BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO: That it is necessary, by Colorado statutes, and by the Home Rule Charter of Weld County, Colorado, to set the annual mill levy for the annual appropriation for Weld County, Colorado, for the fiscal year 1982, and c = WHEREAS, in compliance with an act of law entitled, "An Act to require ri the affairs of the several counties of the State of Colorado to be continued from the revenue derived from taxation and prevent other expenses of any county from exceeding its revenue---", and in accordance with Colorado Revised Statutes, Title 29, Article 1, 1973, "During the fiscal year, no officer, department, board, commission or other spending agency shall expend any money, or incur any liability, or enter into any contract which, by its terms, involves the expenditure of money for any of the purposes for which provision is made in the appropriation ordinance or resolution, including any legally authorized amendments thereto, in excess of the amounts appropriated in said ordinance or resolution for such office, depart- ment, board, commission or other expending agency, or purpose for such fiscal year. Any contract, verbal or written, made in violation of this section shall be void as to the local government, and no money belonging thereto shall be paid thereon.---", and WHEREAS, the Board of County Commissioners, in accordance with Section 14-7 of the Weld County Home Rule Charter had determined that the amount of property tax derived from only a 5% increase would be insufficient for County needs for fiscal year 1982, and WHEREAS, the majority of the County Council, in accordance with Section 14-7 of the Weld County Home Rule Charter, on November 10, 1981 denied an increased levy for the County in excess of the 5% property tax revenue limit therefore restricing the total property tax revenue to $13,253,326 and a total mill levy of 17. 172 for fiscal year 1982. BE IT FURTHER ORDAINED that an emergency exists inasmuch as State law requires that the budget Ordinance of Weld County, Colorado, be enacted on or before the 16th day of November, 1981, and, therefore, this Ordinance is declared to be an emergency Ordinance under the provisions of Section 3-14 of the Weld County Home Rule Charter. The above and foregoing Ordinance No. 95 was, on motion duly made and seconded, adopted by the following vote on the 16th day of November, A.D. , 1981.
