HomeMy WebLinkAbout20002810 PETITION FOR ANNEXATION ' To the Town of Johnstown The undersigned, in accordance with Article 12, Chapter 31, CRS, as amended, hereby petition the Town Board of Trustees of the Town of Johnstown, Colorado, for annexation to the Town of Johnstown the unincorporated territory more particularly described below, currently known as Klein Farms , and in support of said Petition, your petitioners allege that: (1) It is desirable and necessary that the following described territory be annexed to the Town of Johnstown, Colorado. See Exhibit A attached hereto and made a part hereof. (2) Not less than one-sixth (1/6) of the perimeter of that area proposed to be annexed is contiguous with the Town of Johnstown, Colorado. (3) A community of interest exists between the territory proposed to be annexed and the Town of Johnstown, Colorado. (4) The territory proposed to be annexed is urban or will be urbanized in the near fn.th e; (5) The territory proposed to be annexed is integrated or is capable of being integrated with the Town of Johnstown, Colorado; (6) The signatures of the Petition comprise one hundred percent (100%) of the landowners of the territory to be included in the area proposed to be annexed and said landowners attesting to the facts and agreeing to the conditions herein contained will negate the necessity of any annexation election; (7; No land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate: (a) Is divided into separate parts or parcels without the written consent of the landowner or landowners thereof, unless such tracts or parcels are separated by a dedicated street, road or other public way; (b) Comprising twenty (20) acres or more and which, together with the building and improvements situated thereon has an assessed value in excess of Two Hundred Thousand Dollars ($200,000.00) for ad valorem tax purposes to be annexed without the written consent of the landowner or landowners. 411)a bil AT IA'e // ° cc' ✓?L MICI ,1uu) PIC ('/1 °,Al JJ/ - 7 ) 2000-2810 (8) No part of the area proposed to be annexed is more than three miles from a point on the municipal boundary, as such was established more than one year before this annexation will take place; (9) The area proposed to be annexed comprises more than ten acres and an impact report as provided in Section 31-12-105.5, CRS, as amended, is required. (10) The area proposed to be annexed is located within Weld County, School District RE-57, Northern Colorado Water Conservancy District, Little Thompson Water District, Johnstown Fire Protection District, Aims Junior College District, and Weld County Library District, and no others; (11) The mailing address of each signer, the lega description of the land owned by each signer and the date of signing of each signature are all shown on this Petition;, (12) Accompanying this Petition are five (5) prints of the area proposed to be following information: (a) A written legal description of the boundaries of the area proposed to be annexed; (b) A map showing the boundary of the area proposed to be annexed, such map prepared and containing the seal of a registered engineer or land surveyor; (c) Within the annexation boundary map there is shown the location of each ownership tract in unplatted land, and if part or all of the area is to be platted at the time of the effectiveness of the annexation (as opposed to after such effectiveness), then the boundaries and the plat number of plots or of lots and blocks are shown; (d) Next to the boundary of the area proposed to be annexed is drawn the contiguous boundary of the Town of Johnstown, and the contiguous boundary of any other municipality abutting the area proposed to be annexed; (e) The dimensions of the contiguous boundaries are shown on the map. (f) A proposed drainage plan and a proposed utilities plan. (13) The territory to be annexed is not presently a part of any incorporated city, city and county, or town; - 2 - N) (14) The undersigned agree to the following conditions, which shall be covenants running with the land, and which shall, at the option of the Town, appear on the annexation map: (a) Water rights shall be provided as mutually agreed to by the Town and the undersigned; (b) The owners shall participate in providing drainage plan and improvements and payment of a unit drainage fee as may be required by the Town the area; ( c ) The undersigned hereby waive any and all "vested rights" previously created pursuant to Section 24-68-103, CRS, as amended. (d) The undersigned and the Town may enter into an Annexation Agreement prior to the effective date of this annexation, which agreement shall be additional conditions as effectively as if set forth in this Petition. Project Concept The project comprises a total of 149.08 acres of existing agricultural farmland. Additionally, the developer proposes the transitional multi-family housing to consist of a blend of apartment, condominiums and town-homes to reach the full spectrum of affordable housing ranges. Furthermore the developer wishes to coordinate a site within the single family zoning for schools and daycare facilities to assist the community and the subdivision in these essential needs. The mixed use portion of