, and the governing mechanism of the
Weld County, the Department of Planning Services' staff has concerns regarding this request.
The applicant is requesting to divide this 38 acre parcel into two parcels. Lot A at 2 acres and Lot
B at 36 acres of land more or less. Planning staff has found that the application is not in
compliance with Section 11.4.2.4 as expressed in Section 1.3 of the Weld County Subdivision
Ordinance. For this reason we are requesting the case be reviewed by the Board of County
Commissioners.
Section 1.3.1 of the Subdivision Ordinance states as a Statement of Purpose: "Assisting orderly
and integrated development". In the view of the Department of Planning Services, this Recordec
Exemption application does not meet these standards. Approval of this Recorded Exemption wo.ilcl
create a "flag-lot" on Lot A. Access to this "flag-lot" would require an easement which runs throu;ih
three separate property owners parcels. In addition this "flag-lot" would access off of State
Highway 52. Lot B also lies within a 100-year flood plain. Potential impacts to the septic system
capabilities could not be ignored by Planning Staff. The system will have to comply with I.S D.S
standards.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider the application and determine if the standards of Sections 11.2 through 11.8 of the Well:
County Subdivision Ordinance have been met and adhere to the goals and policies of the Weld
County Comprehensive Plan.
For this reason we are recommending denial and requesting that the case be reviewed by the
Board Of County Commissioners

I spoke with Linda Mettler at 9:20 a.m. on March 29, 2000. The conversation concerned the
accesses which enter her property. Ms. Mettler stated that the reason they don't use their
easement along the east side of property is because the previous owners had used
Gustafson/Patterson access and it was never a problem for them. Apparently, there is some kind
of verbal agreement between Patterson/Gustafson and the Mettlers. When I asked her if they
knew of her intentions of doing an RE, she stated that Patterson did, but Gustafson did not.
then told her she should notify them. Ms. Mettler said the east-side easement would need h
have dirt brought in to fill it to County standards.

To Whom It May Concern:
I am writing to ask for another extension for filing required paperwork to your
department on the above referenced Recorded Exemption. We have been unsuccessful in
getting Alpha Engineering to move in a timely manner and provide us with the survey
paperwork.
The planner we were assigned was Kenneth Baumbach. It is my understanding that he is
no longer with your department and the office technician did not know whom our file
was transferred to. She transferred me to the planner on call's voice mail and 1 left a
message yesterday asking what I needed to do to obtain the extension. I did not receive a
call back as I have in the past when I had questions so I called again today. The office
technician explained to me that your office was swamped yesterday so she transferred me
to Julie Chester's voice mail to leave a message regarding the extension. I have not
received a call back so I faxing this request to your office. I can be reached at my work
number 303-724-5064 Monday through Friday 7AM—3:30 PM and at my home number
303-536-4347 after 4:30 PM or you can leave a message on my home recorder.

2. The Permittee shall refer to all additional standard requirements included with this permit and any enclosed
ad
ditional terms, conditions, exhibits, and noted attachments.
3. Incorporated as part of this permit are the following:
Application for Access Permit(CDOT Form No. 137)
Permit (CDOT Form No. 101) and its two page attachment
Exhibits: "A" - Access Plan
"B" - Vicinity Map
"C" - Site Plan
4. This permit is issued in accordance with the State Highway Access Code (2 CCR 601-I), and is based upon the
information submitted by the Permittee. This permit is only for the use and purpose stated in the Application
and Permit. Any changes in traffic volumes or type, drainage, or other operation aspects may render this
permit void, requiring a new permit to the be applied for based upon exisiting and anticipated future
conditions.
5. Access construction methods and materials shall conform to the Colorado Department of Transportation
Standard Specifications for Road and Bridge Construction (current edition).
6. If necessary, minor changes, corrections and/or additions to this permit may be ordered by the Department
inspector, other Department representative or local authority to meet unanticipated site conditions. Changes
may not be in violation of the State Highway Access Code. All major changes to the plans must be approved
in writing by the Department prior to commencement of any work on or within the State Highway
right-of-way.
7. This permit is subject to revocation due to: 1)Noncompliance with the provisions of this permit; 2)
Abandonment; 3) Supersedure by new permit covering the same installation; or 4) Conflict with necessary
planned highway construction and/or improvements. The Permittee shall promptly terminate occupancy upon
notice of cancellation of the permit from the Department, unless a new permit is applied for and granted.
8. Reconstruction and improvements to the access may be required when the Permittee has failed to meet the
required design and/or material specifications. If any construction element fails within two years due to
improper construction or material specifications, the Permittee is responsible for all such reparis.
9. The Department retains the right to perform any necessary maintenance work in this area.
10. Backing maneuvers within and into the State Highway right-of-way are strictly prohibited. All vehicles shall
enter and exist the highway right-of-way in forward movement. Backing into the right-of-way shall be
considered a violation of the terms and conditions of this access permit and may result in revocation of the
permit by the Department and/or the issuing authority.
11. Routine, periodic maintenance and emergency repairs may be performed within the State Highway
right-of-way, under the general terms and conditions of the permit. Any significant repairs such as culvert
replacement,resurfacing, or changes in design or specifications, will require written authorization from the
Department. The Department shall be given proper advance notice whenever maintenance work will affect the
movement or safety of traffic on the State Highway. In an emergency, the Department Region Office and the
State Patrol shall immediately be notified of possible hazards.
12. All work is to conform to the plans referenced by this permit on file with the Department or as modified by this
State Highway Access Pe, • Page 2

permit. (If discrepancies arise, this permit shall take precedence over the plans.) The Department plan review
is only for the general conformance with the Department's design and code requirements. The Department is
not responsible for the accuracy and adequacy of the design, dimensions, elevations, and any other elements
which shall be confirmed and correlated at the work site. The Department through the approval of this
document, assumes no responsibility for the completeness and/or accuracy of the plans.
• 13. The access shall be maintained 20 feet wide with 20 foot radii.
14. Surfacing of the access shall consist of 6 inches ABC Class 6.
15. The access shall be maintained in a manner that will not cause water to enter onto the roadway, and will not
interfere with the existing drainage system within the State Highway right-of-way. Drainage to the State
Highway right-of-way shall not exceed historical rate of flow.
16. A fully executed complete copy of this permit must be on the job site with the contractor at all times during
construction. Failure to comply with this or any other construction requirement may result in the immediate
suspension of work by order of the Department inspector or the issuing authority.

17. The design and construction of access and/or development of this property shall not negatively impact adjacent
nearby properties. Correction of the problem and cost resulting from damages shall be borne by the Permittee.

COLORADO SUBJECT: I.S.D.S. Flood Plain Policy
Septic systems will not be allowed to be located in the floodway.
Septic systems will be allowed in the flood plain, but the system must be installed in a manner
as to prevent the infiltration of groundwater into the septic tank and to prevent the release cf
sewage from the tank during a flood event.
If the tank is above the flood plain elevation, no special installation requirements would he
necessary.
If the tank is not above the flood plain elevation then the access to the tank manhole lids must
be covered with 20 mil PVC and sealed with•plumbers cement. When the seal is broker. i e
the tank is opened for pumping, etc., the tank must be re-sealed prior to backfilling again. A
backflow preventer or one-way valve, must also be installed in the effluent line between the
tank and the absorption field.
All other percolation and suitable soil criteria must be met for a conventional septic system to be
installed.
For inspection purposes, the materials to seal the manhole lids must be on site. The manholes
are not required to be sealed at the time of inspection in order to allow for the inspection ot tcc's
in the tank.
