Dear Mr. Booth:
The Weld County Department of Public Health and Environment(WCDPHE) has reviewed your
January 7, 2000, letter concerning pumping capacity at the Booth Feedlot. Your letter was
submitted in response to my December 8, 1999 letter.
Based upon the pump capacities discussed in your letter, it appears the facility has adequate
capacity to de-water its lagoons in accordance with the Confined Animal Feeding Operation
Control Regulations. Therefore, we consider this matter to be closed.
The County appreciates your cooperation and timely response to this matter. Again, we
encourage you to work cooperatively with your neighbors. Should you have any questions, or if I

Dear Mr. Booth:
The Weld County Department of Public Health and Environment (WCDPHE) has reviewed the
Manure & Wastewater Management Plan(the Plan) for the Booth Feedlot. The Plan was
submitted under a cover letter dated October 25, 1999.
Based upon our review it appears that the Plan substantially complies with the Confined Animal
Feeding Operation Control Regulations (CAFO Regulations) and the standards found in Section
47 of the Weld County Zoning Ordinance. As a result, the WCDPHE approves the Plan with the
following conditions:
1) The facility shall maintain an on-site rain gauge, or other similar instrument, in order to
monitor rainfall events that occur at the facility. Records of any precipitation event that
occurs at the facility shall be maintained on the facility.
2) The facility shall maintain all collection and diversion structures. Specifically, those
structures that are located just west of the facility's western-most pens.
3) The facility shall provide the electrical and pumping capability as described in your
October 25, 1999 letter and in Derald Lang's November 24, 1999 letter.
We will consider this matter to be closed once the facility is equipped with the additional
pumping capacity. Please provide me a schedule, in writing, within the next 30 days,that
outlines the time frame that the additional pumping capacity will be installed.
Additionally, I have discussed the Plan with Mr. Larry Vetter. As you are aware, Mr. Vetter
owns the property immediately west of the facility. Mr. Vetter would like to see the diversion

ditch improved. More specifically, he would like to see the height of the outside berm increased
to ensure that storm water is captured and transported into the lagoons. As you know, if the
diversion ditch were to fail, the wastewater that would normally be carried in the ditch would be
conveyed onto his property. We recommend that you work with Mr. Vetter to alleviate his
concerns.