this development is proposed to be a pedestrian friendly specialty shops with the mom and pop business opportunities in which housing is within the same establishment of their respective business and a feasible opportunity for economic development and local community services to be supplied to the community and subdivision. Site Features The land is sloping gently form the northwest to the southeast. This parcel has no additional features other than farmland with irrigation ditches on the perimeter of the parcel. Additionally, there arc no known mineral or gas wells on this parcel. The owner has retained the mineral rights for this parcel. Proposed Land Use and Zoning A map has been incorporated within this application and the land use table above describes the uses and distribution for the map enclosed. Vehicular, Bike and Pedestrian Circulation The proposed concept plan shows through the use of circles the proposed pedestrian and bike corridors that will be implemented within this application upon preliminary plat process. Additionally, the proposed cross sections included within the plan set shows the desire to implement detached sidewalks and create a more pedestrian friendly community. ' �4 rr `r�. •....+4w s iio�. 1GtGa1i tr M.rrt ay arc W..,"v we wret` .ar.r.-awatee a n EXHIBIT B NARRATIVE DESCRIPTION OF THE PROPOSED STORM DRAINAGE SYSTEM WATER DISTRIBUTION SYSTEM SANITARY SEWER COLLECTION SYSTEM THE PROPOSED RON KLEIN FAMILY SUBDIVISION JOHNSTOWN, COLORADO (150 Acre Parcel) SEPTEMBER 6, 2000 PREPARED FOR: Ron Klein 22015 Weld County Rd. 17 Johnstown, Colorado 80534 INTRODUCTION Purpose and Scope The purpose of this narrative is to outline design concepts prior to the preliminary design phase for the proposed Klein Annexation. Outlining the concepts is important at this time because the design consultants value early and clear communication of the proposed site features. Outlining the proposed "wet utilities"will deliver a better understanding of the direction the design and will bring potential issues to light earlier in the design process. This ultimately results in a more complete and satisfactory design which will be more easily reviewed. The narrative is written to be approachable by a general audience and describes the proposed features. Detailed engineering analyses and reports will be prepared during the design phase. As stated above, presented in this document will be a narrative description of the"wet utilities" 1) the storm drainage system, 2) the water distribution system, 3) the sanitary sewer collection system. The scope of this document is limited to features of the proposed systems. Brief descriptions will be presented for impacted existing systems. Site Description and Existing Conditions Today, the Klein Annexation site comprises 150 acres, more or less, of gently sloping, cultivated farm land. More formally, the site is located on Section 8, Township 4 North, Range 67 West of the 6th Principal Meridian. The site is bounded on the west and north by fallow fields. The eastern boundary of the site is County Road 17. The southern boundary is County Road 46. The site lies immediately upstream of the Little Thompson River. There are no water or sewer services on the site today. However, there is a water line adjacent to the site. The proposed utilities will connect to these existing lines. PROPOSED STORM DRAINAGE SYSTEM The rational method was used to determine peak discharge quantities. The design methodology used during the analysis portion (hydrology and hydraulics) of the design is outlined in the UDFCD Storm Water Management Manual, with the City of Greeley rainfall. The water quality B1vIP design procedures used are outlined in the UDFCD manual. An onsite as well as an offsite peak discharge was calculated. A required detention volume calculation was performed. The results of the calculations are as follows: 1. Existing onsite 100 year peak discharge 72 cfs 2. Developed onsite 100 year peak discharge 315 cfs 3. Existing offsite 100 year peak discharge 290 cfs 4. Required 100 year detention volume 12.3 ac-ft In concept, the storm flows will be carried on the surface, as gutter flow and swale flow until these site features, full or otherwise, are constrained due to site conditions. While it is anticipated that surface drainage will carry the developed site flows, short reaches of closed- conduit storm drain may be presented in the final design. The site plan (included in the application packet) shows that future park sites are proposed. These park sites will include stormwater detention for reducing the developed 100-year flow to historic levels. The pond's outlet structure will include a water quality capture volume discharge structure. In reviewing documents for this project it was discovered that a sizable (approximately 600 acres) tributary basin drains onto this site. The drainage analysis will identify these flows and propose a method of safely routing these flows around or through the site. Current upstream discharge will be routed through the site undetained. It is anticipated that flow through the site will be reduced as upstream property is developed because detention will be required on those sites. The final design