PLAN, S*563 - GREELEY-WELD COUNTY AIRPORT AUTHORITY
A public hearing was conducted on November 15,2000, at 10:00 a.m.,with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 23, 2000, and duly published October 26,
2000, in the South Weld Sun, a public hearing was conducted to consider the request of the
Greeley-Weld County Airport Authority for a Site Specific Development Plan and Planned Unit
Development Final Plan, S#563. Lee Morrison, Assistant County Attorney, made this a matter of
record. Robert Anderson, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the record
as written. Mr.Anderson gave a brief description of the location of the site and surrounding uses.
He stated the site improvements include a variety of aviation businesses,as well as aviation repair
and storage facilities. Mr. Anderson stated sixteen referrals were sent; however, only ten
responded recommending approval, stipulating conditions, or indicating no conflict. He further
stated the Utilities Coordinating Advisory Committee met on November 9,2000,and recommended
approval. Mr.Anderson submitted a letter, marked Exhibit B, recommending additional Conditions
of Approval,and stated the Department of Planning Services recommends approval based on the
reasons indicated in the Administrative Review.
Mike Reisman, Greeley-Weld County Airport Manager, represented the applicant and stated the
Airport Authority is in agreement with the Conditions of Approval, with the exception of Condition
#1.A referencing a referral response from the Department of Public Works. He stated the Airport
Authority can execute easements with utility companies within the rights-of-way;however,it cannot
dedicate right-of-way. Mr. Reisman stated most of the Conditions have already been met. In
response to Commissioner Hall, Mr. Reisman stated he was referring to the letter dated

October 17, 2000, from the Department of Public Works, which is included by reference in
Condition of Approval#1.A. He explained the Airport Authority is a political subdivision of the State
and feels the right-of-way should be recognized as property of the Authority. Diane Houghtaling,
Department of Public Works, stated she recommends that the 80 feet of right-of-way be non-
transferable to private ownership. Commissioner Hall stated the right-of-way is currently under the
ownership of the Airport and is already non-transferable. Ms. Houghtaling stated if the plat does
not designate it as public ownership, it may become privately owned as the lots are sold.
Commissioner Hall clarified that the Airport will not be selling lots. Mr. Reisman stated the Airport
Authority is prohibited from selling land in accordance with Federal grants. In response to Mr.
Morrison, Mr. Reisman stated it is possible to add a note on the Plat that right-of-way for Block 2
of the Final Plat will remain public property owned by the Airport Authority Board. Responding to
Chair Kirkmeyer, Mr. Reisman reiterated the right-of-way is currently owned by the Airport
Authority. Commissioner Hall stated Condition#1.A or the referral letter needs to be modified. Mr.
Reisman clarified that Federal Regulations prohibit the Airport Authority from dedicating any of the
right-of-way to another public entity. In response to Mr. Morrison, Mr. Reisman stated the internal
roads are to be maintained by the Airport Authority. Ms. Houghtaling stated Weld County Roads
62 and 64 are to be maintained by Weld County. Chair Kirkmeyer read the conditions indicated
in the referral letter. In response to Mr. Morrison, Mr. Reisman requested the Condition clarify the
Airport Authority is not in a position to dedicate any right-of-way, and the internal roads are
intended to be under the control of the Airport for public safety reasons. Mr. Morrison stated the
road should be designed to public standards; however, they do not need to be dedicated to the
public. Responding to Mr. Morrison, Mr. Reisman stated the Airport Authority acquired and still
owns the cul-de-sacs for maintenance. Mr. Morrison stated he does not see an issue with the
external roads. He further stated 60 feet of right-of-way needs to be designated on the plat for the
internal roadways; however, they do not need to be dedicated to the County. Mr. Morrison
explained the dedication will preclude anyone from leasing or using the area for anything other than
right-of-way,and added it should not be an unrestricted public road because that is not appropriate
in the middle of an airport. Mr. Reisman stated he has reviewed and agrees with the Conditions
of Approval as discussed.
No public testimony was offered concerning this matter.
Commissioner Hall moved to approve the request of Greeley-Weld County Airport Authority for a
Site Specific Development Plan and Planned Unit Development Final Plan, S#563, based on the
recommendations of the Planning staff,with the Conditions of Approval as entered into the record
with clarification on Condition#1.A that right-of-way shall be designated on the plat not dedicated
to the public, as indicated in the referral from the Department of Public Works, dated October 17,
2000, and add Conditions of Approval 1.J through 1.0 as recommended by staff. The motion was
seconded by Commissioner Baxter, and it carried unanimously.
