RE.. APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#904 - LIQUID
WASTE MANAGEMENT, INC., CIO MARIE LOUISE GOLLNER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated March 14, 1990, the Board did approve Use by Special
Review Permit#904 for Land Application of Commercial Sludge for Liquid Waste Management
Inc., do Mari Louise Gollner, on the following described real estate, to-wit:
Part of the N1/2 and N1/2SE1/4 of Section 27,
Township 4 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the Board has received a request from Marie Louise Gollner Charitable
Trust, 817 Knapp Drive, Santa Barbara, CA 93108, current property owner, to vacate said Use
by Special Review Permit#904, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendatiors of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Use by Special Review Permit#904 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of, A.D., 2000.

SUBJECT: Milliken IGA: Vacation of Land Use Cases
August 14, 2000
An outcome of the land use research conducted during the Milliken IGA process is the request
of three property owners to vacate land use permits associated with their property. The
property owners were contacted by letter. The process of the vacation hearing and purpose
was explained to the property owner. A total of five property owners were contacted. One
property owner did not want to vacate their permit. The other property owner has not
responded to requests. The three property owners who desire a vacation of their permits ..are
listed as follows:
1. SUP 230 for Lot Holding Investments, LLC (November 28, 1973)
A Special Use Permit for the expansion of an existing cattle feed lot operation located
in the NE4 of Section 14, Township 4 North, Range 67 West of the 6th P.M., Weld County,
Colorado.
2. USR 540 for E-Vap, Limited (December 12, 1983)
A Use by Special Review for an oil and gas brine water disposal site located in part of
the NE4 of Section 26 and part of the NW4 of Section 25, all in Township 5 North. Range 57
West of the 6th P.M., Weld County, Colorado.
3. USR 904 for Marie Louise Gollner (March 14. 1990)
A Use by Special Review for land application of commercial sludge on land located in
part of the N2 and the N2 of the SE4 of Section 27, Township 4 North, Range 67 West of the
6th P.M., Weld County, Colorado.
The Department of Planning Services, on behalf of the property owners, is recommending
these three land use permits be vacated. Property owner consent is evidenced by the attached
letters.
The Department of Planning Services agrees to contact each property owner by letter to inform
them of the established hearing date for the vacation hearings. The Department of Planning
Services further agrees to send each property owner a copy of the Resolution vacating such
use.

shall take place in the Board of County Commissioner's hearing room, located on the first floor of the
Centennial Center, 915 10`" Street in Greeley.
Use by Special Review (USR) 904 was permitted as a Commercial Sludge operation located in the
Southeast Quarter of Section 27,Township 4 North, Range 67 West of the 6th P.M.,Weld County,Colorado.
Your letter approving this vacation was received by the Department of Planning Services on June 6, 2000.
Your representative need not be present for this hearing. However,you are welcome to attend. Please feel

Dear Trustee:
The Town of Milliken and Weld County are in the process of entering into an Intergovernmental
Agreement. This agreement outlines a cooperative planning agreement between the Town and
County. As part of this agreement, staff from the Weld County Department of Planning
conducted research into all land-use applications in Milliken's planning boundary. This research
included a permit on property formerly owned by Marie Louise Gollner, located in part of the
North half and in the North half of the Southeast Quarter of Section 27, Township 4 North,
Range 67 West. Case number USR-904 was issued to Marie Louise Gollner and Liquid Waste
Management, Inc. for a Commercial Sludge operation. This permit is still associated with this
property. The field inspection indicated that perhaps, this permit is no longer in use.
In cases such as this, the property owner has the option of vacating this Special Use Permit.
What a vacation of land use permit means is simply a closing of the permit so that the permit 's
no longer associated with your property, located in part of the North half and in the North half of
the Southeast Quarter of Section 27, Township 4 North, Range 67 West of the 6th P.M., Weld
County, Colorado.
For your ease, I have enclosed a letter for you to complete in requesting that this use be
vacated from your property. By vacating the land-use application, the operation will no longer
be associated with your property. Should you not desire to vacate this permit, please notify me
in writing. Please complete the enclosed form to mail your response to me. Fee free to contact
me with further questions. Thank you.
