Each lot will be occupied by a single family residence. Each residence shall be either a conventional fixed location home constructed on the lot or a manufactured home as defined in Amended Section 10.1 of the Weld County Ordinance No. 89- DD. In addition to the 18 single family lots, there is a 2.6 acre open space which will be utilized as a site for storm water detention, buffering around Ashcroft Draw, protection of wildlife habitat near Ashcroft Draw, and general use of the lot owners. 4 - Summary of concerns Sanitation District - The concerns of the Heath Department have been met by the City of Evans taking over operation of the district and working with the State and County Heath departments to resolve outstanding issues. Access to Arrowhead - Traffic into Arrowhead was identified by Arrowhead residents as a potential problem. A requirement for a 6' privacy fence was made part of the Preliminary Plat approval. A fence has been constructed on only the west 400' more or less and has effectively stopped traffic into Arrowhead since June 1999. We will request that the requirement for a fence the entire length be amended. Burden on services - John Nail and Brad Johnson have indicated that addition of these lots should have no undue adverse impact on School District 6, no additional buses will be required and the existing schools should be able to handle the additional students Weld County Engineering has indicated that the existing road system is adequate for the addition of these lots Weld County Sheriffs office indicated they anticipate no adverse impact and will review the proposal when referred by Weld County Planning Miliken Fire District - Bob Onorato with Miliken Fire District indicated no additional impact anticipated Weld County Treasure anticipates an estimated $900 - $1,000 per lot per year in property tax revenue when all lots are fully developed. 5 - Total number of lots proposed: 18 single family lots 1 open space tract 6 - Traffic from these lots will access directly onto Mesa Verde Drive which makes a direct connection to 47th Avenue. Mesa Verde and 47th Avenue are both existing and have been constructed in anticipation of the additional growth in the area. 47i°Avenue connects to 49th Street which provides access to 35th Avenue and 65th Avenue. Mesa Verde Drive: pavement width = 38' pavement thickness = 2" base course =4" 2' wise concrete valley pans abut the pavement 7 - While on street parking is permitted, these lots are large enough to encourage off-street. parking 8 - The open space tract will be owned an maintained by the Property Owner's Association for Hill-n-Park 5th Filing. This Association will be separate from the West Hill-n-Park Propen.y Owner's Association. The Developer will maintain the open space until 50% = one of the lots have been sold. After that time the responsibility for maintenance will transfer to the Property Owner's Association. The covenants for the Home Owner's Association have been modif.ed as requested to provide Weld County the ability enforce maintenance. 9 - NA 10 - Water for these lots will be supplied by the City of Evans. An existing 8" water line in Mesa Verde Drive runs the length of the proposed 18 lots. Fire hydrants and water services are in place. Estimated water usage =4950 gallons per day. 11 - A water supply resource report has not been supplied. Water is being obtained from the City of Evans under an existing agreement wherein the City of Evans aquired the water system for Hill-n-Park and Arrowhead and West Hill-n-Park Inc. and Arrowhead Inc. received existing and future water taps for use in the Hill-n-Park/Arrowhead area. The City has indicated that there is adequate water available. 12 - West Hill-n-Park and the City of Evans have an existing agreement for the City to provide West Hill-n-Park a number of water tap to be used in the West Hill-n-Park/Arrowhead area. There are approximately 40 taps remaining uncommitted from this agreement. 18 of these uncommitted taps will be assigned to these lots:Copy of the agreement and review of available taps attached. 13 - Sanitary sewer system will be an extension of the existing Hill-n-Park system operated by the City of Evans. An 8" sewer line will be extended west from an existing line located at the southeast corner of Lot 18 and will be located in the 15 foot easement along the front of the proposed 18 lots. An estimated 5000 gallons per day to be treated. 14 - 18 sewer taps have been purchased from the City of Evans/West Hill-n-Park Sanitation for use with these lots if approved. 15 - Requirements have been added to the Final Plat requiring and engineered foundation and that all construction will be in accordance with the Geotechnical Engineering Report and recommendations of the Colorado Geological Survey recommendations. 16 - A copy of the proposed Covenants and Home Owners Association Articles of Incorporation attached. 17 - NA 18 - NA 19 - Drainage report attached 20 - NA 21 - NA 22- Dedication of Easement to the City of Evans for a water line which is located between proposed lots 2 & 3. 