RE: City of Greeley Franchise Election
Dear Mayor Wones:
This letter is in response to your letter of May 22, 2000, requesting that the City of Greeley
franchise election be coordinated with the August 8, 2000, Primary Election to be conducted by
the Weld County Clerk and Recorder.
I have considered your request and wish to respectfully decline. Such proposed coordination
would require the rewriting of computer codes for the voter registration system in order to read
the results according to precincts rather than according to party affiliation only. The rewriting
would put the system at risk of error with little, if any, time to test and correct possible mistakes
in the codes. Additionally, the proposed coordination would increase the number of ballot types
from 21 to 40. This increase in the number of ballot types would also place the system at risk of
mistakes by the election judges. I cannot allow the system to be subject to these risks.

Dear Barbara:
The City of Greeley is negotiating with Wide Open West Cable regarding a possible new
franchise in the City. Greeley's Charter requires a vote for new and renewed franchises, and
election costs associated with the "franchise" election would be paid for by the franchisee.
Wide Open West has completed negotiations in Boulder and Denver and secured a place on
the coordinated ballot for the Primary Election in those communities. In anticipation of successful
negotiations with Greeley, Wide Open West would like to unite their campaign efforts in all three
cities for the August 8`e election, and if successful at the polls, would like to begin its business as
soon as possible.
As you are aware, the City of Greeley requested to participate in the August 8`I' Primary as a
coordinated effort with Weld County and the request was respectfully declined. The County Clerk
indicated in her response, and the City Clerk concurred, that an alternative to a coordinated
election on Primary day would be a mail ballot election. This alternative is addressed in the
Municipal Election Code in Section 31-10-108. During the process of preparing for the mail bailot
election, the City Clerk was informed by the Secretary of State's Office that a mail ballot election
can not be conducted at the same time as the Primary pursuant to the Mail Ballot Election Code,
specifically Section 1-7.5-104(2)(b). If desired, a copy of the written opinion can be forwarded to
you as soon as it is received.
I am seeking your support in a reconsideration of the City's request to participate in a
coordinated effort for the August 8`I' Primary. [ understand the County Clerk's concerns with
managing the "fringe" boundary precincts and multiple ballot styles, both inherent in combining
jurisdictions. A coordinated effort is certainly more convenient for our constituents and will
benefit Wide Open West as well. Your consideration is appreciated.
