HomeMy WebLinkAbout20002494.tiff o t' 3 RESOLUTION RE: ACTION OF THE BOARD CONCERNING MOBILE HOME PERMIT#2219 - HOME LUMBER COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 16th day of October, 2000, considered the request of Home Lumber Company, 4058 Camelot Circle, Longmont, Colorado 80504, for a mobile home to be used as an Accessory Use in the I (Industrial) Zone District on a parcel of land being more particularly described as follows Lot 13, Block 1, Rademacher Business Park, located in the NE1/4 of Section 23, Township 3 North, Range 68 West of the 6th P.M., We d County, Colorado WHEREAS„ the Board of County Commissioners, having heard all of the testimony, finds that the applicant's request for a Mobile Home Permit for a mobile home to be used as ar. Accessory Use in the I (Industrial) Zone District does not fully comply with the Weld County Zoning Ordinance and should be denied for the following reasons: 1. Section 43.3.1.1 - The applicant is proposing a mobile home to be utilized as a break room that is not compatible with the surrounding properties. A break room facility is presently available within the office structures sited on Lot 12, Block of the Home Lumber and Supply Company property. 2. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 43.3 of the Weld County Zoning Ordinance, as follows: a. The applicant is proposing a mobile home to be utilized as a breakroom that is not compatible with the surrounding properties. A breakroom facility is presently available within the office structure sited on Lot 12, Block 1 of the Home Lumber and Supply Company property. Should the Board of County Commissioner's approve this request,the Department of Planning Staff recommends the following conditions be attached: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Camelot Circle is designated on the Transportation Plan Map as an industrial park road, which requires a sixty 60 feet of right-of-way at full build out. There is presently a sixty(60)feet of right-of. way. This road is NOT maintained by Weld County. 3. The applicant shall utilize the existing internal access to this parcel from Camelot Circle, and ric PL. /2 3 additional accesses shall be granted. 4. Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the proposed development,the applicant/landowner shall be responsible for controlling the noxious weeds. 5. Derelict manufactured (mobile) home: a manufactured (mobile) home that is partially or total y damaged by fire, earthquake, wind, or other natural causes, or is in a state of general dilapidation, deterioration, or decay resulting from improper lack of maintenance, vandalism, or infestation with vermin or rodents. Any such DERELICT MANUFACTURED(MOBILE) HOME shall be returned to and maintained in the condition as originally established on site and as inspected by the Weld County Building Inspection Department, or it shall be removed from the site. 6. The mobile home may not be used on any basis as a dwelling or as overnight or temporary housing for any person. 7. The applicant shall provide evidence the Department of Planning Services that the concerns of the Mountain View Fire Protection District have been addressed. 8. The applicant shall maintain compliance with section 43.2.5 at all times.
