RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #2624 - MARK MADSEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #2624, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #2624 was submitted by Mark Madsen, 8134 Weld County Road 75.5, Roggen, Colorado 80652, for property which is located in part of the S1/2, NE1/4 of Section 15, Township 2 North, Range 64 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 70 acres and 10 acres, more or less.. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2624 by Mark Madsen is, approved conditional upon the following: 1. A Weld County Septic Permit is required for the proposed home septic system(s) and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. 3. The applicant shall complete a Non-Exclusive License Agreement for the upgrade and maintenance of Weld County right-of-way. The applicant shall submit evidence to the Department of Planning Services that this has been completed to the satisfaction of the Department of Public Works. 4. At the time an application is accepted for a building permit, a plan review will be completed. A complete review of the building or structure may reveal other building issues or areas needing additional attention. 5. Weld County Road 57 is designated on the Weld County Transportation Plan Map as a section line road. This road is not maintained by Weld County. Pursuant to the definition of"setback" in the Weld County Zoning Ordinance #89, the required setback is measured from the future right-of-way line. 7. Prior to recording the plat: A. The applicant shall provide the Department of Planning Services with a certificate from the County Treasurer showing no delinquent taxes for the parcel being divided. B. The applicant shall adhere to Section 31.5.5 of the Weld County Zoning Ordinance #89-JJ. C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Public Works Department to determine if a culvert is necessary at any approved access point. If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert, the Public Works Department shall be contacted to adequately size the culvert. D. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of "setback" in the Weld County Zoning Ordinance, the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits prior to any construction or excavation. 3) All foundations will require an engineered foundation. Such foundation design shall be based on a site-specific geotechnical report or an "open hole" inspection made by a Colorado licensed engineer. 4) All buildings or structures shall maintain distances from property lines and adjacent buildings as outlined in Table 5-A of the 1997 Uniform Building Code. 5) Prior to the release of building permits on Lots A or B, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. The legal description on such deed shall include the lot and recorded exemption number. 2000-0135 RE2624 RE #2624 - MARK MADSEN PAGE 3 6) Pursuant to Ordinance#169-A, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. 7) RIGHT TO FARM COVENANT: As stated on page 7-1 of the Weld County Comprehensive Plan shall be placed on the plat. 8) Staff supports this application for Recorded Exemption; however, subsequent Recorded Exemptions on adjacent properties will raise the issue of compliance with the intent of the Recorded Exemption process. Approval of this Recorded Exemption does not guarantee approval of future applications on adjacent properties. 9) The approved configuration of Lot A does not constitute justification for further land splits. 8. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The applicant shall be responsible for paying the recording fees. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of the way" of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases,will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 8) Staff supports this application for Recorded Exemption however subsequent Recorded Exemptions on adjacent properties will raise the issue of compliance with the intent of the Recorded Exemption process. BOCC Speech: 1.17.2000 Good Morning, Anne Best Johnson, Department of Planning Services. Show Map 1 Mark Madsen has requested a Recorded Exemption to occur in the Southern half of the Northeast quarter of Section 15, Township 2, Range 64 just North of Keenesburg. The application site is located north of Weld County Road 20, and adjacent to and immediately west of the improved Section line where Weld County Road 57 would be located. On November 2, 1999, Kenneth Madsen submitted three Recorded Exemption applications to the Department of Planning Services. Department of Planning staff expressed concerns to about the three applications and met with Kenneth, Matthew and Mark Madsen on December 14 to express these concerns. As outlined in a letter dated December 20, staff provided options to the applicants. Kenneth Madsen withdrew his application on December 21 , 1999. At the advice of legal counsel, staff approved RE-2626 for Matthew Madsen and proceeded with RE 2624 to the Board of County Commissioners. Based upon submitted information, responses from referral agencies, and the governing mechanism of Weld County, the Department of Planning Services' staff has concerns in approving RE-2624 for Mark Madsen. Staff has the following concerns: 1 . The applicant has not demonstrated consistency with orderly and integrated development in accordance with Subdivision Ordinance Sections 11 .9.10 and 1 .3.1 and Comprehensive Plan UGB.Goal 2 in that this application will create the sixth building site concentrated in this half section, outside of an urban growth boundary. Department of Planning Services has consistently interpreted a Subdivision or Planned Unit Development process as an efficient and orderly means of subdividing land into more than two parcels. The Department of Planning Services has consistently viewed this concentration of Recorded Exemption applications as a circumvention of the Subdivision Process. This application is not consistent with the intention of the Recorded Exemption process in that the concentration equates