documents will include a detailed design analysis and calculations addressing construction phase and permanent stormwater quality Best Management Practices (BMPs). Construction phase BMPs may include: Silt Fence Strawbale dikes Vehicle Traction Control Pavement scheduling Gravel filters Permanent BMPs may include: Water quality capture volume in detention pond (w/water quality outlet) Pavement Designed gravel swales PROPOSED WATER SYSTEM The proposed development will use the Town water system for delivering potable water to the development residents. There is an existing 12"waterline along County Road 46. The proposed connection will be looped from County Road 46 to County Road 17 and stubbed out to the north and west. Alternately, a relatively larger diameter"backbone"pipe (10 or 12 inch) may be proposed. The overriding design concept that will be presented is that the system that is proposed in the design enhance the existing distribution system by increasing available flow for domestic use or fire protection. If requested, a water system computer model will be submitted at the time of final design showing that fire flow requirements can be met throughout the proposed system. Thee system will be constructed of AWWA rated, PVC pressure pipe and fittings. Valves and fire hydrants will.AWWA rated ductile body fittings with epoxy coatings and linings. Concrete thrust blocks will be used as thrust restraint. PROPOSED SANITARY SEWER SYSTEM The proposed sanitary sewer collection system will outfall in the southeast corner of the site, ultimately entering a lift station near the intersection of County Roads 17 and 46. During the design phase the depth of the sewer system and the potential need increasing the size of existing sanitary sewer pipes (off-site pipes) will be evaluated. A hydraulic analysis will be presented at final design showing that the proposed collection system is capable of carrying the design capacity. 'The hydraulic analysis will be used as a basis for proposing off-site improvements as well as demonstrating that the proposed on-site collection system will have the design capacity. The proposed collection system will be constructed of 8-inch SDR 35 PVC pipe with 4-foot manholes. The maximum distance between manholes will be 400 feet. See Exhibit A attached hereto and made a part hereof. (2) Not less than one-sixth (1/6) of the perimeter of that area proposed to be annexed is contiguous with the Town of Johnstown, Colorado. (3) A community of interest exists between the territory proposed to be annexed and the Town of Johnstown, Colorado. (4) The territory proposed to he annexed is urban or will be urbanized in the near f.iturc; (5) The territory proposed to be annexed is integrated or is capable of being integrated with the Town of Johnstown, Colorado; (6) The signatures of the Petition comprise one hundred percent (100%) of the landowners of the territory to be included in the area proposed to be annexed and said landowners attesting to the facts and agreeing to the conditions herein contained will negate the necessity of any annexation election; (7) No land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate: (a) Is divided into separate parts or parce's without the written consent of the landowner or landowners thereof, unless such tracts or parcels are separated by a dedicated street, road cr other public way; (b) Comprising twenty (20) acres or more and which, together with the building and improvements situated thereon has an assessed value in excess of Two Hundred Thousand Dollars (,200,000.00) for ad valorem tax purposes to be annexed without the written consent of the landowner or landowners. - t - (8) No part of the area proposed to be annexed is more than three miles from a point on the municipal boundary, as such was established more than one year before this annexation will take place; (9) The area proposed to be annexed comprises more than ten acres and an impact report as provided in Section 31-12-105.5, CRS, as amended, is required. EXHIBIT B Page 2 NARRATIVE DESCRIPTION OF THE PROPOSED STORM DRAINAGE SYSTEM WATER DISTRIBUTION SYSTEM SANITARY SEWER COLLECTION SYSTEM THE PROPOSED RON KLEIN FAMILY SUBDIVISION JOHNSTOWN, COLORADO (69 Acre Parcel) SEPTEMBER 6, 2000 PREPARED FOR: Ron Klein 22015 Weld County Rd. 17 Johnstown, Colorado 80534 INTRODUCTION Purpose and Scope The purpose of this narrative is to outline design concepts prior to the preliminary design phase for the proposed Klein Annexation. Outlining the concepts is important at this time because the design consultants value early and clear communication of the proposed site features. Outlining the proposed"wet utilities"will deliver a better understanding of the direction the design and will bring potential issues to light earlier in the design process. This ultimately results in a more complete and satisfactory design which will be more easily reviewed. The narrative is written to be approachable by a general audience and describes the proposed features. Detailed engineering analyses and reports will be prepared during the design phase. As stated above,presented in this document will be a narrative description of the "wet utilities": 1) the storm drainage