ANNEXATION PETITION
TO THE MAYOR AND BOARD OF TRUSTEES OF THE TOWN OF KEENESBURG,
COLORADO:
The undersigned, in accordance with Title 31, Article 12,
Chapters 101 et.seq. , Colorado Revised Statutes, hereby petition
the Board of Trustees of the Town of Keenesburg for annexation into
the Town of Keenesburg the territory described herein and described
and shown on the map designated " SIB Addition Annexation " .
Four (4) copies of said map are submitted herewith and by this
reference are incorporated herein. The description of the
territory hereby petitioned for annexation into the Town is set
forth in Rrhibit "A" attached hereto and incorporated herein by
reference (Exhibit "A" must be an original printed proeprty
description on 8 1/2 X 11 white paper) .
In support of this petition, the petitioner(s) allege (s) that:
1. It is desirable and necessary that the above-described
territory be annexed to the Town of :Keenesburg.
2 . The requirements of Section 31-12-104 and 31-12-105 of
the Colorado Revised Statutes exist or have been met in that:
A. Not less than one-sixth 91/6) of the perimeter cf the
area proposed to be annexed is contiguous with the Town of
Keenesburg.
B. A community of interest exists between the territory
proposed to be annexed and the Town of Keenesburg.
C. The territory sought to be annexed is .urban or will be
urbanized in the near future.
D. The territory sought to be annexed is integrated or is
capable of being integrated with the Town of Keenesburg.
3 . In establishing the boundaries of the territory proposed
to be annexed, no land held in identical ownership, whether
consisting of one tract or parcel of real estate or two or more
contiguous tracts or parcels of real estate, has/have been divided
into separate parts or parcels of real estate without the written
consent of the land owner or land owners thereof, except and unless
where such tracts or parcels are already separated by a dedicated
street, road, or other public way.
4 . In. establishing the boundaries of the territory proposed
to be annexed, no land held in identical.-ownership, whether
consisting of one tract or parcel of real estate or two or more
contiguous tracts or parcels of real estate comprising twenty (20)
acres or more which, together with the buildings and improvements-
situated thereon have an assessed valuation in excess of $200, 00.0
for ad valorem tax purposes for the year next preceding the filing
of the written petition for annexation, has/have been included
within the territory proposed to be annexed without the written
consent of the land owner or land owners.
5 . The territory proposed to be annexed dos not include any
area which is the same or substantially the same area in which an
election for an annexation to the Town of Keenesburg was held
within the twelve months preceding the filing of this petition.
6 . The territory proposed to be annexed does not include any
area included in another annexation proceeding involving a town
other than the Town of Keenesburg.
7 . The territory proposed to be annexed is not presently a
part of any incorporated town, town and county, or town.
8 . The property owned by each petitioner is described on
each separate signature sheet and, when needed, described more
fully in the exhibits attached hereto and incorporated herein by
reference.
9 . The signer(s) of this petition comprises (s) more than
fifty percent (50%) of the land owners and owning more than fifty
percent (50%) of the property, excluding public streets and alleys,
and any land owned by the annexing municipality, and are, in fact,
owners of one hundred percent (100%) of the property set forth. in
Exhibit "A" attached hereto and incorporated herein by reference.
Accompanying this petition are the original and four copies of
an annexation plat map containing the following information:
A. A written legal description of the boundaries of the area
proposed. to be annexed.
B. A map showing the boundary of the area proposed to be
annexed.
C. Within the annexation boundary map, an identification of
the location of each ownership tract in =platted land and, if part
or all of the area is platted, the boundaries and the plat numbers
of plots or of lots and blocks. Also within the boundary map,
identification of any special districts the area proposed to be
annexed may be part of.
D. Next to the boundary of the area proposed to be annexed,
a drawing of the contiguous boundary of the annexing municipality
and the contiguous boundary of any other municipality abutting the
area proposed to be annexed.
E. A surveyor's certificate prepared by a registered land
surveyor that attests to the preparation of the map and certifies
at least one-sixth (1/6) contiguity to the Town of Keenesburg.. "
F. Acceptance block describing the acceptance action of Town
of Keenesburg and providing for the effective date and Town Clerk
and Mayor attest signatures.
10 . Except as otherwise provided, no part of the territory
sought to be annexed is more than three miles from a point on the
municipal boundary, as such was established more than one year
before this annexation will become effective.
THEREFORE, the undersigned respectfully petition the Board of
Trustees of the Town of Keenesburg to annex the territory described
and refereed to in Exhibit "A" to the Town of Keenesburg in
accordance with and pursuant to the statutes of the State of
Colorado.

IMPACT REPORT OF THE SJB ANNEXATION
The proposed annexation is known as the SJB Addition
Annexation to the Town of Keenesburg and involves the annexation of
approximately 82 acres of property as described in the attached
property description.
The following information is provided with this report :
A. A preliminary master plan of the property to be annexed
showing major proposed streets and existing streets and roads
adjacent to the property.
B. A vicinity map showing the proposed annexation ' s
proximity to the existing Town of Keenesburg.
C. Water service will be connected to the Town of Keenesburg
central water system. Although not shown on the enclosed map, the
sewer lines and water lines will lie within the street right-of
way.
D. The existing land use is agricultural although the
property is primarily unused. The enclosed map designated as map
"C" sets forth the proposed land uses .
E. Subsequent to annexation, the area will receive such
other services as are normally provided to residents of the Town cf
Keenesburg.
F . No draft of a pre-annexation agreement is available at
the time of this report .
G. The property owners will construct all water and sewer
extensions, streets and other infrastructure improvements, and no
financing of such improvements will be done by the Town of
Keenesburg.
H. The districts which exercise control over the property •:o

Dear Mr. Hansen:
On behalf of Weld County School District Res-3J, this letter is submitted pea your
request outlining the anticipated effects of the proposed American Builders development.
The above referenced development is proposed for 48 multifamily housing units to be
annexed into the Town of Keencsburg along with other nonresidential uses. This letter
first summarizes the implications for school facilities. Second, it addresses the district's
ability to aceommodate such an inlux of students, both financially and physically.
The subject land development proposes 48 multifamily housing units in three
buildings of 16 units each. Based upon estimated student generation rates, this level of
attivrty, at build out, would generate about 12 new students to be accommodated within
district facilities(see attached Table 1 for°dculations):

This level of student generation results in the need for less than one-half acre of land
accessary to support the school facilities respired to serve then students.

