RE: APPROVE TAP FEE AGREEMENT AND PETITION FOR INCLUSION OF LAND FOR
FORT LUPTON GRADER SHED AND AUTHORIZE CHAIR TO SIGN - CENTRAL
WELD COUNTY WATER DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Tap Fee Agreement and Petition for
Inclusion of Land for the Fort Lupton Grader Shed between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Public Works, and the Central Weld County Water District, with terms and
conditions being as stated in said agreement and petition, and
WHEREAS, after review, the Board deems it advisable to approve said agreement and
petition, copies of which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Tap Fee Agreement and Petition for Inclusion of Land for the
Fort Lupton Grader Shed between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Public Works,
and the Central Weld County Water District be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement and petition.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 14th day of August, A.D., 2000.

Please submit the enclosed item for the Board's next agenda:
Enclosed are two Tap Fee Agreements for the Chair's signature one with
Central Weld County Water District and one with the Northern Colorado
Water Conservancy District.
Also enclosed are three petitions for inclusion of lands purchased for the Ft. Lupton
grader shed to be in the municipal subdistrict submitted for the Chair's signature.
The appropriate documentation is attached.

Dear Mr. Hawkins:
Enclosed are two Tap Fee Agreements, which need to be dated, signed and returned to the
District office. One copy will be returned to you after the District's Board Members sign
on the appropriate lines. Also enclosed are three Petitions For Inclusion, which have to
be dated, signed, notarized and return two copies to the District office for processing.

TO: THE BOARD OF DIRECTORS OF THE CENTRAL WELD COUNTY WATER
DISTRICT
I/we, being all of the owners of the below described real property, which property is capable
of being served with the facilities of the aforesaid District hereby petition the Board of Directors of
said Central Weld County Water District to include the below described real property within the
boundaries of said District.
Assent to the inclusion of such property is hereby given by the below signers, which signers
constitute all of the fee owners of said below described property.
Lot A Recorded Exemption No. 1309-28-1-RE2375, recorded February 18, 1999, Reception

ACTIVE TAP
TAP FEE AGREEMENT
THIS AGREEMENT,made and entered into this(' 14th day of August , 20 00 ,
by and between the CENTRAL WELD COUNTY WATER DISTRICT, hereinafter called the District, and
Weld County and hereinafter called Customer,
WITNESSETH:
WHEREAS, District has been organized as a legal body and is known as the Central Weld County
Water District, and
WHEREAS, Customers are taxpaying electors within said District, or desiring to join said District, or
and,
WHEREAS, Customers are desirous of acquiring one water tap of 5/8 inches in diameter from the
said District,
NOW, THEREFORE, in consideration of the premises and the terms of this agreement, it is mutually
agreed as follows:
1. Customer agrees to pay the tap fee of$ 18,600.00
Eighteen Thousand Six Hundred and No/100 Dollars.
2. The description of the premises for which this tap is being purchased is as follows:
Lot A Recorded Exemption No. 1309-28-1-RE2375, recorded February 18, 1999, Reception No.
2673927, located in SE 'A NE ''A and NE ''A SE ''A Section 28, Township 2 North, Range 66 West of the
6th P.M., Weld County, Colorado.
3. This agreement, when approved by the Board of Directors, shall become a legal and binding
contract upon all parties hereto.
4. Customer further agrees to execute any and all easements needed by District at no expense to
District, across Customer's property for the installation of the meter pit and appurtenances constructed by
District. District shall be responsible for restoring surface area back to reasonable condition at District cost.
5. Customer further agrees to execute any and all easements needed by District at no expense to
District, across Customer's for the purpose of installing the District's service line and meter pit constructed
by District. District shall be responsible for restoring surface area back to reasonable condition at District
cost.
6. Customer further agrees to the following special provisions:
Extension Fee of$33,300.00
7. Customer further agrees to abide by the rates established and the rules and regulations of the
District.
IN WITNESS WHEREOF, the parties hereto have hereunto and hereunder set their signatures the day
and year first hereinabove written.