system, 2) the water distribution system, 3) the sanitary sewer collection system. The scope of this document is limited to features of the proposed systems. Brief descriptions will be presented for impacted existing systems. Site Description and Existing Conditions Today, the Klein Annexation site comprises 69 acres, more or less, of gently sloping, cultivated farm land. More formally, the site is located on Section 8, Township 4 North, Range 67 West of the 6th Principal Meridian. The site is bounded on the west by county road 15. On the North, the site is bounded by an irrigation ditch. The eastern boundary of the site has a twelve foot wide dirt road that is not named. The southern boundary is an existing farm. The site lies upstream of the Little Thompson River. There are no water or sewer services on the site today. However, there is a water line adjacent to the site. The proposed utilities will connect to these existing lines. The existing railroad will be bored through as necessary for utility connection purposes. PROPOSED STORM DRAINAGE SYSTEM The rational method was used to determine peak discharge quantities. The design methodology used during the analysis portion (hydrology and hydraulics) of the design is outlined in the UDFCD Storm Water Management Manual, with the City of Greeley rainfall. The water quality BMP design procedures used are outlined in the UDFCD manual. An onsite as well as an offsite peak discharge was estimated. A required detention volume calculation was performed. The results of the calculations are as follows: L Existing onsite 100 year peak discharge 36 cfs 2. Developed onsite 100 year peak discharge 170 cfs 3. Existing offsite 100 year peak discharge 173 cfs 4. Required 100 year detention volume 4.42 ac-ft In concept, the storm flows will be carried on the surface, as gutter flow and swale flow until these site features, full or otherwise, constrained due to site conditions. While it is anticipated that surface drainage will carry the developed site flows, short reaches of closed-conduit stone drain may be presented in the final design. The site plan (included in the application packet) shows that future park sites are proposed. These park sites will include stormwater detention for reducing the developed 100-year flow to historic levels. The pond's outlet structure will include a water quality capture volume discharge structure. In reviewing documents for this project it was discovered that a sizable (approximately 300 acres) tributary basin drains onto this site. The preliminary drainage analysis will identify these flows and propose a method of safely routing these flows around or through the site. Current upstream discharge will be routed through the site undetained. It is anticipated that flow through the site will be reduced as upstream property is developed because detention will be required on those sites. The final design documents will include a detailed design analysis and calculations addressing construction phase and permanent stormwater quality Best Management Practices (BMPs). Construction phase 13MPs may include: Silt Fence Strawbale dikes Vehicle Traction Control Pavement scheduling Gravel filters Permanent BMPs may include: Water quality capture volume in detention pond (w/water quality outlet) Pavement Designed gravel swales PROPOSED WATER SYSTEM The proposed development will use the Town water system for delivering potable water to the development residents. There is an existing waterline along county road 15. The proposed connection will be looped from County Road 15, and stubbed out to the eastern and southern boundaries of the site. Alternately, a relatively larger diameter"backbone"pipe (10 or 12 inch) may be proposed. The overriding design concept that will be presented is that the system that is proposed in the design enhance the existing distribution system by increasing available flow for domestic use or fire protection. If requested, a water system computer model will be submitted at the time of final design showing that fire flow requirements can be met throughout the proposed system. The system will be constructed of AWWA rated, PVC pressure pipe and fittings. Valves and fire hydrants will AWWA rated ductile body fittings with epoxy coatings and linings. Concrete thrust blocks will be used as thrust restraint. PROPOSED SANITARY SEWER SYSTEM The proposed sanitary sewer collection system will outfall in the southeast corner of the site. The sanitary line will continue southeast, ultimately entering a lift station near the intersection of County Roads 17 and 46. During the design phase the depth, of the sewer system and the potential need increasing the size of sanitary sewer pipes (off-site pipes)will be evaluated. A hydraulic analysis will be presented at final design showing that the proposed collection system is capable of carrying the design capacity. The hydraulic analysis will be used as a basis for proposing off-site improvements as well as demonstrating that the proposed on-site collection system will have the design capacity. The proposed collection system will be constructed of 8-inch SDR 35 PVC pipe with 4-foot manholes. The maximum distance between manholes will be 400 feet.
