Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: A. The applicant shall submit evidence to the Department of Planning Services that any existing septic systems meet all requirements of the Weld County Department of Public Health and Environment. The Weld County Department of Public Health and Environment was unable to locate a septic permit for the septic systems located at 20864 WCR 12 (that includes the office, a principal dwelling, an accessory structure used for an employee of the Hudson Nursery, or the mobile home, also used for farm labor. Any existing septic systems that are not currently permitted through the Weld County Department of Public Health and Environment will require an I.S.D.S. evaluation prior to the issuance of the required septic c)C0C — 3355 110 permit. In the event the systems are found to be inadequate, the systems shall be brought into compliance with current I.S.D.S. regulations. B. The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel. Section line accesses are considered private lanes with no county maintenance. C. The applicant shall submit to the Department of Planning Services, a recorded copy of an access agreement signed by all owners of property which is crossed by the access.The access shall be for ingress and egress and shall be referenced on the plat by the Weld County Clerk and Recorders reception number. D. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved access point. If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert, please contact the Department of Public Works to adequately size the culvert. E. Weld County Road 43 is designated on the Transportation Plan Map as a local gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 43 shall be delineated on the plat.This road is maintained by Weld County. Weld County Road 12 is designated on the Transportation Plan Map as a section line access road. There is presently sixty (60)feet of vacated right-of-way. This road is not maintained by Weld County. F. The applicant shall address the requirements of the Weld County RE-3J School District as stated in a referral response received June 28, 2000. The applicant shall submit evidence to the Department of Planning Services verifying that the occupant of the mobile home and labor house, is principally employed at or engaged in the farming operation on the subject property in accordance with Section 43.2.3 of the Weld County Zoning Ordinance. The evidence shall consist of tax records, employment agreements or other documentation as determined suitable by the Department of Planning Services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. H. All vehicles located on the property must be operational with current license plates, or be screened from all adjacent properties and public rights-of-way, or be removed from the property. All other items considered to be a part of a noncommercial junkyard must also be removed from the property or screened from all adjacent properties and public rights-of-way. The property is in violation of the Weld County Zoning Ordinance. The applicant shall schedule a final inspection with the Weld County Department of Planning Services, prior to recording the plat. The applicant shall provide the Weld County Department of Planning Services with a certificate from the County Treasurer showing no delinquent taxes for the original parcel (mother parcel) area. J. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Zoning Ordinance, the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Al mobile homes as accessory farm uses are temporary. Allowance of the mobile homes shall be extended only if the use continues to be in conformance with the criteria set out in Section 43.2.3.1.1 of the Weld County Zoning Ordinance. The mobile home shall be removed from the property if the mobile home cannot be legally permitted for an approved use as listed in Section 43 of the Weld County Zoning Ordinance. 4) Prior to the release of building permits the applicant shall submit evidence to the Department of Planning Services that Lots A and B have an adequate water supply of sufficient quality, quantity and dependability. 5) RIGHT TO FARM COVENANT Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning;flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 6) Prior to the release of building permits, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. The legal description on such deed shall include the lot and Recorded Exemption number. 7) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169A. 3. The applicant shall submit a mylar plat to the Weld County Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty(60)days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. 4. The Weld County Department of Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions. The nursery is an "out of town" water customer. Since 1988 there has been a prohibition on out of town water taps. • The following section of the Hudson Municipal Code is included for your reference. This section was added in 1988. Sec. 13-10. Declaration of policy. (a) The town water system is primarily for the use and benefit of the residents within the municipal limits of the town. Any sale of water to property or users outside the municipal limits of the town is subject to the paramount rights of the users within the town limits. The water system, and the granting of taps for use of the water system, are primarily for the purpose of improvement and development of the land within the town, and not for use on vacant land or for speculation. (b) Pursuant