Dear Ms. Johnson:
Your letter of May 12, 2000 to Jennifer Torrey regarding Meadow Vale Farm Phase II PUD
has been provided to me for response. It is my understanding the Clerk to the Board will not set up
the case for Board Hearing until a Deed describing the property owner's interest in the land is
provided. Enclosed is a photocopy of a Quit Claim Deed recorded on January 23, 1995 which
indicates that Katharine Hamm Oliver is the owner of the Southwest Quarter of Section 4, Township
2 North, Range 68 West of the 6th P.M. Both my client and I feel some additional explanation of the
Deed will avoid any additional suspicion by Weld County that Mrs. Oliver is not the owner of the
property.
In December of 1983, Mrs. Oliver along with other members of her family formed a limited
partnership known as JCK Farm, LTD. The members of the limited partnership included Richard E.
Hamm, Emma Alice Hamm, Carolyn Hamm Tucher in addition to Mrs. Oliver. In October of 1988,
Richard E. Hamm died and his interest was transferred to his wife, Emma Alice Hamm. In 1990
Emma Alice Hamm gifted her partnership interest to her two daughters, Carolyn Hamm Tucher and
Katharine Hamm Oliver. In 1995 Katharine Hamm Oliver purchased her sister's interest in the
partnership and became the only remaining member of the limited partnership. The Quit Claim Deed
recorded on January 23, 1995, enclosed with this cover letter, represents the transfer of the ownership
interest of Carolyn Hamm Tucher to Katharine Hamm Oliver and is the evidence of Katharine Hamm
Oliver's ownership of the property. I am also enclosing a photocopy of a Deed dated December 29,
1983 which shows the original transfer by Mrs. Oliver and her family to the limited partnership known
as JCK Farm, LTD.
As you are aware the property in question is divided by Weld County Road 5 Y. The
property line west of Weld County Road 5 'h has previously been subdivided and is known as the
Meadow Vale Farm. Copies of those Deeds have not been included because it is not relevant to the

remaining property which lies east of Weld County Road 5 1/2. The remaining 44.42 acres which has
been submitted as the Meadow Vale Farm Phase II PUD is the only remaining property that Mrs.
Oliver owns in the Southwest Quarter of Section 4, Township 2 North, Range 68 West.
I believe this letter of explanation in addition to the Deeds should be sufficient to allow Weld
County to complete the processing of the Change of Zone Application. Please notify Mrs. Oliver by
mail at her address, which is 2385 Homestead Place, Longmont, CO 80504, when the matter will be
set for hearing before the Board of Commissioners. If additional issues need to be resolved, please
contact me immediately.

Dear Jenny:
Thank you for your timely submittal of maps to the Clerk to the Board. Unfortunately,the Clerk to the Board
does not have the capabilities of reducing large maps into required Board of County Commissioner format.
Please submit the maps in 8-1/2 x 11 inch format. Thank you.
In addition, the Sketch Plan application and the Change of Zone application did not include a copy of the
Deed. The Clerk to the Board will not set the case up for Board hearings until a deed describing the property
owners interest in the land is provided.
And lastly, at the Sketch Plan and initial Change of Zone phases, staff comments did not include the need
to amend USR-1199. Prior to recording the Final Plat, the applicant will be required to amend the Use by
Special Review case. This requirement will be suggested to the Board of County Commissioner's hearing
of Change of Zone-539 as a condition of approval prior to recording the Final Plat. This amendment
procedure can take place concurrently with the Subdivision process.

COMMENTS: After this morning's staff meeting, I spoke with Lee Morrision (Assistant County
Attorney) concerning these subject issues. Mr. Morrison and fellow staff members concurred that a
Deed describing the area for Meadow Vale Phase II is needed. The Clerk to the Board will not set a
Board hearing date for COZ-539 until a recorded deed is provided. I did receive the maps for the Clerk
to the Board on May 18, 2000. These will be send to the Clerk to the Board along with your deed. After
which, a hearing date will be established.
Secondly, the portion of land under consideration as Meadow Vale Phase II that is part of USR-1199 will
need to be amended out of USR-1199 prior to recording the Final Plat for Meadow Vale Phase II. The
Final Plat and USR Amendment process may occur concurrently.