urban scale development. Show Map 2 Mr. Kenneth Madsen acquired this land in September of 1999 and submitted Recorded Exemption applications in November, 1999 for three of the 80-acre parcels, creating 6 parcels. In addition, four 80-acre parcels are located adjacent to and immediately east of these 80-acre divisions in Section 14, adding 4 building sites. The conflict between rural and urban activities is evident in this request. When an urban growth pattern is established without regard to long range comprehensive planning, the outcome lacks the essential elements of long term desirability. Higher costs are incurred by providing many public services to urban development outside Urban Growth Boundary areas. As urban areas develop and expand they inadvertently influence surrounding areas. These areas are either converted to urban areas themselves or are in direct conflict and competition with agricultural areas. Scattered residential development in rural areas necessitates an increased demand for roads, police and fire protection, education facilities, utilities and other services. The cost of providing services and the conflicts between rural and urban land uses can be reduced if development is encouraged in areas adjacent to existing municipalities. 2. The applicant has not demonstrated conformance with the public improvement plans of the County as outlined in Subdivision Ordinance Sections 1 .3.3 and 11 .8.3, Comprehensive Plan UGB Policy 3.2. It is noted that requirements set forth in Sections 3 and 20 of the Weld County Public Works Policies have not been met. This will also accommodate continuity for potential improvements in the next mile north. 2. The northern terminus of the roadway should include a cul-de-sac with a minimum radius of 50 feet and an easement encompassing the improvement. 3. Currently, there is only a 30-foot right-of-way for the improvement. Staff determined several options for you, as was communicated in a brief telephone conversation to Matthew on the 17th. As I stated to Matthew, a FAX would be sent to you outlining these options. This letter serves as the outline. Facts: 1. Section 31.2.1 of the Weld County Zoning Ordinance states that, "One (1) Single Family Dwelling Unit and Auxiliary Quarters per Legal Lot" are allowed in the Agricultural Zone District. 2. If the Board of County Commissioners hears the applications, and decides that the application(s) do not meet the intention of the Weld County Subdivision Ordinance, the Weld County Comprehensive Plan, or the Weld County Zoning Ordinance, the applicant will loose the application fees. In addition, should the applicant wish to apply for another land use process on the same parcels of land. the applicant is required to have a Substantial Change hearing. Options: 1. I spoke with Mr. Donald Carroll on 10/21/99 with regards to the Weld County specifications and requirements for county roads,as we had plans to improve and widen the existing road on the east side of the above mentioned property. ORDINANCE NO. 180 PAGE 23 The Board of County Commissioners of Weld County resolve that general weed control will be carried out only along designated roadsides to increase motorist visibility at intersections and traffic control signs, and prevent snow drifts along County roads. The methods of weed control used by Weld County shall be by mowing or spraying herbicides. Equipment in the Weed & Pest Division of Public Works will be used. SECTION 18.0: TREES IN COUNTY RIGHTS-OF-WAY Weld County has a duty to protect motorists by ensuring that tree overgrowth from overhanging branches and dead trees do not create road hazards by obstructing visibility. It shall be the policy of Weld County that when trees on private property begin to obstruct visibility on County roads, the property owner shall be given notice to trim the trees within a reasonable time or the County will do so and bill the property owner. If a free or branches from a tree on private property fall onto the County rights-of-way, the tree or tree • branches will be pushed back onto the private property by the County work force. The County shall trim or remove all trees growing in the County-owned rights-of-way that obstruct visibility for the safety of motorists at the County's expense. SECTION 19.0: STRIPING OF COUNTY ROADS Weld County's roads require certain striping, per the Manual on Uniform Traffic Control Devices. Weld County has limited resources for Public Works operations and can only provide minimum services. (See Appendix "E") 20.4 The road must be adequately graded and drained.' • 20.5 A minimum of two inches of crushed rock must be provided on the traveled surface; or if necessary, additional material may be required to support anticipated traffic loads. 20.6 The road cannot be fenced or gated, but if there are cattle in the area, a cattle guard can be installed in accordance with the County cattle guard policy. 20.7 The benefitting parties will be responsible for the costs of all aspects of the project SECTION 21.0: VACATION OF COUNTY ROAD RIGHTS-OF-WAY 21.1 Owners of land adjacent to a County road, street, or alley rights-of-way which are shown as part of an approved or recorded subdivision plat, map, or unincorporated community legally filed prior to any regulations controlling subdivisions, may seek vacation only by means of an application to re-subdivide pursuant to the Weld County Subdivision Ordinance which is administered by the Department of Planning Services. 21.2 Owners of land adjacent to County road rights-of-way,other than those described in Section 20.1, may seek vacation by petition to the Board of County Commissioners through the Clerk to the Board, pursuant to C.R.S. 43-2-303. SECTION 22: OBSTRUCTIONS LOCATED WITHIN WELD COUNTY ROAD RIGHTS-OF-WAY Weld County reserves the right to maintain its road rights-of-way without obstructions located thereon. "Obstructions" include, but are not limited to, fences, trash cans, gates, and irrigation structures, regardless of whether or not they are physically located on the travelled portion.
