HomeMy WebLinkAbout20001106.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MAY 10, 2000 TAPE #2000-13 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, May 10, 2000, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Baxter moved to approve the minutes of the Board of County Commissioners meeting of May 8, 2000,as printed. Commissioner Geile seconded the motion,and it carried unanimously. ADDITIONS TO AGENDA: The following was added under Bids:4)Approve Window Cleaning for Various Buildings Bid - Buildings and Grounds Department CONSENT AGENDA: Commissioner Hall moved to approve the consent agenda as printed. Commissioner Geile seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. PUBLIC INPUT: Yongge Vue, Weld County resident, stated he applied for Recorded Exemption #2669 on Monday, May 8, 2000; however, the request was denied. He stated the file was incomplete and submitted a letter of explanation and two deeds, marked Exhibit A, showing he does not own Lot A of Recorded Exemption #2300, as previously approved by the Board of Commissioners. Chair Kirkmeyer clarified Commissioner Vaad was not present on May 8, 2000, and cannot make a determination on this matter. Mr. Barker stated the deed submitted by Mr. Vue was not in the packet on May 8, 2000. Chair Kirkmeyer stated the reason for denial was not based on whether he owned both lots. Commissioners Geile and Hall commented that this information does not change the decision. In response to Commissioner Geile, Mr. Barker stated the deed was backup information for Recorded Exemption#2300, not the Recorded Exemption that was considered on May 8, 2000. Commissioner Geile commented the applicant needs to meet with the Department of Planning Services staff to discuss other options for the use of this land. Commissioner Baxter stated the decision for denial was based on the overall number of 2000-1106 BC0016 parcels created, regardless of who owns the lots, and this information does not alter that decision. Chair Kirkmeyer stated the Board does not wish to reconsider this matter. She stated the decision for denial was based on the application being inconsistent with the Zoning regulations, not on who owned the lots. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $155,827.93 Commissioner Baxter moved to approve the warrants as presented by Mr. Warden. Commissioner Hall seconded the motion, which carried unanimously. BIDS: PRESENT AND APPROVE DIGITAL CAMERAS AND ACCESSORIES BID-ASSESSOR'S OFFICE: Mr. Warden presented the three bids received. Michael Sampson,Assessor's Office, recommended approval of the second low bid from Wolf Camera because it is more consistent with the specifications required. He explained he is requesting this be approved on an emergency basis because the Assessor's Office needs to begin using digital pictures which will be scanned into the computer system. In response to Commissioner Geile, Mr. Sampson stated the bid includes 18 cameras, expansion kits, picture expansion cards,NC adapters,all-weather bags,and a wide angle lense and adapter. Responding to Commissioner Vaad, Mr. Sampson stated Mike's Camera did not meet the specifications for the camera bag and expansion kits. He added that although these are partial bids, he would prefer to get all of the equipment from one source. Mr. Warden suggested getting all of the equipment from Mike's Camera, Inc., with the exception of the camera bag. Mr. Warden suggested the waiting period not be waived to allow the Purchasing Department to contact Mike's Camera, Inc., and determine if it can meet the specifications. Rose Everitt, Purchasing Department,stated she attempted to contact Mike's Camera, Inc.; however,they did not respond and do not open until 9:00 a.m today. Chair Kirkmeyer suggested continuing this matter until Monday, May 15, 2000, to allow staff to finalize the details. Commissioner Hall moved to continue said bid until Monday, May 15, 2000, at 9:00 a.m. Commissioner Baxter seconded the motion. APPROVE GARAGE DOORS FOR EXHIBITION BUILDING BID - BUILDINGS AND GROUNDS DEPARTMENT: Mr. Warden stated the Buildings and Grounds Department recommends approval of the low bid from Front Range Raynor Door Company, in the amount of $9,915.00. Commissioner Baxter moved to approve said bid as recommended by staff. Commissioner Geile seconded the motion, which carried unanimously. APPROVE CRUSH CONCRETE/ASPHALT BID - DEPARTMENT OF PUBLIC WORKS: Mr. Warden stated the Department of Public Works recommends approval of the low bid from Killion Supply, in the amount of $57,600.00. Commissioner Hall moved to approve said bid as recommended by staff. Commissioner Geile seconded the motion, which carried unanimously. APPROVE WINDOW CLEANING FOR VARIOUS BUILDINGS BID - BUILDINGS AND GROUNDS DEPARTMENT: Mr. Warden stated the Buildings and Grounds Department recommends approval of the low bid from Budget Building Services, Inc. Commissioner Hall moved