The proposed development will generate the proportionate demand for about 0.42
acres of land to support the facility space required to house the students anticipated. This
amount of land is not feasible for dedication purposes. Consequently, a cash-in-lieu of
land dedication payment is requested at the equivalent of fully improved dedicated land. It

is estimated that this value would approximate $12,640, or $263 per unit. It is suggested
that this payment be made prior to recordation of the final plat for the multifamily units
Facility and Fiscal Capacity Issues
Current facilities that would serve this development are Keenesburg Elementary and
Weld Central Junior/Senior High. Capacities (following construction of the new
elementary in Keenesburg and the funded expansion to the junior-senior high) and
enrollments a!'these schools are:

With opening of the new elementary funded for Keenesburg, capacity at this school level
will be adequate for a few years. The remaining elementary school in Hudson is also at
capacity and will not provide sufficient seating capacity to act as a meaningful overflow
facility. A third elementary school is to be constructed in Lochbuie that rnav assist with
alleviating certain space shortages over the next few years in that area. Considering the
distance to this facility, it will not provide meaningfi.il facility space assistance fill- the
Keenesburg area. Even after construction of the funded addition to Weld Central,
capacity will still he inadequate at this school level. Two portable classroom units (four
classrooms) were added to Weld Central in the 199E-99 school year and certain of the
portables at the existing elementary school will be relocated to this facility to assist with
the seat shortages
At present, district bonding capacity approximates $19.0 million, or 20 percent of
assessed valuation per state statute. The November 1999 bond election included S16.9
million for [facility needs throughout the district Combined with prior debt, this leaves
about $2 million of'bonding capacity to provide space fnr additional new growth. Even if'
the district received voter approval to issue additional debt, the available funding would
fall short of providing the facility space needed to supply seats for students the district will
be required to serve from other already approved residential developments. This, along
with the two-year lag in receiving property tax revenues from new construction,
substantially compounds the district's ability to adequately provide capacity for students.
These fiscal constraints substantially limit the potential to provide needed educational
facilities. Unless school construction is enabled by some mechanism(s), certain interim
capacity enhancing measures will be required above and beyond addition of portable
classrooms. Many of these mechanisms are not well accepted by the district or its
constituents.

deducting for future taxes that will be paid to the district for current bond redemption
payments, the net unmet.cost per unit will approximate $1,410 per unit. It is requested
that this per unit bum be paid by the development to mitigate the excess facility costs
attributable to these housing units. Payment at building permit or certificate of occupancy
would be acceptable.
Recommendations
The school district remains very concerned about the recent trend toward
accelerated residential activity throughout the district and the ensuing enrollment that will
follow as well as the district's physical and financial ability to serve that growth. Approval
of additional residential development without a ready and identified means of providing
appropriate infrastructure would not demonstrate good stewardship of the public trust.
It is requested that the proposed project mitigate land dedication requirements as
well as the unmet capital costs that will be experienced in the amounts specified above
Further, the school district will recommend that the Town Board require such mitigation
as a condition of project approval. Without such mitigation, the district will recommend

A RESOLUTION FINDING THAT THE PETITION FOR ANNEXATION OF
THE SJB ADDITION ANNEXATION IS IN SUBSTANTIAL COMPLIANCE
WITH C.R. S . 31-12-107 (1) AND SETTING A DATE FOR A HEARING
BEFORE THE BOARD OF TRUSTEES OF THE TOWN OF KEENESBURG TO
CONSIDER ANNEXATION OF THE AREA PROPOSED TO BE ANNEXED.
WHEREAS, the owners of 100% of the property known as the SJB
ADDITION ANNEXATION have filed a Petition for Annexation of the
hereinafter described property to the Town of Keenesburg, anc ;
WHEREAS, the Board of Trustees has determined that the
Petition is in substantial compliance with C.R. S . 31-12-107 (1) and
that a hearing on such annexation should be scheduled as provided
by Colorado law.
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF KEENESBURG, COLORADO AS FOLLOWS :
Section 1 . The Board of Trustees hereby accepts the above
described petition for annexation and finds and determines that the
petition for annexation of the property described as the SJB
ADDITION ANNEXATION and as described i,n Exhibit "A" attached hereto
is in substantial compliance with the requirements of C.R. S . 3.-12-
107 (1) and Section 30 of Article II of the Colorado Constitution
and desires to initiate annexation proceedings in accordance with
law.
Section 2 . The Board of Trustees will conduct: a public
hearing on the 18th day of September, 2000, at the hour of 7 : 00
p.m. at the Town Hall, Town of Keenesburg, 140 S . Main, Keenesburg,
Weld County, Colorado for the purpose of determining whether the
area proposed to be annexed meets the applicable requirements of
C.R. S . 31-12-104 and 105, and to determine whether the area should
be annexed to the Town of Keenesburg .
Section 3 . The Town Clerk is hereby directed to pu:Dlash
notice of this hearing once each week for five weeks in the The
