RE: APPROVE AMENDMENT TO AGREEMENT FOR DONATION OF PROPERTY FOR
POUDRE RIVER TRAIL AND AUTHORIZE CHAIR TO SIGN - DEAN AND SUSAN
EDMUNDSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to the Agreement for
Donation of Property for the Poudre River Trail between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, and Dean and Susan
Edmundson, with terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Amendment to the Agreement for Donation of Property for the
Poudre River Trail between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, and Dean and Susan Edmundson be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 3rd day of January, A.D., 2000.

AMENDMENT TO AGREEMENT FOR DONATION
OF PROPERTY FOR POUDRE RIVER TRAIL
THIS AMENDMENT TO AGREEMENT is entered into this 3rdday of
January. 2000 , by and between the County of Weld, a political subdivision of the
State of Colorado, by and through the Board of County Commissioners of the County of Weld,
whose address is 915 10th Street, Greeley, Colorado 80631, hereinafter referred to as "County,"
and Dean P. Edmundson and Susan Edmundson, whose address is 11651 WCR 62 Greeley, CO
80631, hereinafter referred to as "the Edmundsons."
WITNESSETH:
WHEREAS, the parties hereto previously entered into an Agreement for Donation of
Property for Poudre River Trail, dated January 12, 1999, and approved by the Board of County
Commissioners of the County of Weld by resolution dated February 8, 1999, and
WHEREAS, the parties now desire to amend such Agreement to add a new Section 17, as
set forth below.
NOW, THEREFORE, in consideration of the premises and the following mutual
covenants, the parties hereto have agreed to amend their Agreement for Donation of Property for
Poudre River Trail, dated January 12, 1999, and approved by the Board of County
Commissioners of the County of Weld by resolution dated February 8, 1999 ("the Agreement"),
as follows:
17. LOCATION OF MONUMENTS AND /OR BENCHES: County agrees to limit the
location of monuments and/or benches to that area within the Right-of-Way between the
north edge of the concrete pavement and the Poudre River.
All other provisions of the Agreement shall remain the same.
IT IS MUTUALLY AGREED that the terms and conditions of this Amendment to
Agreement shall extend to and be binding upon the heirs, executors, administrators, successors,
and assigns of the respective parties hereto.