to the powers vested in the town by Section 31-15-708, C.R.S., the board of trustees ordains this article to ensure that the citizens of the town receive water supply services that are adequate to protect and promote the health, safety and welfare and to cultivate and preserve the town's natural resources, environment and aesthetic qualities of life. Although recorded exemptions,individually,represent a small increment of the total housing stock,the cumulative effect of several such approvals is exerting a considerable negative effect upon the school district's ability to provide adequate educational opportunities for the resulting students. Additionally,the substantial separation of these units from other more densely populated areas increases school transportation costs,further eroding the amount of funds that can be applied in the classroom toward educating the students. The school district's Board of Education is opposed to approval of additional new housing without adequate mitigation of both land and facility costs. However, in the event that the County Commissioners decide to approve this application,Weld County School District Re-3(J)respectfully requests that these exemptions be required to mitigate the costs of providing land for school sites as well as capital construction costs for the necessary educational structures; the rationale for the costs follows. Site Issues Based upon the district's school capacities and site size standards,the proposed exemption would generate the need for less than one acre of land;the cash equivalent would approximate$691 per unit(see Table 1). If approved, it is requested that this amount be paid to the school district as cash-in-lieu of land dedication for each new unit allowed. Facility and Fiscal Capacity Issues Current facilities that would serve this development are Keenesburg Elementary and Weld Central Junior/Senior High. Capacities(following construction of the new elementary in Keenesburg and the funded expansion to the junior-senior high)and enrollments of these schools are: School Student Capacity Enrollment 10/01/99 Seats Available(short) Keenesburg Elementary 113 307 (194) Hudson Elementary 228 610 (382) Weld Central 659 684 ( 25) With opening of the new elementary school in Keenesburg,capacity at this school level will expand to 462 and be adequate for a few years. The remaining elementary school in Hudson is also beyond capacity and will not provide sufficient seating capacity to act as a meaningful overflow facility. A third elementary school is to be constructed �r a in Lochbuie that may assist with alleviating certain space shortages over the next few years in that area. Considering the distance to this facility,it will not provide meaningful facility space assistance for the Keenesburg area. Even after construction of the funded addition to Weld Central,capacity will still be inadequate at this school level. Two portable classroom units(four classrooms)were added to Weld Central in the 1998-1999 school year and certain of the portables at the existing elementary school will be relocated to this facility to assist with the seat shortages. At present, the district's bonding capacity approximates$19.0 million,or 20 percent of assessed valuation per state statute. The November 1999 bond election included$16.9 million for facility needs throughout the district. Combined with prior debt,this leaves about$2 million of bonding capacity to provide space for additional new growth. Even if the district received voter approval to issue additional debt,the available funding would fall well short of providing the facility space needed to supply seats for students the district will be required to serve from other already approved residential developments. This along with the two-year lag in receiving property tax revenues from new construction substantially compounds the district's ability to adequately provide capacity for students. These fiscal constraints substantially limit the potential to provide needed educational facilities. Unless school construction is enabled by some mechanism(s),certain interim capacity enhancing measures will be required above and beyond addition of portable classrooms. Many of these mechanisms are not well accepted by the district or its constituents. As illustrated in Table 2, the gross cost to provide school structures to serve single-family homes approximates $8,788 per unit. After deducting for future taxes that will be paid to the district for current bond redemption payments, the net unmet cost per unit will approximate $6,807 per unit. It is requested that this per unit sum be paid by the development to mitigate the excess facility costs attributable to these housing units. Payment at building permit or certificate of occupancy would be acceptable. Recommendations The school district remains very concerned about the recent trend toward accelerated residential activity throughout the district and the ensuing enrollment that will follow as well as the district's physical and financial ability to serve that growth. Approval of additional residential development without a ready and identified means of providing appropriate infrastructure would not demonstrate good stewardship of the public trust. It is requested that the proposed project mitigate land dedication requirements as well as the unmet capital costs that will be experienced in the amounts specified above. Further the school district will recommend that the Town Board require such mitigation as a condition of project approval.
