RE: ACTION OF THE BOARD CONCERNING MOBILE HOME PERMIT#2219 - HOME
LUMBER COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 16th
day of October, 2000, considered the request of Home Lumber Company, 4058 Camelot Circle,
Longmont, Colorado 80504, for a mobile home to be used as an Accessory Use in the
I (Industrial) Zone District on a parcel of land being more particularly described as follows
Lot 13, Block 1, Rademacher Business Park,
located in the NE1/4 of Section 23, Township 3
North, Range 68 West of the 6th P.M., We d
County, Colorado
WHEREAS„ the Board of County Commissioners, having heard all of the testimony,
finds that the applicant's request for a Mobile Home Permit for a mobile home to be used as ar.
Accessory Use in the I (Industrial) Zone District does not fully comply with the Weld County
Zoning Ordinance and should be denied for the following reasons:
1. Section 43.3.1.1 - The applicant is proposing a mobile home to be utilized as a
break room that is not compatible with the surrounding properties. A break room
facility is presently available within the office structures sited on Lot 12, Block
of the Home Lumber and Supply Company property.
2. Section 43.3.1.3 - The applicant is proposing a mobile home to be placed as a
permanent structure which has no water or sewage disposal facilities available
NOW„ THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Home Lumber Company for permission to place a
mobile home to be used as an Accessory Use in the I (Industrial) Zone District on the above
described parcel of land, which was found not to be in compliance with Section 43.3 of the
Weld County Zoning Ordinance, be, and hereby is, denied.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be denied based on the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 43.3 of the Weld County Zoning Ordinance, as follows:
a. The applicant is proposing a mobile home to be utilized as a breakroom that is not
compatible with the surrounding properties. A breakroom facility is presently
available within the office structure sited on Lot 12, Block 1 of the Home Lumber and
Supply Company property.
Should the Board of County Commissioner's approve this request,the Department of Planning Staff
recommends the following conditions be attached:
1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home
on the property.
2. Camelot Circle is designated on the Transportation Plan Map as an industrial park road, which
requires a sixty 60 feet of right-of-way at full build out. There is presently a sixty(60)feet of right-of.
way. This road is NOT maintained by Weld County.
3. The applicant shall utilize the existing internal access to this parcel from Camelot Circle, and ric

additional accesses shall be granted.
4. Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a
result of the proposed development,the applicant/landowner shall be responsible for controlling the
noxious weeds.
5. Derelict manufactured (mobile) home: a manufactured (mobile) home that is partially or total y
damaged by fire, earthquake, wind, or other natural causes, or is in a state of general dilapidation,
deterioration, or decay resulting from improper lack of maintenance, vandalism, or infestation with
vermin or rodents. Any such DERELICT MANUFACTURED(MOBILE) HOME shall be returned to
and maintained in the condition as originally established on site and as inspected by the Weld
County Building Inspection Department, or it shall be removed from the site.
6. The mobile home may not be used on any basis as a dwelling or as overnight or temporary housing
for any person.
7. The applicant shall provide evidence the Department of Planning Services that the concerns of the
Mountain View Fire Protection District have been addressed.
8. The applicant shall maintain compliance with section 43.2.5 at all times.

application meets the approval criteria of Section 43 of the Weld County Zoning Ordinance,you will be notified
that the zoning permit is approved. If the staff determines that the application does not meet the approval
criteria, you will be notified and asked to appear before the Board of County Commissioners at a public
hearing. You will be informed of the hearing date at least a week prior to the hearing. The Board of County
Commissioners will then consider your application and make a final decision on the zoning permit for the
mobile home.

This is a follow up to our phone conversation earlier this week pertaining to our
building permit application VI #9900337. As we discussed, we still have not been
able to procure the title or bill of sale for the trailer but we have located a serial
number. After talking to you I was informed that we have contacted the
manufacture of the trailer and have initiated the process of obtaining a new title.

The Weld County Public Works Department has reviewed this proposal; the following requ rerniints -e
recommended to be a part of any approval:
COMMENTS:
Camelot Circle is designated on the Transportation Plan Map as an industrial park road, which requir is

Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-w ry
line.
WCR 9.5 is designated on the Transportation Plan Map a collector status road,which requires an 80-ft 3t
right-of-way at full build out. There is presently an 80-foot right-of-way. This road is maintained by WI: Id
County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 9,
as amended), the required setback is measured from the future right-of-way line.
REQUIREMENTS:_
The Weld County Public Works recommends approval of this application.
The applicant shall utilize the existing internal access to this parcel from Camelot Circle . and to

I have reviewed the submitted material pertaining to the Zoning Permit for Accessory Use in tie
Industrial Zoned District at 4058 Camelot Circle in Weld County (Case Name: Home Lumber
Supply, Case Number: ZPMH-2219). The Fire District has no objection to zoning permit for the
purposes of installing one modular building at the above address.
Building floor plans will need to be submitted by the applicant to the Fire District for review aid
approval before a building permit is issued by Weld County. A final inspection of the structi re
will be required by a member of the Fire District before a Certificate of Occupancy is issued
from Weld County.

Dear Mr. Ogle:
I have reviewed the submitted material pertaining to the request to install a break room modular building at
4058 Camelot Circle in Weld County. The Fire District does not object to the request to install the modular
building provided the requirements of the District are met. Based on my review, I have the following
comments:
• The trailer shall be located at the site as shown on the plans submitted and no other structures or
facilities shall be brought onto the site or located within 20 feet of the trailer.
• Cooking equipment, other than a micro wave or coffee pot, shall not be installed in the building.
• Any access/egress to the trailer such as stairs, walkways or ramps must meet the requirements of the
Uniform Building Code, including handrails, and shall be inspected and approved by the Weld County
Building Department.
• Building floor plans will need to be submitted by the applicant to the Fire District for approval before
a building permit is issued by Weld County.
• A final inspection of the structure will be required by a member of the Fire District before a Certific ue
of Occupancy is issued from Weld County.
The Fire District reserves the right to make further comments as the project proceeds. Nothing in tits
review is intended to authorize or approve of any aspect of this project that does not comply with all
