HomeMy WebLinkAbout20000770.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING REVIEW OF CONDITION OF APPROVAL FOR USE BY SPECIAL REVIEW#1251- PAT AND AMANDA WEAKLAND WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on January 26, 2000, the Weld County Board of Commissioners approved Use by Special Review#1251, for property which is described being part of Lot B of Recorded Exemption #1425, being part of the E1/2 SW1/4 of Section 18, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado, for a Commercial Greenhouse/Garden Center in the A (Agricultural) Zone District, with Conditions of Approval, and WHEREAS, the request to the Board of County Commissioners for review of Condition of Approval #2.1 for Use by Special Review Permit#1251 was submitted by Pat and Amanda Weakland, 6461 Highway 392, Windsor, Colorado 80550, and WHEREAS, after reviewing recommendations from the Weld County Departments of Planning Services, Public Works, and the County Attorney's Office staff, and hearing the testimony presented, the Board deemed it advisable to approve the request to delay posting of collateral in conjunction with an improvements agreement as required by Condition of Approval #2.1 for Use by Special Review Permit#1251. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Pat and Amanda Weakland to delay posting of collateral in conjunction with an improvements agreement as required by Condition of Approval #2.1 for Use by Special Review Permit#1251, be, and hereby is, approved. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 3rd day of April, A.D., 2000. Chester, Lead Planngr *' /A SUBJECT: Condition of approval 2.1. for USR-1251 The Department of Planning Services' is requesting the Board of County Commissioner's review the above referenced Condition of Approval for USR-1251 (attached). Normally, as a part of the Improvements Agreement, the applicant is required to post an approved form of collateral for the improvements. However, the Department of Public Works has indicated that paving for this USR does not need to be in place until four years from the date of approval of the application. It is the recommendation of the County Attorney's Office, Department of Planning Services'and Department of Public Works, that no collateral be required as a part of the Improvements Agreement. If the paving is not in place after the four year time frame, the County may require an approved form of collateral at that time. Thank you for your consideration in this matter. 2000-0770 Hello
