RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 154 - MR.
AND MRS. ARCHIE SHAW.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Mr. and Mrs. Archie Shaw have requested that Re-
corded Exemption No. 154 be amended by reducing the size of Lot
B from 160. 619 acres to 77. 821 acres. The legal description
for said Lot B is as follows :
Part of Section 16, Township 7 North, Range
66 West of the 6th P.M. , County of Weld,
State of Colorado being more particularly
described as follows:
Beginning at the Southwest Corner (SW Cor)
of said Section 16 and considering the West
line of said Section 16 as bearing North
00°00 ' 00" West, with all other bearings
contained herein relative thereto;
Thence North 00°00 ' 00" West, along said
West line, 2661. 68 feet;
Thence North 89°18 ' 24" East, 561. 32 feet;
Thence South 26°43 ' 41" East, along the
centerline of a concrete irrigation ditch,
927. 38 feet;
Thence South 32°24 ' 30" East, continuing along
said irrigation ditch, 1070. 75 feet;
Thence South 22°26 ' 32" East, 927. 00 feet,
continuing along said irrigation ditch;
Thence South 07°00 ' 40" East, 55. 81 feet to a
point on the South line of the SWa of Sec-
tion 16;
Thence South 89°16 ' 52" West, along said South
line, 1913. 09 feet to the Southwest Corner
(SW Cor) of said Section 16, said point being
the Point of Beginning.
Said described parcel of land contains 77. 821
acres , more or less, including a strip of
ground 30 feet in width along the West and
South lines of said described parcel of land
reserved for county road right-of-way purposes
and is subject to any rights-of-way or other
easements as granted or reserved by instru-
ments of record or as now existing on said
described parcel of land.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado has studied said request and has studied the recommen-
dations of the Weld County Planning Department and deems it ad-
visable to approve the amendment.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the amendment to Recorded
Exemption No. 154 as hereinabove mentioned be, and hereby is,
approved.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 30th day of
April , A.D. , 1980 .

RE: Amendment to Recorded Exemption #154
Dear Cannissioners:
The attached materials are in reference to a request fran Mr. and Mrs. Archie
Shaw for an amendment to Recorded Exemption #154. The property is described
as Pt. SW4 Section 16, T7N, R66W of the 6th p.m. , Weld County, Colorado. The
property is located 3 miles west and 1 mile south of Ault.
The request is to amend Recorded Exenption #154 by reducing the size of Lot
B fran 160.619 acres to 75.821 acres. The balance of 84.798 acres which is
all located east of an existing concrete irrigation ditch has been sold to
the adjacent property owner. Lot A of the Recorded Exemption is not affected
by this request.
Based upon a review of the information sukmitted, the Department of Planning
Services Staff recannends approval of this request for the following reasons:
1. The impact on surrounding agricultural land uses would not appear
to be any different than the original request which has already
been approved.
2. This request is in compliance with Section 9-4A. of the Weld County
Subdivision Regulations.

Gentlemen:

in Conformity to the natural topography following the
centerline of an existing concrete irrigation ditch,
the Lakeside Lateral .
No buildings are located upon either parcel "A" or

Re: SHAW - DANIELSON Property Transfer
Gentlemen:
Submitted herewith is an application and request for exemption
from the definition of "subdivision" or "subdivision land" as
defined by Section 2-1 of the Regulations.
This parcel of 160 acres is being divided along the natural
division line which leaves parcel "A" with about 4 acres less
than the minimum lot size for A-I zoned property.
The Danielsons also own the SE1/4 of Section 16, Township 7
North, Range 66 West of the 6th P.M. and will be farming
it in connection with parcel "B".
No buildings are located upon either parcel "A" or "B", and
although N.C.W.C.D. water is available to the two properties,
no change of use of the properties as farms is contemplated.
