PATRICK CRAIG
A public hearing was conducted on March 15, 2000, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 28, 2000, and duly published March 2,
2000, in the South Weld Sun, a public hearing was conducted to consider the request of Patrick
Craig for a Site Specific Development Plan and Special Review Permit #1253 for a Wildlife
Sanctuary and Kennel in the A (Agricultural) Zone District. Lee Morrison, Assistant, County
Attorney, made this a matter of record. Chair Kirkmeyer advised Patrick Craig that he has the
option of continuing this matter to a date when the full board will be present. However, if he
decides to proceed today, it will require three affirmative votes, or in the case of a tie vote,
Commissioner Hall will listen to the record and make the determining vote. Mr. Craig indicated he
would like to proceed today. Sheri Lockman, Department of Planning Services, presented a brief
summary of the proposal and entered the favorable recommendation of the Planning Commission
into the record as written. Ms. Lockman explained Mr. Craig submitted an application for a Use by
Special Review Permit to prevent having a violation issued on his property. Ms. Lockman gave a
brief description of the proposed use and requested Development Standard #11 be amended to
state,"The operation shall comply with all applicable rules and regulations of the Division of Wildlife
and the United States Department of Agriculture." Ms. Lockman gave a brief description of the
location of the site,which is located in a rural area. She stated three referral agencies responded
in favor of the proposal with comments, three did not respond, and three letters of support have
been submitted. In response to Commissioner Vaad, Ms. Lockman stated Development Standard
#11 should be amended to ensure the applicant also complies with the requirements of the United
States Department of Agriculture (USDA). Chair Kirkmeyer stated the applicant will not be able to
operate without permits from the State and Federal levels, therefore, Development Standard #11
is not necessary. Mr. Morrison indicated it is important to keep at least one reference to the other
required permits to ensure that if State or Federal permits are revoked, the Use by Special Review
Permit will be affected as well. Chair Kirkmeyer suggested Development Standard #11 be
amended to state, 'The operation shall maintain all applicable and valid permits from the Division
of Wildlife and the United States Department of Agriculture."

Mr. Craig stated he would prefer the USDA be referenced, and gave an example of another wildlife
sanctuary which had its permit revoked but continued to operate under other permits. Mr. Craig
stated that in the past year the operation has been changed to a private, non-profit organization,
and there are approximately 100 volunteers. He stated approval of this permit will bring the
property into compliance with Weld County rules and regulations and added he has an upstanding
history with the State and Federal agencies which also regulate the site. In response to
Commissioner Baxter, Mr. Craig stated the USDA and Division of Wildlife require fencing and
barriers which ensure wild animals cannot escape back into the wild; however, he houses animals
that have been raised in captivity, and most of them do not desire to escape. In response to
Commissioner Geile, Mr. Craig stated there are currently 20 animals on the site, and with the
addition of a new building he estimates the maximum of 80 animals will be sufficient. Responding
to Commissioner Ceile, Mr. Craig clarified that although there are 100 volunteers,they usually visit
the site in groups of no more than 10 to 20 at any given time. Trevor Jiricek, Department of Public
Health and Environment, stated if the site hosts groups more than is allowed by the existing septic
system, the applicant will be required to provide Port-A-Potties. In response to Chair Kirkmeyer,
Mr. Craig stated he has reviewed and agrees with the Conditions of Approval and Development
Standards with the proposed change to Development Standard #11.
No public testimony was offered concerning this matter.
Commissioner Baxter moved to approve the request of Patrick Craig for a Site Specific
Development Plan and Special Review Permit #1253 for a Wildlife Sanctuary and Kennel in the
A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as entered into the
record and amended Development Standard #11 to state, "The operation shall maintain all
applicable and valid permits from the Division of Wildlife and the United States Department of
Agriculture." The motion was seconded by Commissioner Vaad, and it carried unanimously.
This Certification was approved on the 20th day of March 2000.