to approve said bid as recommended by staff. Seconded by Commissioner Vaad, the motion carried unanimously. NEW BUSINESS: CONSIDER APPLICATION FOR FEDERAL ASSISTANCE FOR MIGRANT HEAD START PROGRAM IMPROVEMENT IN GRAND JUNCTION, COLORADO, AND AUTHORIZE CHAIR TO SIGN: Walt Speckman, Director of Human Services, stated this is a request for additional funds to assist in moving the Migrant Head Start Program into the new building in Grand Junction, Colorado. Commissioner Vaad Minutes, May 10, 2000 2000-1106 Page 2 BC0016 moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Hall, the motion carried unanimously. CONSIDER APPLICATION FOR FEDERAL ASSISTANCE FOR FISCAL YEAR 2000-2001 MIGRANT HEAD START GRANT AND AUTHORIZE CHAIR TO SIGN: Mr. Speckman stated this is the annual Migrant Head Start Grant Application for fiscal year 2000-2001. Commissioner Baxter moved to approve said application and authorize the Chair to sign. Commissioner Vaad seconded the motion,which carried unanimously. CONSIDER MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN - RIGHT TO RIEAD OF WELD COUNTY, INC.: Mr. Speckman stated this and the following three items have similar terms with different providers. He explained these Memorandums of Understanding are required under the Workforce Development Act to replace the Job Training Partnership Act on July 1, 2000. In response to Commissioner Geile, Mr. Speckman stated there will be no money exchanged; however, there will be some exchange for in-kind services. Commissioner Vaad moved to approve said memorandum of understanding and authorize the Chair to sign. The motion,which was seconded by Commissioner Geile, carried unanimously. CONSIDER MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN -JOB CORPS. Commissioner Geile moved to approve said memorandum of understanding and authorize the Chair to sign. Commissioner Vaad seconded the motion, which carried unanimously. CONSIDER MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN - GREEN THUMB, INC.: Commissioner Vaad moved to approve said memorandum of understanding and authorize the Chair to sign. Seconded by Commissioner Geile, the motion carried unanimously. CONSIDER MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN -DIVISION OF VOCATIONAL REHABILITATION: Commissioner Baxter moved to approve said memorandum of understanding and authorize the Chair to sign. Seconded by Commissioner Vaad, the motion carried unanimously. CONSIDER ACCEPTANCE OF QUIT CLAIM DEED TRANSFERRING PROPERTY FROM INDIANHEAD, LTD., APPROVE QUIT CLAIM DEED TRANSFERRING SAID PROPERTY TO THE TOWN OF WINDSOR, AND AUTHORIZE CHAIR TO SIGN: Art Willis, Weld County Treasurer, stated this is a strip of land approximately 1,586.71 feet by 4.79 feet, which has gone to tax sale every year since 1991. Mr Willis stated he contacted the Town of Windsor which is willing to accept the property located adjacent to other property owned by the Town. Commissioner Vaad moved to accept said Quit Claim Deed transferring the property from Indianhead, LTD., approve the Quit Claim Deed transferring said property to the Town of Windsor, and authorize the Chair to sign. Seconded by Commissioner Baxter, the motion carried unanimously. In response to Commissioner Hall, Mr. Willis stated this property was owned by Indianhead, LTD, but is not part of the Indianhead Subdivision. CONSIDER LICENSE AGREEMENT FOR GIS GEOGRAPHIC DATA AND AUTHORIZE C:HAIR TO SIGN - UNIVERSITY OF NORTHERN COLORADO, DEPARTMENT OF GEOGRAPHY: Bruce Barker, County Attorney, stated this is a standard agreement for use of GIS Data. In response to Commissioner Hall, Mr. Barker stated the University is requesting the use fee be waived. Mr. Warden stated the County has a similar agreement that does not charge a fee for Aims Community College; and Colorado University is planning on requesting this information to be used for educational purposes. He explained a fee is charged for private companies, and in some instances the information is traded with other entities so no charge is assessed. In response to Commissioner Hall, Mr. Barker stated the professors at the colleges will use the information in some publications but will not be allowed to profit from the publication. In Minutes, May 10, 2000 2000-1106 Page 3 BC0016 response to Commissioner Geile, Mr. Barker stated there is a provision which prohibits the professors from using the information and gaining funds from publications. Mr. Warden stated this information is public domain and available to anyone; however, the agreements are designed to keep other entities from obtaining access and then charging others to use it. Chair Kirkmeyer clarified use of the information is addressed under Article 5. Commissioner Baxter moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Vaad, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board. I knew that the zone is an agricultural zone,this is why I decided to make�nth Ican smaller lot.
