HomeMy WebLinkAbout20002093.tiff HEARING CERTIFICATION DOCKET NO. 2000-39 RE: CHANGE OF ZONE #546 FROM THE R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICT TO THE I-3(INDUSTRIAL)ZONE DISTRICT -J QUARTER CIRCLE COMPANY A public hearing was conducted on August 30, 2000, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tern Commissioner George E. Baxter Commissioner Dale K. Hall - EXCUSED Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Julie Chester Health Department representative, Pam Smith Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated August 7, 2000, and duly published August 10, 2000, in the South Weld Sun, a public hearing was conducted to consider the request of J Quarter Circle Company, do Bruce Johnson, for Change of Zone #546 from the R-1 (Low Density Residential) Zone District to the 1-3 (Industrial) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record, and stated the Department of Planning Services staff submitted a photograph of the sign posted at the site, marked Exhibit E. Chair Kirkmeyer advised Bruce Johnson, agent for the applicant, that he has the option of continuing this matter to a date when the full board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Hall will listen to the record and make the determining vote. Mr. Johnson indicated he would like to proceed today. Julie Chester, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Chester gave a brief description of the location of the site, stated all nine referral agencies responded favorably to this request and proposed conditions, and she reviewed the surrounding uses which include industrial and residential. In response to Commissioner Baxter, Ms. Chester stated there is some oil and gas equipment on the site; however, there is no other development on the site. Responding to Commissioner Geile, Ms. Chester stated the Recorded Exemption submitted by the applicant was approved by staff and the plat will be recorded once the surveyor is done with it. Ms. Chester clarified this Change of Zone application covers both lots of the Recorded Exemption, and added the applicant did speak with the City of Greeley regarding annexation of this site; however, the City was not interested. 000-2093 /5/ /7L( e7 2, G FL1428 HEARING CERTIFICATION - J QUARTER CIRCLE COMPANY (USR #546) PAGE 2 In response to Commissioner Baxter, Mr. Johnson stated the applicant intends to use the property for agribusiness. Responding to Commissioner Vaad, Mr. Johnson stated City of Greeley unanimously voted not to annex the site although the applicant was proposing to install utilities. Responding to Commissioner Geile, Mr. Johnson stated there is a business ready to use Lot A if this request is approved. Fred Otis, attorney for the potential business to use the site, speculated the City may not have wanted to annex this parcel because of its current zoning. He stated his client is looking forward to operating his birdseed operation from this location. In response to Chair Kirkmeyer, Mr. Otis stated he and his client have no concerns with the Conditions of Approval Responding to Commissioner Baxter, Mr. Otis stated the company will be buying bird seed and millet locally which will benefit Weld County. In response to Chair Kirkmeyer, Mr. Johnson stated he has reviewed and agrees with the Conditions of Approval. Commissioner Vaad moved to approve the request of J Quarter Circle Company, c/o Bruce Johnson, for Change of Zone#546 from the R-1 (Low Density Residential)Zone District to the 1-3 (Industrial) Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously Th:s Certification was approved on the 6th day of September 2000.