23 - Draft agreement attached. Colorado Geologic Survey- construction on the east 4 lots has been restricted and a requirement added to the plat for construction to be in accordance with the Geotechnical Reports and the Colorado Geologic Survey referral 34 - Water is being supplied by the City of Evans and they indicate that looped system is sufficient for the intended use. 35 - Sewage disposal is provided by Hill-n-Park Sanitation District/City of Evans. 36 - No new streets are proposed for this development. The Weld County Engineering Department has reviewed the propose plan and found that the existing street system is adequate. 37 - NA 38 - A drainage report has been completed and facilities and site grading designed to accommodate the storm drainage demands of this development 39 - This proposal has been reviewed by local governments and districts and they have indicated that it will not cause and unreasonable burden on the ability to provide services. 40 - The subdivision will not cause air pollution violations based on Colorado Department of Public Health and Environmental standards based on a review by the Weld County Health Department. 41 - This subdivision conforms to the subdivision design standards of Section 10 of the Weld County Subdivision Ordinance. 42 - This subdivision will no have an undue adverse effect on wildlife and it habitat, the preservation of agricultural land, or historical sites. The proposed development is surrounded by other residential developments including Indian Hills, Dos Rios, and Arrowhead. Also the proposal incorporates the small area of floodplain into a 2.3 acre open space. January 3, 2000 De ,��eld County Planning Pt Mr Eric Jerman JAN 07 2000 Department of Planning Services Weld County Administrative Offices RECEIVED 1555 N. 17th Avenue Greeley, Colorado 80631 RE: Major Subdivision Final Plat Submittal Responses (West Hill n Park 5`h Filing) Dear Mr. Jerman The following is information is in response to your letter of December 2, 1999 detailing deficiencies in the Final Plat Submittal for West Hill n Park 5th Filing. Updated title commitment with an issue date of December 22, 1999 A water supply resource report. In your letter you referenced a document you felt was available from the City of Greeley. After extensive discussions with the City of Greeley Water Administration and Planning Department, we have concluded the document you are referring to is an internal document that is not relevant to water supplied by the City of Evans. The City of Greeley has an agreement to process water for the City of Evans that is owned by the City of Evans (see document "B" attached). The City of Greeley does not sell or provide water to the City of Evans. Also attached (document "C") is a City of Evans Resolution pertaining to Water Rights. This Resolution stipulates that in order to provide a sustainable and sufficient water supply the City must receive or purchase water equal to or greater than the rate required by development. West Hill n Park Inc. and Arrowhead Inc. transferred raw water rights to the City of Evans and later the water systems that serves Arrowhead and West Hill n Park in exchange for 850 water taps, of which approximately 40 are remaining. Eighteen of these taps will be assigned to the proposed lots of Hill n Park 5`" Filing (documents "D" and "E" attached). Attached is a deed from West Hill n Park Inc. to the West Hill n Park 5`" Filing Home Owners association for the Open Space and Drainage Detention area. Item 3 of the Conditions of Approval listed 7 items: A. water supply - information pertaining to water supply detailed in#3 above. B. Financial data provided with original submittal. C. Letter from Miliken Fire District states that they anticipate no impact (document"F"). D. Letter from School District Six stating that there are no concerns or expenses (document "G". E. Letter from Weld County Sheriffs Office stating there are no conflicts with their interests (document "H"). F. Revise covenants with Right to Farm Covenant and Maintenance added (attached). G. Draft improvements agreement provided with original submittal. Closure of 47`h Avenue and stopping traffic between Hill n Park and Arrowhead has been a continuing issue. The traffic between these areas has been stopped since June 1999 except for several weeks when all fencing was removed to allow for site grading and construction of a new fence. The six foot high wood privacy fence has remained in place and no one has attempted to remove it to open 47' Avenue into Arrowhead. Weld County Public Works has inspected the site and feels that the fence as constructed provides adequate closure. Oil and Gas drilling sites. No oil and gas drilling sites are shown on the final plat as nn sites are anticipated. A letter from attorney Sam Oldenburg addressing this issue is attached (document "!"). I hope that this addresses all of the outstanding issues necessary to complete the submittal so that this application can move forward.
