HomeMy WebLinkAbout20000242.tiff vi-3/ -2a80 ORDINANCE NO. 69-B IN THE MATTER OF THE REPEAL AND RE-ENACTMENT OF ORDINANCE NO. 69-A, AMENDING THE COUNTY DEVELOPMENT REVENUE BOND POLICY FOR WELD COUNTY, COLORADO BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on October 13, 1980, the Board of County Commissioners of the County of Weld, State of Colorado, adopted Ordinance No. 69-A, which repealed and reenacted Ordinance No. 69, adopting a County Development Revenue Bond Policy for Weld County, and WHEREAS, Section 1.2 of said Ordinance No. 69-A states the following: "The County will not employ the provisions of the 1967 County and Municipality Development Revenue Bond Act to industries presently located in other parts of the State of Colorado if the result of such act is to induce removal of these industries from their present location", and WHEREAS, the Board of County Commissioners now wishes to strike said Section 1.2 from Ordinance No. 69-A, and WHEREAS, said Section 1.2 is not necessary for inclusion in said Policy in accordance with state law. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that Ordinance No. 69-A be, and hereby is, amended by striking Section 1.2 therefrom. BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. 2000-0242 ORD69-B RE: ORDINANCE NO. 69-B PAGE 2 The above and foregoing Ordinance Number 69-B was, on motion duly made and seconded, adopted by the following vote on the 14th, day of February, A.