My attorney, Glen Droegemueller is working with Lee Morrison on providing a copy of the
Deed to show that my wife Katharine H. Oliver is the owner of the land we are attempting
to have changed in zone. I do not understand why a certificate of ownership from the Weld
County Assessors Office showing the partial number and that party who owns the partial is
not stOdent
Lastly, Mountain View Fire Protection is reviewing and will soon forward a letter saying that
are satisfied with our design, hydrant location, water main size and fire flows.
This concludes what I have been doing. I just wanted you to be up-dated prior to a hearing

Dear Gregg;
This letter is written to request partial release of Western Mobile's (WMI)
reclamation obligation for that portion of MLRB Permit#M-87-176(Hamm Pit) located
west of St. Main Creak and North of Colorado Stare Highway 119.To date, W M1 has
completed all mining of this part of the Hamm Pit and the majority of the reclamation work
including grading,shaping and reseeding.
WMTs request for partial release is the result of the property owner's residential
development plans associated with this area of the Hamm Pk.The owner of the property.
Mrs.Katharine H. Oliver, has asked WMI to obtain partial release from the Mined Land
Reclamation Board in order that development plans for this area can proceed.
Assisting us with this request is our consultant Mr.Mike Hart who recently spoke to
Mr.grace Humphries regarding this matter.Tins written request for partial release was
prepared pursuant to Mr.Humphries'guidance and ieetnetea the property owner's written

On December l5, 1998, the Colorado Division of Minerals and Geology approved your request for
release of a portion of the permit area from further reclamation responsibility. The permit area was
reduced to 115.4 acres, through the release of 94,6 acres in this permit action. Because the permit is
not totally released,you are still liable for filing annual reports and fees. Also,the amount of financial
warranty required for remaining disturbances is being evaluated by the Division as part of the
operator's current amendment request.

Since the Planning Commission hearing on April 18, 2000, three additional items have been
brought to the attention of the Departments of Planning Services. These items are of
significance which merit additional Conditions of Approval. These items will require an addition
made by the Board of County Commissioners at the July 12 hearing.
New Conditions of Approval:
Condition of Approval 22B is being added due to the fact that realignment of WCR 5.5 has
never been recorded, as noted in a letter dated May 22, 2000 from King Surveyors to the
Department of Planning Services. The Department of Public Works and Planning Services
would like to have this realignment recorded with the Change of Zone plat for Meadow \/ale
Farms Phase II.
New 22B: The realignment of Weld County Road 5.5 shall be recorded with the
Weld County Clerk and Recorder.
The applicant submitted a Specific Change of Zone application. Sketch Plan comments were
clear in indicating that the applicant must follow the PUD Development Guide components for
the Change of Zone application. However, the Department of Planning Services and Public
Works have concerns regarding Sections 6.3.2.2.1.7 and 6.3.2.2.1.6 of the PUD Ordinance.
These specific requirements have been addressed through Conditions of Approval in this
Change of Zone application. The Department of Planning Services would like to add a
Condition of Approval that the third phase of the PUD, the Final Plat, come before the Board of
County Commissioners for approval as required through the Conceptual option. The applicant
and their representative were contacted concerning this request prior the Planning Commission
hearing. The applicant agreed to this condition at the April 18 Planning Commission hearing
New 23A: The applicant shall submit a Conceptual application for the Final Rat
phase of the Planned Unit Development.
Conversations with Assistant County Attorney Morrison indicate a need for the following
addition. The applicant, the representative, and the applicant's attorney are aware of this
requirement and have agreed to amend USR-1199 accordingly.
New 23B: The portion of land under consideration as Meadow Vale Phase II that is
also part of USR-1199 shall be amended out of USR-1199 prior to
recording the Final Plat.

Dear Ms. Johnson:
I was asked to provide the following information to you by Mr. Floyd Oliver. This matter is
about the realignment of Weld County Road 5.5 (WCR#5.5) at its intersection with State
Highway #119.
As you are aware this right-of-way was initially platted within Meadow Vale Farm PUD First
Filing as recorded October 23, 1996 in Book 1573 as Reception Number 2517104 of the records
of the Weld County Clerk and Recorder. Since the time of that platting it's position has been
realigned, which is not reflected within any current recorded subdivision plat.
Please find enclosed a preliminary subdivision plat for the area to the East of WCR #5.5. We
have included whoever a portion of the first filing within this plat to address this realignment
issue and the vacation of the previously dedicated right-of-way.
